Upon motion of Mr. Perea the bill was considered as engrossed and read a third time by title.

Mr. Jaramillo now moved that Council Bill No. 77 pass, and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President--12.

Nays, none.

Therefore Council Bill No. 77 was passed unanimously.

Upon motion of Mr. Catron the rules were suspended and the committee on the judiciary made a report on Council Bill No. 79 entitle dAn Act to fix the time for holding the supreme and district courts in the Territory of New Mexico recommending its passage. The bill was read in full for information and a slight amendment offered by Mr. Richardson, adopted.

Upon motion of Mr. Catron the bill was considered as engrossed and read a third time by title.

Mr. Catron moved that the bill pass and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-12.

Nays, none.

Therefore Council Bill No. 79 passed unanimously.

Business on the President's table was now in order and House Bill No. 46 entitled An Act creating a commission to codify and revise the laws of the Territory of New Mexico taken up and read a third time and referred to the committee on the ju diciary.

Unfinished business was now in order, and Council Bill No. 55 entitled An Act to provide for the issuance of county current expense bonds in the Territory of New Mexico taken up, but upon motion of Mr. Catron the bill was recommitted to the committee on the judiciary, with instructions to report to-mor

row.

Mr. Mills now moved to adjourn.

Mr. Perea moved to amend by adjourning until 10 a. m.

January 23, 1891, which motion was carried, and the Council adjourned until 10 a. m. January 23, 1891.

Council met pursuant to adjournment.

Session opened by prayer by Rev. John Menaul.

Roll call dispensed with, all members being present.

The Journal of yesterday's proceedings was read and apapproved.

A messenger from the Governor of New Mexico, appeared and delivered a message, which was received.

The chair then announced the order of business.
Petitions and memorials, none being presented.

Reports of standing committees were in order, and the committee on the judiciary through Mr. Mills made a report on Council Bill No. 15 and the substitute presented by the House; the bill and report ordered to lie on the table and await its regular order.

The committee on territorial affairs through its chairman, Mr. Ancheta, made a report on Council Bill No 51, which bill and report were ordered to lie on the table and await their regular order.

The committee on roads and highways, through its chairman, Mr. Stover, made a report on House Bill No. 11, which bill and report were ordered to lie on the table and await their reg

ular order.

The committee on municipal and private corporations, through its chairman, Mr. Catron, made a report on Council Bill No. 48, which report and bill were ordered to lie on the table and await their regular order.

The committee on the judiciary, through its chairman, Mr. Catron, made a report on Council Bill No. 55, which bill and report were ordered to lie on the table and await their regular order.

Mr. Perea moved that the Council go into executive session, but upon suggestion, withdrew his motion.

Reports of special committees were in order, none being presented.

Resolutions were in order, none being presented.
Introduction of bills was in order.

Mr. Perea introduced the following:

Council Bill No. 81-entitled An Act providing funds and making appropriations for the 42d and 43d fiscal years and for other purposes; the bill was read a first time by title and under suspension of the rules read a second time by title, ordered printed in English and referred to the committee on finance. Mr. Richardson introduced the following:

Council Bill No. 82—entitled An Act to amend An Act of the 27th Legislative Assembly, Section 2, Chapter 7, entitled An Act relative to practice in the supreme court, the bill was read a first time by title, and under suspension of the rules, was read a second time and referred to the committee on the judiciary.

Mr. Mills introduced the following:

Council Bill No. 83-entitled An Act relating to deeds and conveyancing; the bill was read a first time by title, and under suspension of the rules, it was read a second time, and referred to the committee on the judiciary.

Mr. Stover by request introduced

Council Bill No. 84- entitled An Act in relation to suits against counties and subdivisions thereof; the bill was read a first time by title and under suspension of the rules it was read a second time, ordered translated and printed and referred to the committee on the judiciary; also

Council Bill No 85-entitled An Act amending Sec. 6, of Chapter 56, of the Session Laws of 1889, relating to the duties of district attorneys, the bill was read a first time by title, and under suspension of the rules it was read a second time, and referred to the committee on the judiciary.

Joint resolutions were now in order, none being presented. Bills on second reading were in order and Council Bill No. 15 and the substitute for same presented by the House, and the re

port of the committee on the judiciary recommending the passage of the substitute taken up, and the substitute read in full and laid on the table until this afternoon.

Upon motion of Mr. Ancheta the Council chief clerk was instructed to have the Governor's message translated and printed in the Spanish language.

Upon motion of Mr. Perea the Council then went into executive session.

Mr. Mills moved to adjourn, which motion being carried, the Council was adjourned until 2 p. m.

AFTERNOON SESSION.

HALL OF LEGISLAVIVE COUNCIL,

SANTA FE, N. M., January 23, 1891,
Friday, 2 o'clock p. m.

The substitute of the House for Council Bill No. 15 taken up, and upon motion of Mr. Mills the Council resolved itself into a committee of the whole to consider the same, the President in the chair.

The committee of the whole rises temporarily, and a message from the Governor of New Mexico received.

Committee of the whole resumed.

Upon the committee of the whole arising the President, as chairman of said committee, reported that the committee had had under consideration the House substitute for Council Bill No. 15, that several amendments suggested by the committee had been adopted, and that he was instructed to recommend that the bill pass as so amended.

Upon motion of Mr. Vigil the report was adopted, and after several amendments suggested by the Council being adopted, the bill was upon motion of Mr. Stover, ordered to be engrossed.

By unanimous consent Mr. Stover introduced Council Bill No. 86-entitled An Act to amend Section 1771, of the Com-` piled Laws of 1884, relating to the official bonds of the territorial auditor and treasurer, the bill was read a first time by title, then read in full for information, and upon motion of Mr. Stover the rules were suspended and the bill read a second time by title.

Mr. Catron now moved that the bill be referred to the committee on finance with instructions to report to-morrow. Car

ried and so ordered.

Council Bill No. 54-entitled An Act to provide for the issuance of county current expense bonds in the Territory of New Mexico, and the report of the committee on the judiciary recommending several amendments and the passage of the bill as so amended taken up and the bill read in full for information.

After several amendments suggested by the Council being adopted, the bill was upon motion of Mr. Richardson, considered as engrossed and read a third time by title.

Mr. Richardson now moved that the bill pass as amended and, and the ayes and nays were ordered with the following result: Ayes, Messrs. Ancheta, Catron, Contreras, Jarrmillo, Mills, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-11.

Nays, 1.

Therefore Council Bill No. 55 as amended was duly passed. Upon motion of Mr. Richardson the Council then adjourned until 10 a. m. January 24, 1891.
