On motion of Mr. M'Donell,

3 o'clock P. M.

Ordered, That the bill to raise money and determine the compensation to be paid to the Chief Justice and Associate Justices of the Courts of Common Pleas in the Territory of Michigan, reported with the unfinished business, be referred to the committee on Territorial Affairs.

The bill to establish a board of Commissioners with authority to raise a sum of money by lottery, and to open and construct a free road between the city of Detroit and the River Aux Raisin, in the county of Monroe &c. was taken up.

On motion the name of Jonathan Kearsely' was inserted after the name of H. N. Howard.

On motion of Mr. Drake, so much of the first section, stricken out on the 23d instant, as succeeds the words" occasion," was reinstated, so as to read "and said board &c." and the word "three," in the part reinstated stricken out, and the word "five," substituted.

On motion of Mr. M'Donell,

The words "locate, open, and construct," were stricken out and the words "open, or if necessary, to locate," submitted.

On motion of Mr. Fletcher, the bill was amended, by appending to the 5th section, the following:

And that in the event that any class of the said lottery shall not be drawn within months after the tickets for such class shall have been offerred for sale, he will not hereafter proceed to draw such class, but will refund the money received on the sale of tickets in such class to the purchaser thereof, at any time thereafter on demand.

Mr. Stockton moved to fill the blank in the amendment with the word 'six.'

Mr. Stockton moved to lay the bill on the table. The motion prevailed.

The Council proceeded to consider as in committee of the whole,

The bill to provide for laying off into separate counties the district of country adjacent to Grand River, and for other purposes.

Mr. Drake moved to amend by adding to the 16th section the following.

Sec. 16. That all that part of the county of Washtenaw lying north of the line between townships 2 and 3 S. and

all that part of the county of Shiawasse lying south of the line between townships 2 and 3 N. shall be set off into a separate county, and the name thereof shall be

Mr. Drake moved to lay the bill on the table. The motion was negatived.

The question recurring on the motion to amend, it was determined in the negative.

On motion of Mr. Schoolcraft,

The bill was ordered to be engrossed and read a third time on Tuesday.

Mr. Kingsley from the select committee to whom the subject was referred, reported

A bill for establishing a certain Territorial road.

The bill was read a first time and laid on the table. The President presented a communication from J. H. M'Bride, on the subject of raising mulberry trees. Referred to the committee on Internal Improvement.

Mr. Stockton submitted the following resolution: Resolved, That when the Council adjourn, it adjourn until Tuesday week, then to meet at the Capitol in Detroit. Mr. Stockton moved the adoption of the resolution. The motion was negatived.

The Council adjourned.

SATURDAY, February 26, 1831.

The President presented a petition for the organization of the county of Berrien.

Mr. Brown presented a petition from certain citizens for authority to the city, to oppoint constables.

Referred to the committee on the Judiciary.

Mr. Schoolcraft presented an account of G. L. Whitney, for printing.

Referred to the committee on Expenditures.

Mr. Durocher presented an accounnt of G. Hurd for painting.

Referred to the committee on Expenditures.

Mr. Schoolcraft from the committee on Enrolment, reported as correctly enrolled, bills with the following titles. An act to amend the several acts now in force for the relief and settlement of the poor."

An act for the relief of Martha Garlick.

Mr. Lawrence from the Judiciary Committee, reported A bill to authorise the sale of the estate of Elisha W. Rumsey, deceased.

The bill was read the first time and laid on the table.

Mr. Le Roy from the Judiciary committe reported, A bill in addition to and for the amendment of the act concerning Judgments and Executions.

The bill was read the first time and laid on the table.

A bill to amend an act entitled an act to amend an act entitled an act to regulate taverns, reported the same with amendments.

The amendments being concurred in,

Mr. M'Donell moved to amend, by striking out in the first section, the word "two" and inserting the word "one" The motion was negatived.

Mr. Schoolcraft moved that the bill pass.

The question being taken it was decided that the bill pass,

and that the title thereof be

An act to amend an act, entitled an act to amend an act, entitled an act to regulate taverns.

The bill to amend an act entitled an act for defraying the public and necessary charges in the respective counties of this Territory and for other purposes, was read a second time and laid on the table.

The bill to establish a ferry over the St. Joseph River, was read a second time and considered as in committee of the whole.

On motion of Mr. Drake, the bill was amended by inserting after the word "Finch," the words, "or such other person or persons as they may think proper."

The bill being reported as amended, the amendments were concurred in.

On motion of Mr. Lawrence,

Ordered, That the bill be engrossed and read a third time on Monday.

The bill to organize the county of Berrien, was read a second time and laid on the table.

The bill to establish a board of commissioners, with authority to raise a sum of money by lottery &c. was taken

up.

On motion of Mr. M'Donell,

The bill was amended by adding the following at the close of the second section.

Provided also, That all powers and privileges, herein granted or authorised to be granted, except the improvements directed by this act to be made, shall cease and determine within six years from the first day of September aforesaid.

And by striking out séction 6, the words, "locate, open,

and construct" and substituting the words "open or if necessary locate."

Mr. M'Donell moved further to amend by adding, to stand as the 12th, 13th, and 14th, section of the bill the following. Sec. 12. That it shall be the duty of the said board of commissioners whenever required by a resolution of the Legislative Council to render a just and true account of all the proceedings in carrying into effect the objects of this act, and that the said board shall at all times be subject to the future directions of the Legislature for the time being: Provided, that such directors shall not interfere with any rights that may have accrued under this act.

Sec. 13. That if there shall be a balance remaining in the Treasury, of any sum of money in this act appropriated after the object of public improvements for which such sum is appropriated shall have been finished and completed, any balance so remaining, shall be subject to the further directions of the Legislature for the time being.

Sec. 14. That this act shall take effect from and after its passage.

Mr. Lawrence moved to amend the amendment by striking out the proviso in the 12th section.

The motion was negatived.

The question recurring on the amendment, it was concurred in.

Mr. Lawrence moved to strike out so much of the bill as relates to improving the navigation of Flint River.

The motion was negatived.

Mr. Fletcher moved to amend by inserting after the word "place," section 4, line 2, the words" within the Territory."

The motion was rejected.

Ayes-4.

Nays-8.

Those who voted in the affirmative, are

Messrs. Fletcher, Kingsley, Lawrence, Schoolcraft-4. In the negative,

Messrs. Bartow, Brown, Drake, Durocher, Le Roy, M'Donell, Stockton, Edwards-8.

On motion of Mr. Fletcher, the bill was amended, by inserting, after the word "lottery" section 5, line 5, the words "who shall be citizens of said Territory.

Nays-5.
