The Assembly bill (No. 1189, Senate Reprint No. 1403, Rec. No. 223) entitled "An act to amend chapter three hundred of the Laws of nineteen hundred and fourteen, entitled 'An act in relation to the department of public works of the city of Syracuse, and repealing certain sections of chapter six hundred and eightyfour of the Laws of nineteen hundred and five, relating thereto,' in relation to condemnation of lands for local improvements," having been announced for third reading, Mr. Walters moved that said bill be recommitted to the committee on affairs of cities. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Slater offered the following:

Resolved (if the Assembly concur), That a respectful message be sent to the Governor, requesting the return to the Senate of the Senate bill (No. 1157, Int. No. 540) entitled "An act to amend chapter seventeen of the Laws of nineteen hundred and five, entitled 'An act empowering the board of supervisors of Westchester county to authorize the towns of such county to borrow money by the issue of bonds for the purpose of paying for highway improvements,' in relation to the payment of said bonds by the whole or a part of the town," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request their concurrence therein.

The Assembly returned the above resolution, with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution to the Governor. Mr. Walters offered the following:

Resolved (if the Assembly concur), That a respectful message be sent to the Governor requesting the return to the Senate of the Senate bill (No. 753, Int. No. 656) entitled "An act to legalize and confirm the official acts of notaries public and commissioners of deeds," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request their concurrence therein.

The Assembly returned the above resolution, with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution to the Governor. Mr. Gibbs offered the following:

Resolved (if the Assembly concur), That a respectful message be sent to the Governor requesting the return to the Senate of the Senate bill (No. 160, Int. No. 159) entitled "An act to amend the Code of Civil Procedure, in relation to publication of notice of sale of real property," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request their concurrence therein.

The Assembly returned the above resolution, with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution to the Governor. Mr. Downing offered the following:

Resolved (if the Assembly concur), That Senate bill (No. 186, Int. No. 185) entitled "An act to amend the Domestic Relations Law, in relation to the solemnization of marriages and fees therefor," be returned to the Governor.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request their concurrence therein.

The Assembly returned the above resolution, with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution and bill to the Governor.

Mr. Ottinger moved that the committee on the judiciary be discharged from the consideration of Assembly bill (No. 399, Rec. No. 310) entitled "An act to repeal article twenty-two of the General Business Law and section fourteen of the Stock Corporation Law relating to monopolies and contracts in restraint of trade,” and that the said bill be amended and reprinted, the title. being amended to read as follows:

"An act to repeal article twenty-two of the General Business Law, relating to monopolies and contracts in restraint of trade.”

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

On motion of Mr. Ottinger, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Mr. Wicks moved that the committee on internal affairs of towns, counties and public highways be discharged from the consideration of Senate bill (No. 1385, Int. No. 1091) entitled "An act to provide a purchasing agent for the county of Oneida," and that the said bill be amended, reprinted and recommitted to the committee on internal affairs of towns, counties and public highways.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Yelverton moved that the committee on internal affairs of towns, counties and public highways be discharged from the consideration of Senate bill (No. 1055, Int. No. 878) entitled "An act to amend the County Law, in relation to the salaries of the county judge and surrogate of Montgomery county," and that the said bill be amended, reprinted and recommitted to the committee on internal affairs of towns, counties and public highways. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Marshall moved that the committee on finance be discharged from the consideration of Senate bill (No. 1570, Int. No. 1199) entitled "An act making an appropriation for the payment of the State's portion of the expense of acquiring a site and constructing a public market in the city of Ogdensburg, pursuant to the Farms and Markets Law," and that the said bill be amended, reprinted and recommitted to the committee on finance.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The Assembly returned the Senate bill (No. 153, Int. No. 152) entitled “An act authorizing the police commissioner of the city of New York to restore John A. Kaht to the rank of sergeant," with a message that they have concurred in the passage of the same.

Ordered, That the Clerk transmit said bill to the mayor of the city of New York for a hearing, pursuant to the provisions of the Constitution.

Pursuant to a concurrent resolution heretofore adopted, the mayor of the city of New York returned the Senate bill (No. 369, [SENATE JOURNAL]

Also, Senate bill (No. 566, Int. No. 517) entitled "An act to amend the Highway Law, in relation to the rebuilding of bridges which were former toll bridges."

Also, Senate bill (No. 804, Int. No. 486) entitled "An act conferring jurisdiction upon the county court of Chautauqua county to adjudicate upon cases of children in Chautauqua county . under sixteen years of age who are delinquent, neglected, or otherwise subject to the discipline or in need of the care and protection

of the State, and upon cases of adults who may be responsible for or contribute to the condition of such children; and regulating the procedure in such cases, including provisions for the detention of children, a probation system and the appointment of guardians.

Also, Senate bill (No. 1067, Int. No. 890) entitled "An act to legalize, ratify and confirm the proceedings of the village of East Aurora, relating to the sale of bonds for the widening and improving of Center street in said village, and to provide for the payment thereof," with a message that they have concurred in the passage of the same.

Ordered, That the Clerk deliver said bills to the Governor.

The President presented a report of the State Commissioner of Highways relative to the proposed acquisition by the State of the Congress Street bridge at Troy and the Greenbush bridge at Albany, now operated as toll bridges across the Hudson river.

Ordered, That said report be referred to the committee on finance.

Mr. E. R. Brown moved that the Senate do now adjourn. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative. Whereupon, the Senate adjourned.

The journal of yesterday was read and approved.

Mr. Lawson introduced a bill (Int. No. 1220) entitled "An act to amend the Religious Corporations Law, in relation to property of extinct churches," which was read the first time, and by unanimous consent was also read the second time and referred to the committee on the judiciary.

Mr. Murphy introduced a bill (Int. No. 1221) entitled "An act to amend section four of chapter two hundred and sixteen of the Laws of eighteen hundred and forty-six, entitled 'An act to
