(a) Upon the resignation of Chief Justice Swan, in November, 1859, Judge Brinkerhoff being the Judge "having the shortest time to serve, and not holding his office by appointment or election to fill a vacancy," became Chief Justice by operation of the statute. (b) On the 8th of November, 1859, Judge Gholson took his seat upon the bench by appointment by the Governor, to fill the unexpired term of Chief Justice Swan, resigned. February 9, 1860, Judge Gholson having served out the unexpired term of Chief Justice Swan, entered upon a full term of five years, for which he had been elected at the previous October election.
