The bill for the relief of Peter Van Every was read a third time.

Mr. Stockton moved that the bill pass.

Mr. Brown presented a certificate of O. Hawkins, on the subject of the matter for which relief had been prayed, which was read.

The question on the passage of the bill being put, the bill was rejected,

On motion of Mr. Fletcher,

The vote just taken was reconsidered, and the bill being again before the Council,

On motion, it was recommitted.

The bill for the relief of Benjamin Woodworth, and for other purposes, was read a third time.

Mr. Bartow moved that the bill pass. It was decided that the bill pass, and that the title be

An act for the relief of Benjamin Woodworth and for other purposes.

The bill making certain appropriations, to be paid out of the Territorial Treasury for the year 1831, was read the third time.

Mr. M'Donell moved to strike out in the 2d section after the words 'contingent fund,' all to the words 'Thomas Simpson,' and insert the words $100, for contingent expenses, to be at the disposal of the Governor,' The motion was negatived.

Mr. M'Donell moved to strike out all between the words "contingent fund" and "two hundred dollars." The motion was negatived.

Mr. Lawrence moved to amend by adding the following. To Allen Farquar a sum not exceeding $104, for his services, time and expences, in serving a requisition of the Governor of this Territory on the Governor of Ohio, and the warrant of the Governor of Ohio, for certain persons in that state indicted in this Territory in the county of Monroe. Provided, that the Auditor of the Territory shall admit and allow said Farquar such sum as he shall find justly due according to law. The motion prevailed.

Ayes 8. Nays 4.

Those who voted in the affirmative are.

Messrs. Brown, Durocher, Fletcher, Lawrence, M'Donell, Schoolcraft, Stockton, Edwards-8.

In the negative,

Messrs. Bartow, Drake, Kingsley, Le Roy-4.

Mr. Stockton moved further to amend, by adding 'to

George A. O'Keeffe and others, a sum not exceeding two hundred and twenty-eight dollars, for services rendered in two cases of murder tried in the county of St. Clair, as audited by the Supervisors of said county.' The motion was negatived.

Mr. Kingsley moved that the bill pass.

Mr. M'Donell moved to amend the bill, by adding these words, 'that one hundred and fifty dollars be paid to the officers, and non-commissioned officers and privates of the 1st Battalion of Riflemen, that attended at the execution of Stephen G. Simmons, convicted of murder.'

The amendment was rejected.

Mr. M'Donell moved to reconsider the vote taken on the amendment offered by Mr. Lawrence.

The motion prevailing, and the question being on accepting the amendment, it was decided in the negative. So the amendment was stricken out. The question being on the passage of the bill, it was decided that the bill pass, and that the title be,

An act for making certain appropriations, to be paid out of the Territorial Treasury for the year 1831.

Mr. M'Donell submitted, and moved the adoption of the following resolution.

Resolved, That the Secretary of the Territory be directed to furnish to the Legislative Council on the first day of its next session, a list of all the officers, civil and military, commissioned by the Executive of the Territory, since the organization of a Territorial Government, designating the rank that such respective officers hold, with the date of their commissions, so far as is practicable. And a list of all officers, civil and military, that shall then be actually in commission in the Territory, designating their rank, with the date of their respective commissions.

The question being taken, was determined in the negative.

Mr. Fletcher from the Judiciary committee, to whom was recommitted the bill for the relief of Peter Van Every, reported the same with amendments.

The amendments being concurred in,
Mr. Fletcher moved that the bill pass.

It was decided that the bill pass, and that the title be,
An act authorising the Supervisors of the county of
Wayne to grant a certain discharge to Peter Van Every.
The report of the committee on Printing was taken up
and read, and on motion of Mr. Kingsley, amended by strik-

ing out the name of George L. Whitney, and substituting the name of Thomas Simpson, and by striking out the name of Thomas Simpson, at the close of the report, and substituting that of Samuel Dexter:

Mr. Kingsley moved that the Council concur in the report.

Mr. Stockton moved to amend by striking out the name of Samuel Dexter, and inserting that of George L. Whit

ney.

The Council took a recess for one hour.

Mr. Fletcher from the committee on Enrolment, reported as correctly enrolled, bills with the following titles.

An act to amend the Act for establishing courts of Probate. A resolution relative to the southern boundary of the Ter ritory.

An act to restrict the jurisdiction of the County Courts of the counties of Wayne, Macomb, St. Clair, and Oakland, and for other purposes.

An act for the relief of Benjamin Woodworth, and for other purposes.

An act to alter the time provided for the assessment of taxes in the county of Chippewa, and for other purposes.

An act to incorporate the first Presbyterian Church of Mackinac.

An act for the preservation of health, and the removal of nuisances within three miles of the city of Detroit.

An act making certain appropriations to be paid out of the Territorial Treasury for the year 1831.

An act to provide for laying out and establishing certain roads.

An act relative to proceedings in criminal cases.

An act authorising the Supervisors of the county of Wayne, to grant a certain discharge to Peter Van Every.

The Council resumed as in committee of the whole, the consideration of the Bill to divide the Township of Farmington in the county of Oakland. The bill being reported without amendment, was read a third time.

Mr. Le Roy moved that the bill pass. The motion was determined in the negative. So the bill was rejected.

Two messages were received from the Governor of the Territory on Executive business, by Mr. Rowland.

The bill to provide for the payment of the contingent expenses of the Legislative Council, was read a third time. On motion the bill was amended, by striking out the word

'fifteen', section 3, appropriation to S. Wells, and inserting 'forty-four.'

By restoring the item of appropriation for the purchase of books, section 4, by adding to section 4 the following, To George Bowman for painting book cases, ten dollars and seventy-five cents.

By striking out the words 'fifty-two,' appropriation for postage, section 6, and inserting 'sixty-two.'

By striking out the words, 'one hundred,' appropriation for furniture, section 6, and inserting, 'one hundred and fifty.' By striking out the word, 'twenty,' appropriation to assistant messenger, section 6, and inserting, 'thirty.'

By striking out the words, 'forty-five,' appropriation to C. K. Green, section 6, and inserting, 'fifty.'

By adding to section 6, the following:

To Colman Funston for putting a lock on committee room, one dollar.

To Benjamin Woodworth for the use of committee rooms, fifty dollars, in part payment.

To Andrew Mack for the use of committee rooms, twenty-five dollars,

For services under the resolution of the Council of the third instant, $15.

To William Meldrum for reimbursing certain payments, $10.

To Lucius Lyon for adjusting county lines on certain maps $10.

On motion of Mr, Stockton, the blank in the 22d line, section 3, was filled with the name of Thomas Simpson, and the blank in the 26th line, same section, with the name of George L. Whitney.

On motion of Mr. M'Donell, the words '45,' appropriation for publishing the laws in the different newspapers, was stricken out, and the word '50' inserted, and after the word Territory, at the close of that paragraph, the following inserted, "which compensation shall also include the publication of the current accounts of the Auditor and Treasurer of the Territory, together with the circulars issued by the Auditor, and for proclamations issued by the Executive of the Territory by virtue of law, which said printers shall publish in their respective papers."

On motion of Mr. Lawrence the word '50', appropriated to Woodworth for use of committee rooms, was stricken out, and the words '75' inserted.

Mr. M'Donell moved to insert at the close of the third section the following:

That a sum not exceeding 120 dollars shall be paid to the person designated by the President of the Council, for superintending the printing of the laws passed at the present session, and making marginal notes and index to the laws. The motion was negatived.

Mr. Stockton moved that the bill pass.

The question being taken, it was decided that the bill pass, and that the title thereof, be

An act to provide for the payment of the contingent expences of the Legislative Council.

The Council went into the consideration of Executive business, and having disposed of the same,

On motion of Mr. Schoolcraft,

The vote on the passage of the bill to incorporate the first Presbyterian Church of Mackinac was reconsidered. The bill being then before the Council,

On motion of Mr. Schoolcraft, was recommitted.

Mr. Schoolcraft from the Judiciary committee, then reported the bill with amendments. The amendments being concurred in,

Mr. Schoolcraft moved that the bill pass.

It was decided that the bill pass, and the title be

An act to incorporate the first Presbyterian Church of Mackinac.

Mr. Fletcher from the committee on enrolment, reported as correctly enrolled, bills with the following titles:

An act to provide for the payment of the contingent expences of the Legislative Council,

An act to amend an act, entitled an act to provide for the establishment of seats of Justice.

An act to incorporate the first Presbyterian Church in Mackinac.

On motion of Mr. Lawrence, the vote, rejecting the resolution offered by Mr. M'Donell, requiring the Secretary of the Territory to furnish a list of officers, civil and military, &c. was reconsidered.

On motion of Mr. Lawrence, the resolution was adopted.

Mr. M'Donell submitted the following resolution.

Resolved, By the Legislative Council of the Territory of Michigan, That the Commissioners required to be appointed by the Act, amending the act to establish county seats
