The Council went into the consideration of Executive business ; and having disposed of the same, the doors of the Council Chamber were opened; and,

The Sergeant-at-Arms announced another message on Executive business

And said message was delivered by the hands of Mr. E. A. Brush.

On motion of Mr. Stockton, the Council then went into the consideration of Executive business; and having disposed of the same, On motion of Mr. Durocher, adjourned.

TUESDAY, Sept. 22, 1829.

Prayer by the Rev. Mr. Richard.

Mr. Drake, from the committee of Enrolment, reported as correctly enrolled bills with the following titles, viz:-"an act to amend an act, entitled 'an act to organise the county of Lenawe;" "an act for the relief of Lewis Greaves;"" an act to dissolve the marriage contract between William Chapel and Lucy Chapel ;" also, "a resolution authorising the Librarian to cause books and pamphlets to be bound ;" and the President signed the same.

Mr. Lawrence, from the committee on the Judiciary, reported the following entitled bills, viz:

A bill to amend an act, entitled "an act relating to interest on contracts;"

A bill to amend an act, entitled "an act to provide for the election of a Delegate in the Congress of the United States ;" and,

A bill to amend an act, entitled "an act concerning judgments and executions," (approved April 12, 1827,) and the "act concerning Mortgages ;'

And said bills were severally read the first time and laid on the table.

A bill to amend an act, entitled "an act authorising Administrators de bonis non, to prosecute suits commenced by the executor or administrator of the estate, and for other purposes," approved July 3, 1828, was taken up, and having been amended by inserting after the words now have," in the 7th line of the 1st section, the words, 66 or shall hereafter have," said bill was read the third time and passed.

Mr. Lawrence, at the request of the President, took the Chair. The resolution relative to the repeal of the act, entitled " an act relative to the Mission Family at Michilimackinac," submitted yesterday by Mr. Stockton, was taken up ; and,

The President having resumed the Chair, Mr. Schoolcraft moved that said resolution be rejected by the Council. The motion was decided in the negative.

Mr. Stockton then moved that said resolution be adopted; and the motion was agreed to.

The resolution relative to amending the "act concerning Estrays," submitted yesterday by Mr. Brown, was taken up and adopted.

Mr. Noble submitted the following, which was read and laid on the table:

Resolved, That the President and Directors of the Bank of Monroe be required to furnish the Legislative Council with a statement or return, which will state the amount of the capital stock paid; of the debts due the same; of the moneys deposited therein; of the notes in circulation; and of the specie on hand; in conformity with the requisitions of the "act to incorporate the Bank of Monroe," and the act to amend said act, approved May 21, 1828.

Mr. Rumsey submitted the following, which was read and laid on the table:

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of so far amending the act regulating Justices of the Peace, as to permit all Justices who are Attorneys, licenced to practice law in the Supreme Court of this Territory, to practice and plead before Justices of the Peace.

The "bill to provide for laying out certain counties, and for other purposes," heretofore reported as among the unfinished business of the last session of the Council, was taken up and read the first time; and,

On motion of Mr. Noble, said bill was then read the second time by its title and referred to the committee on Territorial Affairs.

The President announced that he had presented to the Governor for his signature, the bills this day reported from the committee of Enrolment; also, the bills reported from said committee on the 17th and 18th inst.

Mr. President-The Governor of the Territory approved and signed on the 17th inst. " an act relative to the appropriation for the expenditures of the Legislative Council of the Territory of Michigan, for the year 1829." On the 21st inst. he approved and signed, an act for the relief of Mahala Fowler ;" and to-day he has approved and signed, an act for the relief of Lewis Greaves ;" an act to dissolve the marriage contract between William Chapel and Lucy Chapel, of the county of Monroe, in the Territory of Michigan ;"" an act to amend an act, entitled an act to organise the county of Lenawe;" and "a resolution to authorise the Librarian to cause books and pamphlets to be bound."

On motion of Mr. Rumsey, the Council then adjourned.

WEDNESDAY, Sept. 23, 1829.

Prayer by the Rev. Mr. Richard.

Mr. Durocher presented the petition of Lucy Lawrence, of the ounty of Monroe, (accompanied by the depositions of sundry per

sons,) praying that a law may be passed to dissolve the matrimonial ties existing between her and John Lawrence. The petition and accompanying depositions were referred to the committee on the Judiciary.

Mr. Drake, from the committee of Enrolment, reported as correctly enrolled the bill entitled "an act to amend an act, entitled an act authorising Administrators de bonis non, to prosecute suits commenced by the executor or administrator of the estate, and for other purposes ;" and the President signed the same.

A bill to amend an act, entitled "an act to provide for the election of a Delegate in the Congress of the United States," was taken up and read the second time. Said bill was then considered as in committee of the whole; and,

On motion of Mr. Lawrence, it was then ordered to be engrossed and read a third time on Monday next.

A bill to amend an act, entitled "an act for establishing Courts of Probate," was taken up; and having been considered as in committee of the whole, and read a third time,

On motion of Mr. Drake, said bill passed."

Mr. M'Donell submitted the following resolution, which was read and laid on the table:

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of passing a law that shall require of any person who shall hereafter apply to the Legislature for a divorce, to give a notice, for at least thirty days, in some public newspaper printed in the Territory, of such intention, previous to the sitting of the Legislature.

The resolution submitted yesterday by Mr. Noble, relative to the Bank of Monroe, was taken up and adopted.

The resolution relative to permitting Attorneys who are Justices of the Peace, to plead and practice in the courts of other Justices, submitted yesterday by Mr. Rumsey, was taken up and adopted. Mr. Stockton submitted the following resolution, which was read and laid on the table:

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of so amending the Judiciary laws, that hereafter the sessions of the Supreme, Circuit, and County Courts, shall commence on Tuesday instead of Monday; and that hereaf ter the Grand and Petit Jurors of said Courts shall be returned on the first day of the terms thereof.

Mr. Rumsey submitted the following resolution, which was read and laid on the table:

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of amending the act regulating appeal; from a Justices' Court, and providing by law that any person or persons, who shall appeal from said Court, shall be required to give security to pay all costs of suit within forty-eight hours after judg

ment.

On motion of Mr. Connor, the Council went into the consideration of Executive business; and having disposed of the same, On motion of Mr. Trowbridge, adjourned.

THURSDAY, Sept. 24, 1829.

Prayer by the Rev. Mr. Richard.

Mr. Brown presented the memorial and petition of Lucy Berthelet, praying for the passage of a law to dissolve her marriage with Lewis B. Berthelet. Read and referred to the committee on the Judiciary.

Mr. Rumsey presented the claim of Samuel Van Fossen, for services as a Commissioner to lay out a Territorial Road. Read and referred to the committee on Claims.

The President presented a communication from the Grand Jury for the county of Lenawe, requesting, for reasons stated therein, that the County Court of said county, may be abolished. Read and referred to the committee on the Judiciary.

Mr. Drake, from the committee of Enrolment, reported as correctly enrolled, a bill with the following title, viz: "An act to amend an act, entitled' an act for establishing Courts of Probate," (approved April 12, 1827 ;) and the President signed the same.

Mr. Drake, from the committee on the Judiciary, reported, A bill to amend an act, entitled "an act concerning appeals and writs of error, certiorari, and habeas corpus," (adopted by the Governor and Judges on the 21st day of December, 1820;) which was read the first time and laid on the table.

Mr. M'Donell, from the committee on Territorial Affairs, to whom the subject was referred, reported a memorial to the Congress of the United States, asking an amendment in the laws of Congress, in relation to this Territory, so as to give an additional body to the Territorial Legislature. And the memorial was read and laid on the table.

Mr. Lawrence, from the committee on the Judiciary, reported, A bill to prevent the abatement of actions in certain cases; which was read the first time and laid on the table.

Mr. Stockton, from the committee to examine the unfinished business of the last session, reported,

A bill to prevent the obstruction of navigable Rivers;

A bill relating to the duty of the Secretary of the Territory of Michigan; and,

A bill to amend the several acts to organise the Militia.
And said bills were laid on the table.

Mr. Lawrence, from the committee on the Judiciary, to whom was referred the petition of Robert Abbott, Ellis Doty and Thomas Rowland, Justices of the Peace, made a verbal report adverse to the prayer of the petitioners; and,

On motion, said petition was laid on the table.

Mr. Lawrence, from the committee on the Judiciary, also reported,

A bill to dissolve the marriage contract between John Lawrence, late of the county of Monroe, blacksmith, and Lucy Lawrence, his wife; which was read the first time and laid on the table.

Mr. Trowbridge, from the committee on Territorial Affairs, reported,

A bill for the relief of overscers of Highways; and

A bill to amend "an act concerning Estrays;"

And said bills were severally read the first time and laid on the table.

Mr. Stockton, from the committee on Territorial Affairs, reported, A bill to repeal a certain act therein named; which was read the first time and laid on the table.

The "bill for the relief of blacks and mulattoes," was taken up, and having been considered in committee of the whole, the further consideration thereof was postponed until Wednesday next.

Mr. M'Donell submitted the following resolution, which was laid on the table:

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of so amending the criminal laws of this Territory, that the private prosecutor or complainant shall not be liable for costs in any case where the prosecutor is not a party interested.

On motion of Mr. Schoolcraft,

Resolved, That the committee on the Judiciary be instructed to inquire into the condition and prospects of the Missionary Establishment at Michilimackinac, so far as the subject is matter of public concern; and that they have power to send for persons and papers.

The resolution relative to providing by law, that notice of intended application for divorce shall be given, submitted yesterday by Mr. M'Donell, was taken up and adopted.

On motion of Mr. Stockton, the Council went into the consideration of Executive business; and having disposed thereof,

Mr. Drake moved that the Council adjourn until Monday next. The motion was agreed to, and,

The Council adjourned.

MONDAY, Sept. 28, 1829.

At half past eleven o'clock, A. M. the President directed a call of the Council, and it was found that the following members were absent, viz:

Messrs. Drake, Durocher, Irwin, Lawrence, Noble, Rumsey, Schoolcraft, Stockton, and Trowbridge.

There not being a sufficient number of members present to form a quorum, the President declared the Council to be adjourned until the usual hour to-morrow.
