On motion of Mr. Stockton,

Resolved, That the committee on the Judiciary be instructed to inquire and report, whether any member of the Legislative Council has been appointed to any office, contrary to the provisions of the act of Congress, approved Jan. 29, 1827.

On motion of Mr. M'Donell,

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of so amending the act to authorise the Legislative Council to punish for contempt, and to privilege the members thereof from arrest, as to designate the number of days, previous to, and after, the adjournment of the session during which a member of the Legislative Council shall be privileged from arrest or be compelled to answer any civil process-and to report by bill or otherwise.

On motion of Mr. Drake, the Council went into the consideration of Executive business, and having disposed of the same, On motion of Mr. Noble, adjourned.

THURSDAY, Oct. 22, 1829.

Prayer by the Rev. Mr. Brown.

Mr. Ramsey, from the committee on Territorial Affairs, to whom had been committed "A bill to organise the counties of St. Joseph and Kalamazoo, and for other purposes,” reper.ed the same with amendments, and with the following titie, viz: A bill to provide for laying out certain counties, and for other purposes;" and said bill and amendments were then laid on the table.

Two messages on Executive business were received by the hands of Mr. E. A. Brush.

On motion of Mr. Irwin, the Council went into the consideration of Executive business; and having disposed of the same,

Air. Schoolcraft presented the claim of John Farmer, for making and compiling a map of the Territory of Michigan, for the use of the Legislative Council, Referred, on motion of Mr. Schoolcraft, to the commitice on Torritored Affairs.

Mr. Drake, from the committee of Enrolment, reported as correctly enrolled, a bill entitled an act to amend the sever acts to organise the Militia ;" and the President signed the same.

Mr. Drake, from the select committee to whom the subject had been referred by a resolution of the Council, reported,

A bill authorising the guardian of luri Fish to remove the said Imri from the jail of the county of Oakland, to any safe place out of

the Territory; which was read the first time and laid on the table, The President announced that the select committee, appointed agreeably to the motion made yesterday by Mr. Durocher, and agreed to by the Council, were,

Messrs. Durocher, Noble, Connor, Trowbridge and Rumsey. On motion, the bill to provide for laying out certain counties, and for other purposes, was taken up.

Mr. Rumsey then moved that the Council concur in the amendments made to said bill by the committee on Territorial Affairs, and the motion was agreed to; and,

On motion, said bill was then ordered to be engrossed and read a third time to-morrow.

On motion of Mr. Stockton,

Messrs. Schoolcraft and Irwin had leave of absence for the remainder of the session.

The bill to provide for the compensation of the officers of the Legislative Council, and for other purposes, was taken up and read the third time.

Mr. Lawrence then moved that the bill be amended by striking out the word "ninety," in the 13th line of the 1st section, and inserting in lien thereof the words, "one hundred and five ;" and the motion was decided in the negative.

On motion, the question "shall the bill now pass ?" was then put, and Mr. Noble requiring the ayes and nays thereon, they were taken as follows:

Ayes....Messrs. Drake, Durocher, Edwards, Irwin, Lawrence, M Donell, Rumsey, Schoolcraft, Stockton, Trowbridge....10. Nays....Messrs. Brown, Noble.

So the bill passed.

The "bill amendatory to an act, entitled an act to regulate the assessment and collection of Territorial taxes," was taken up and read the third time.

Mr. Stockton then moved that the bill be amended by inserting, after the words "number of," in the 9th line of the 12th section, the words, "the different descriptions of,"-and the motion was agreed to.

On motion, the question "shall the bill now pass?" was then put, and Mr. Drake requiring the ayes and nays thereon, they were taken as follows:

Ayes....Messrs. Brown, Durocher, Edwards, Lawrence, M'Donell, Noble, Rumsey, Schoolcraft, Stockton, Trowbridge....10. Nays....Mr. Drake.

So the bill passed.

The bill to increase the taxes of Oakland county, was taken up and read the third time; whereupon,

Mr. Lawrence moved that said bill be committed to the committee on Tercitorial Affairs; and the motion was agreed to.

The bill to raise a sum of money by Lottery, for the purpose of

establishing a free communication by land between the city of Detroit and the village of Monroe, was taken up and read the third time.

Mr. Noble then moved that the bill be amended by striking out the words, "impeded by a tax, paid to the several toll-bridge companies," in the 3d and 4th lines of the preamble, and that the words, obstructed by several toll-bridges," be inserted in lieu thereof; and the motion was agreed to.

On motion of Mr. M'Donell, the question "shall the bill now pass was then put, and Mr. Lawrence requiring the ayes and nays thereon, they were taken as follows:

Ayes-Messrs. Brown, Durocher, Edwards, Irwin, M'Donell, Noble, Schoolcraft, Stockton-8.

Nays-Messrs. Drake, Lawrence, Rumsey, Trowbridge-4.
So the bill passed.

On motion of Mr. M'Donell, the Council went into the consideration of Executive business; and having disposed thereof,

Mr. Drake moved that the Council take a recess until 5 o'clock, P. M. ; and the motion was agreed to.

3 o'clock, P. M.

The bill amendatory to "an act securing to mechanics and others payment for their laber and materials in erecting any house, mill, or other building, within the city of Detroit or county of Brown," was taken up, read the third time and passed.

Mr. M'Donell prescuted the claim of Sheldon M'Knight, for certain printing for the Legislative Council; and,

Mr. Brown presented the claim of Wm. Durell, for chairs for the Legislative Council; and, on motion,

Said claims were referred to the committee on Expenditures.

Mr. M'Donell moved that the vote taken on the motion made this day, to order the “bill to provide for laying out certain counties, and for other purposes," to be engrossed and read a third time to-morrow, be reconsidered; and the motion was agreed to.

And said bill then being before the Council, it was on motion read the third time; whereupon,

Mr. Drake moved that the bill be amended by adding thereto the following, to stand as the last section thereof, viz ;—“That all acts and parts of acts, contravening the provisions of this act be, and the same are hereby repealed ;" and the motion was agreed to.

Mr. Rumsey then moved that the bill do now pass; and the motion was decided in the affirmative.

The bill in addition to an act, entitled "an act to provide for the appointment, and to regulate the duties of District Attorneys," and the act to amend the said act,' was taken up and read the second time; and having been considered as in committee of the whole, said bill was, on motion of Mr. Noble, ordered to be engrossed and read a third time to-morrow.

The bill to amend an act, entitled "an act concerning judg

ments and executions," (approved April 12th, 1827,) and the "act concerning mortgages," was taken up and considered as in committee of the whole.

Mr. M'Donell then moved that the consideration of said bill be postponed until the next session of the Legislative Council; and the motion was decided in the negative.

On motion, the bill was then laid on the table until Monday next, A message on Executive business was received by the hands of Mr. E. A. Brush.

On motion of Mr. Stockton, the Council went into the consideration of Executive business; and having disposed thereof,

The bili to amend an act, entitled "an act to prevent Justices of the Peace from keeping tavern, and for other purposes," was taken up, the question being on the passage of said bill; whereupon,

Mr. Drake moved that said bill be recommitted to the committee on the Judiciary; and the motion was decided in the negative.

Mr. M'Donell then submitted as a substitute for said bill, a "bill to repeal an act, entitled 'an act to prevent Justices of the Peace from keeping taverns, and for other purposes ;" and the question being on receiving said substitute, it was decided in the negative.

On motion, said bill was then passed, by the following vote, the ayes and nays being required by Mr. Drake:

Ayes-Messrs. Brown, Connor, Durocher, Edwards, Lawrence, M'Donell, Noble, Rumsey, Stockton, Trowbridge-10. Nays-Messrs. Schoolcraft, Drake—2.

On motion of Mr. M'Denell, the Council then adjourned.

FRIDAY, Oct. 23, 1829.

Prayer by the Rev. Mr. Brown.

Mr. Drake presented the petition of James Connor and others, and of C. Crittenden and others, inhabitants of the county of Macomb, praying that a law may be passed to abolish the County Court of said county. Read and referred to the committee on the Judiciary.

Mr. Stockton presented the deposition of D. H. Brown, relative to the time in which "James Connor, William Little and Judge Leib," were employed in laying out a Territorial Road from Detroit to a point on the Clinton River between Enoch Huntley's and Nathaniel Squires'. Read and laid on the table.

Mr. Noble, from the committee on the Judiciary, reported, "A bill to organise the counties of Cass and St. Joseph;" which was read the first time; and on motion of Mr. Noble, said bill was read the second time by its title and laid on the table.

Mr. Noble, from the committee of Enrolment, reported as correctly enrolled, bills with the following titles, viz: An act to incorporate the President, Directors and Company of the Summit Portage Canal and Road Company," and "an act to dissolve the marriage contract existing between William C. Iiutchinson and

Susanna Hutchinson ;" and the President signed the same. Mr. M'Donell, from the committee on Territorial Affairs, reported,

A bill to amend an act, entitled "an act to authorise the Legislative Council to punish for contempt, and to privilege the members of the Council from arrest ;" which was read the first time; and, on motion of Mr. M'Donell, said bill was then read the second time by its title and laid on the table.

Mr. Drake, from the select committee appointed to prepare a bill for laying out a Territorial Road from Enoch Huntley's to the Kalamazoo River, reported,

A bill to provide for laying out and establishing a certain Territorial Road; which was read the first time and laid on the table. The bill to amend an act, entitled “an act relating to interests on contracts;" was taken up and considered as in committee of the whole.

Mr. M'Donell then moved that the further consideration of the bill be postponed until Monday next; and the motion was decided in the negative.

On motion of Mr. Noble, said bill was then ordered to be engrossed and read the third time on Thursday next, by the following vote, the ayes and nays having been required by Mr. M'Donell:

Ayes-Messrs. Drake, Durocher, Edwards, Lawrence, Noble, Rumsey, Trowbridge-7.

Nays-Messrs. Brown, M'Donell, Schoolcraft-3.

The bill to provide for the termination of the present session of the Legislative Council, and for the annual commencement of future sessions of the Council, was taken up as in committee of the whole; and,

On motion of Mr. Stockton, the consideration thereof was postponed until Monday next.

Mr. Stockton moved that the Council suspend the operation of the 27th Rule, and reconsider the question taken on the 21st inst. on the adoption of the "Memorial to the Congress of the United State, requesting that a certain portion of country, including the Sault de St. Marie and the island of Michilimackinac, may be added to the contemplated Territory of Wisconsin," &c.; and the motion was agreed to.

And said memorial being again before the Council,

Mr. M'Donell moved that it be recommitted to the committee on the Judiciary; and the motion was agreed to.

The resolution to fix the orthography of a certain name, was taken up and read the third time.

Mr. Drake moved that said resolution be adopted by the Council; and the motion was decided in the negative by the following vote, the ayes and nays being required by Mr. Drake:

Ayes-Messrs. Drake, Edwards, Rumsey, Trowbridge-4.
