Gentlemen voting in the negative were:

Messrs. Brandley, Ely, Grimes, Johnson, Judd, Martindale, McFarland, McWirt, Moonlight, Morrill, O'Neil, Rogers Simons, Simpson, St. John, Walker and Winter.

Gentlemen absent or not voting were:

Messrs. Guerin and Topping.

And so the resolution was not adopted.

The following resolution in relation to the Secretary appointing additional clerks,

Was then taken up for consideration.

Resolved, That the Secretary of the Senate be and is hereby authorized to appoint from time to time, such assistant clerks as the necessities of the business of the Senate may demand.

Mr. Moonlight offered the following amendment:

Resolved, That Miss Alice Armsby, of Mound City, be and is hereby appointed Assistant Enrolling Clerk of the Senate. That Miss Emma Hunt, of Emporia, be and hereby is appointed Assistant Engrossing Clerk of the Senate; and that all other clerks necessary for enrolling and engrossing as business may increase shall be appointed by the Enrolling and Engrossing Clerks respectively, with the approval of the President of the Senate: And provided further, That should any Standing or Special Committee require the services of a clerk, such Committee shall have power to employ not more than one person, and report the same to the President of the Senate.

Mr. Butler moved to lay the resolution on the table.
Which motion was lost.

Mr. Winter offered the following amendment to the amendment:

Provided, That the assistant's pay shall not begin until their services are required.

Which amendment was adopted.

The question then being upon the adoption of the amendment offered by Mr. Moonlight, as amended,

A vote was had,

And it was not adopted.

Mr. Brandley then offered the following resolution:

Resolved, That the President of the Senate is hereby authorized to appoint, from time to time, such assistant clerks as the necessities of the Senate may demand.

Which was adopted.

The following gentlemen were present and answered to their names:

The Journal of yesterday read and approved.

The election of a Chaplain for the Senate being the Special Order for 10 A. M.,

Mr. Matheny nominated Rev. P. S. Clelland.

Mr. Murdock nominated Rev. F. S. McCabe.

Mr. V. P. Wilson nominated Rev. Mr. Patten.

Mr. Palmer nominated Father Defouri.

A ballott was then had with the following result:
Mr. Clelland received 1 vote.

Mr. McCabe received 17 votes.

Mr. Patten received 10 votes.

Mr. Defouri received 1 vote.

Mr. Matheny voted for Mr. Clelland.

Gentlemen voting for Mr. McCabe were:

Messrs. Blair, Brandley, Barker, Crichton, Edwards, Judd, Martin, Martindale, McFarland, Moonlight, Murdock, O'Neil, Rogers, Simons, Simpson, Winter and York.

Gentlemen voting for Mr. Patten were:

Messrs. Butler, Ely, Grimes, Johnson, McWirt, Morrill, Schmidt, St. John, Walker, and V. P. Wilson.

Mr. Palmer voted for Mr. Defouri.

Rev. F. S. McCabe having received a constitutional majority was declared duly elected Chaplain of the Senate for this term.

The President of the Senate then appointed as Committee to investigate affairs of State officers:

Messrs. Johnson, J. C. Wilson and Butler.

Mr. Winter offered the following petition of Wendlin Hurd and thirty-five others, praying for an amendment of section 2, chapter 40, of the General Statutes of Kansas, relating to fences.

Mr. York, Chairman of the Committee on Finance and Taxation, made the following minority report:

Senate Bill No. 8, An act to postpone the penalty for non-payment of taxes,

Have had the same under consideration, and I am directed to report the said bill to the Senate with the recommendation that it be passed.
