Mr. Williams moved that the committee of the whole be discharged from the further consideration of the Assembly bill entitled "An act to amend and consolidate the existing laws in relation to the State prisons," and that the same be ordered to a third reading.

Debate being had thereon,

Mr. Foote moved that when the Senate adjourns it be to 4 o'clock. Mr. Sloan moved to amend so that the Senate do now adjourn until 4 o'clock.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The President then put the question whether the Senate would agree to said motion as amended, and it was decided in the affirmative.

The Senate then took a recess until 4 o'clock P. M.

The President announced the question pending at the time of the recess, to be on the motion of Mr. Williams, that the committee of the whole be discharged from the further consideration of the bill enti

tled "An act to amend and consolidate the existing laws in relation to the State prisons.'

Mr. John D. Willard moved to lay that question on the table.

The President put the question whether the Senate would agree to said motion, and it was decided in the negative.

Mr. Mather moved that the question be laid on the table for the purpose of going into executive session.

Mr. Noxon called for a division of the question.

Mr. Loveland, from the committee on State prisons, reported the bill back with amendments, as instructed by the Senate.

The President put the question whether the Senate would agree to the report of the committee, and it was decided in the affirmative. Mr. Noxon moved that said bill now have its third reading. Mr. Ely moved to amend by making it a week from Thursday, at 12 o'clock.

Pending which,

A message from the Assembly was received, informing that they had concurred in the report of the committee of conference on the Assembly bill entitled "An act making appropriations for certain expenses of government for the year 1859."

Mr. W. A. Wheeler moved that the Senate concur in said report. The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have agreed to the report of the conference committee.

A message from the Assembly was received, requesting the concurrence of the Senate to the following resolution :

Resolved, (if the Senate concur,) That this Legislature do adjourn sine die, at 9 o'clock P. M., of this day.

On motion of Mr. Sloan, and by unanimous consent; the rule was suspended, and said resolution considered and adopted.

Ordered, That the Clerk return said resolution to the Assembly, with a message informing that the Senate have passed the same, without amendment.

A message from the Assembly was received and read, informing that they had concurred in the passage of the bill entitled "An act to incorporate the Port Morris Land and Improvement company," with the following amendment:

In the first section, strike out the word "aforesaid."

Mr. Ely moved that the Senate concur in the amendment.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, as follows:
