The Assembly bill entitled "An act for the appraisal and payment of canal damages to Jonathan Nelson and William W. Barker," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

"An act to increase the pay of jurors in Herkimer county."

"An act to amend an act entitled 'An act in relation to sewerage and drainage in the city of Brooklyn,' passed April 15, 1857." "An act to empower the Chautauque Farmers' and Mechanics' [SENATE JOURNAL.] 114

Union, at Fredonia, to purchase and hold real estate, not to exceed five thousand dollars in value."

"An act in relation to the Colonial History of the State."

"An act to amend the poor laws of the county of Herkimer." "An act to provide for the supply of the city of Brooklyn with water."

A message from the Assembly was received and read, informing that they had concurred in the passage of the following entitled bill, as further amended by the Senate, viz:

"An act to reduce the fees of the county clerk of Erie county, and for other purposes.'

A message from the Assembly was received and read, informing that they had concurred in the passage of the following entitled bills, without amendment:

"An act in relation to the auditing of accounts by the board of supervisors of the county of Montgomery, and the duties of certain officers of said county in connection therewith."

"An act to amend the act entitled 'An act concerning the Watervliet Turnpike company,' passed April 25, 1829."

"An act in relation to the New York Protestant Episcopal Public School."

"An act for the relief of James Mullet, deceased."

"An act to repeal the charter of the People's Loan and Relief company."

Ordered, That the Clerk deliver said bills to the Governor.

A message from the Assembly was received and read, informing that they had concurred in the amendments of the Senate to the bills entitled as follows:

"An act to incorporate the Peekskill Savings Bank."

"An act to amend certain sections of the Code of Procedure.' Ordered, That the Clerk return said bills to the Assembly.

A message from the Assembly was received, returning the following entitled bills:

"An act to authorize the laying of a railroad track in and through certain streets in the city of Syracuse."

"An act requiring county treasurers to file in the county clerk's office a report of the moneys and securities in their hands belonging to infants.' ""

"An act to make corporations in the city of Buffalo taxable, the same as corporations in the other cities and counties of the State." Ordered, That the Clerk deliver said bills to the Governor.

A message from the Assembly was received and read, informing that they had non-concurred in the report of the committee of conference, on the bill entitled as follows:

"An act to amend an act entitled 'An act to amend an act to revise the charter of the city of Syracuse,' passed April 17, 1858." Mr. Mather moved to lay the order of third reading of bills on the table.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

A message from the Assembly was received, in the words following, to wit:

"His Excellency the Governor returned the bill entitled 'An act to provide for the payment of interest on the drafts and certificates of the Canal Commissioners in certain cases,' with the message herewith transmitted.

The message having been read, and the bill being before the House for reconsideration,

Mr. Speaker put the question "Shall this bill become a law notwithstanding the objections of the Governor?" and it was decided in the affirmative, two-thirds of all the members present voting in favor thereof.

Ordered, That the Clerk transmit to the Senate said bill and message, together with the proceedings of the Assembly thereon."

The message having been read, and debate being had thereon, Mr. Sloan moved that the Senate adjourn.

By unanimous consent, Mr. Ames offered the following resolution: Resolved, (if the Assembly concur,) That the Legislature adjourn on Tuesday, April 19th, 1859, at 10 o'clock a. M.

Mr. Truman moved to amend, by striking out "Tuesday, April 19," and inserting " Thursday, April 21."

On motion of Mr. Loveland, and by unanimous consent, Resolved, That the Clerk of the Senate be requested to complete the index of the Senate Journal, immediately after the adjournment of the Legislature, and that the Secretary of State cause the Journals, and Laws, to be bound and distributed to those entitled by law to receive them, and that said distribution be made on or before the first day of June next.

The President then announced that when the Senate adjourned on Saturday evening, the pending question was "Shall the bill entitled 'An act to provide for the payment of interest on the drafts and certificates of the Canal Commissioners in certain cases,' become a law notwithstanding the objections of the Governor ?”
