The ayes and nays were called for with the following result: Ayes, Messrs. Ancheta, Jaramillo, Mills, Santistevan, Stover, Valdez, Vigil and Mr. President-8.

Nays, Messrs. Catron, Contreras, Perea, and Richardson-4. Therefore Council Bill No. 27 was duly passed.

Mr. Mills moved to reconsider the vote by which Council Bill No. 27 was just passed and that the same be laid on the table, which motion being carried, it was so ordered.

House Bill No. 17-entitled An Act in relation to condemnation of private property by municipal corporations, thereon read and adopted, the bill was then read in full for information and upon motion was read a third time by title.

Mr. Richardson moved that House Bill No. 17 pass, and the ayes and nays were called for with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-11.

Nays, none

Mr. Jaramillo not voting.

Therefore House Bill No. 17 was duly passed.

Council Bill No. 56-entitled An Act amending Chapter 52 of the Session Laws of 1887 was taken up and the report of the committee on judiciary thereon read and approved.

Upon motion of Mr. Ancheta the bill was read a third time by title and put upon its passage.

Mr. Ancheta moved that the bill pass, and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President--12.

Nays, none.

Therefore Council Bill No. 56 was passed unanimously.

House Bill No. 31—entitled An Act to repeal An Act of the 28th Legislative Assembly of the Territory of New Mexico entitled An Act providing for the inspection of live animals intended for human food and prohibiting the sale or use of uncured meats, of uninspected bovine cattle and hogs and the sale of improper fresh meats was taken up and the report of the committee on territorial affairs thereon; read and adopted.

Mr. Jaramillo moved that the bill be read a third time by title, and passed which motion being carried, the ayes and nays were called for with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-12.

Nays, none.

Therefore House Bill No. 31 passed unanimously.

Business on the President's table was now in order, and House Bill No. 28, entitled An Act to amend Section 1608 of the Compiled Laws of 1884 entitled municipal corporations; the bill was read a first and second time by title, and referred to the committee on municipal and private corporations.

By unanimous consent Mr. Stover presented a resolution in the nature of a petition from the Commercial Club of Albuquerque, New Mexico, which was referred to the committee on judiciary.

Upon motion of Mr. Perea the Council then adjourned until 2 p. m. January 19, 1891.

MORNING SESSION.

Council met pursuant to adjournment.

Session opened by prayer by Rev. John Menaul.

The roll call was dispensed with, a quorum being present.

The Journal of Saturday's proceedings was read in English and Spanish, and upon motion of Mr. Perea the same was approved.

The chair announced that he had signed House Joint Resolution No. 3.

The chair announced the order of business, petitions and memorials.

Mr. Mills presented a memorial from the Commercial Club

of Las Vegas, N. M., in relation to an appropriation for the New Mexico exhibit at the World's Columbian Exposition.

The memorial was read in full for information and ordered to be considered as having been read a first and second time, also to be translated and printed and referred to the committee on finance.

A messenger from the House appeared and presented House Bills Nos. 9 and 32 which he announced had passed the House. Reports of standing committees were now in order, none being presented.

Reports of special committees were in order, none being presented.

Introduction of bills was in order.

Mr. Mills introduced the following:

Council Bill No. 64-entitled An Act relating to the office of county treasurer and fixing the salaries thereto, the bill was read a first and second time by title, ordered translated and printed and referred to the committee on county and county lines.

Mr. Richardson introduced the following;

Council Bill No. 65-entitled An Act to provide for the incorporation of towns and villages in the Territory of New Mexico; the bill was read a first and second time by title, ordered translated and printed and referred to the committee on municipal corporations; also

Council Bill No. 66-entitled An Act to provide for the establishment, charge, maintenance and control of roads and highways in the Territory of New Mexico; the bill was read a first and second time by title, ordered translated and printed and referred to the committee on roads and highways.

Mr. Richardson arises to a question of privilege and presents a substitute, to supply the place of Council Bill No. 55, entitled An Act to provide for the issuance of county current expense bonds in the Territory of New Mexico; which bill has unaccountably been lost, the substitute ordered to take the same course, as was ordered in the case of Council Bill No. 55.

Joint resolutions were now in order, none being presented. Bills upon second reading were now in order, there being none presented.

Bills on third reading were in order and Council Bill No. 18 was taken up; read by sections and various amendments adopted.

Upon motion of Mr. Mills the bill was considered as engrossed, read a third time by title, and put upon its passage.

Mr. Mills moved that the bill now pass, which motion was carried and the ayes and nays were called for, with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Richardson, Santistevan, Valdez, Vigil, and Mr. President -10.

Nays, Mr. Perea-1.

Mr. Stover was absent.

Therefore Council Bill No. 18 as amended duly passed.

Business on the President's table was now in order and House Bill No. 9, entitled An Act relating to public moneys; the bill was read a first and second time by title and referred to the committee on finance.

House Bill No. 34-entitled An Act in relation to sewers in cities and incorporated towns was next taken up, read a first and second time and referred to the committee on municipal and private corporations.

Unfinished business was now in order.

Council Bill No. 9-entitled An Act providing for the distribution of the general school fund by the auditor and the report of the committee on education thereron taken up and bill and report recommitted to the committee on education.

The substitute presented by the committee on territorial affairs for Council Bills Nos. 19 and 24 and House Bill No. 63 was next taken up and read in full in English and Spanish.

Upon motion of Mr. Jaramillo the substitute was read a second and third time by title.

Mr. Jaramillo moved that the substitute pass, which motion being carried the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Perea and Mr. President--6.

Nays, Messrs. Mills, Richardson, Santistevan, Valdez, and Vigil-5.

Mr. Stover was absent.

Therefore the substitute for Council Bills Nos. 19 and 24, and House Bill No. 63 were duly passed.

Mr. Perea moved that the vote by which the substitute was just passed, be reconsidered and that the same be laid on the table indefinitely; which motion being carried it was so ordered.

The joint rules presented by the committee on rules were next taken up, but upon motion of Mr. Mills they were passed over until tomorrow.

Upon motion of Mr. Perea the Council then adjourned until 2 p. m. January 20, 1891.

Roll call was dispensed with, all the members being present. Upon motion of Mr. Jaramillo the reading of the Journal was dispensed with and the Journal approved.

The chair aunounced the order of business, petitions and memorials, none being presented.

Reports of standing committees were in order, and the committee on territorial affairs through their chairman, Mr. Ancheta, made a report on Council Bill No 30; report and bill to lie on the table, and await their regular order.

The same committee made a report on Council Bill No. 34, which report and bill were ordered to lie on the table and await their regular order.

Reports of special committees were now in order, none being presented.

Resolutions were in order, none being presented.

Introduction of bills was in order and Mr. Jaramillo introduced Council Bill No. 67, entitled An Act to amend an act entitled An Act for the maintenance and government of the penitentiary, being Chapter No. 79 of the Session Laws of 1889, the same was read in full for information, ordered considered as
