Journal of the Legislative Council of the Territory of Michigan

The following bills were severally taken up, considered in committee of the whole, and ordered to be engrossed and read a third time to-morrow, viz:

.."A bill to restrict the jurisdiction of the County Courts of the counties of Michilimackinac, Brown, and Crawford;" and

"A bill to amend an act, entitled "an act to provide for the ap pointment and to regulate the duties of District Attorneys, "

Mr. Trowbridge gave notice that he should on a future day, ask leave to bring in "a bill relative to taxes due on tax lists made out previous to the passing of the several township laws now in force." Mr. Schoolcraft moved that two members be added to the com mittee on Expenditures; the motion was agreed to; and,

Messrs. Irwin and Noble were appointed to be of said committee. The "bill to amend an act, entitled "an act concerning the Supreme, Circuit, and County Courts of the Territory of Michigan, defining their jurisdiction and powers, and directing the pleadings and practice therein in certain cases,' was taken up in committee of the whole; and, on motion of Mr. Noble, the bill was again laid on the table.

On motion of Mr. Drake, the Council went into the considera tion of Executive business; and having disposed thereof, On motion of Mr. Durocher, adjourned.

FRIDAY, June 13, 1828.

Prayer by the Rev. Mr. Cadle.

Mr. M'Donell presented the petition of Hiram Burnham, and others, of the township of Ypsilanti, praying that townships num bered one and two be set off and made a separate township, and be called "Superior." Referred to the committee on Territorial Affairs.

Mr. Noble, from the select committee to whom the subject was referred, made the following report, which was laid on the table: REPORT.

The select committee to whom was referred the following resolu tion of the 2d inst. to wit: That a committee of three be appointed to ascertain and report to the Council what business is necessary to be acted upon during the present session, and when the Council can adjourn-report:

That they have given to the subject that consideration which its importance demands, and after a careful examination of the business before the Council, would beg leave to submit the following as the result of their labors:

1st. That the bills of a general nature, now before the Council, should be first taken up and disposed of.

26. Those of a local character should then be taken up; and, 3d. Bills of a private nature, for the relief of individuals.

That under the first division should be classed the following subjects, together with all bills now ordered to a third reading, or upon their passage.

1st. The bill to prevent Justices of the Peace from keeping ta> verus, and for other purposes,

2d. The bill to provide for the laying out of certain Territorial Roads, and for other purposes.

3d. The bill declaring certain Rivors and their branches navigas ble.

4th. The bill to prevent the obstruction of navigable streams. 5th. The bill relative to distribution of Laws to Governors of States, &c.

6th. The bill to amend certain acts relative to the duties and privileges of townships.

7th The bill relative to the abolishing of the County Courts. 8th. The bill to amend an act concerning the Supreme, Circuit and County Courts, &c.

9th. The bill supplementary to the act for the relief of Insolvent Debtors.

10th. The bill amendatory of the act regulating and defining the powers and duties of Justices of the Peace, &c.

11th The bill amendatory to the act for defraying the necessary and public charges of the Territory.

12th. The bill amendatory to the act providing for the assessment and collection of Territorial taxes.

13th. The bill amendatory of the act to regulate highways.

14th. The bill to regulate taverns.

15th. The bill amendatory of the act regulating writs of replevin. 6th The bill relative to mill-ponds.

17th. The bill relative to Coroners and County Treasurers. 18th. The bill relative to a County Poor House for the county of Wayne, and for other purposes.

19th. The bill relative to District Attorneys.

20th. The bill authorising Commissioners of Bail to take acknowledge of deeds, &c.

Under the second division, the committee would class the follow. ing, to wit:

1st. The bill restricting the jurisdiction of the County Courts for the counties of Michilimackinac, Brown, and Crawford.

2d. The bill to adjourn and regulate the time of holding the County Court for the county of Wayne.

3d. The bill for a division of the township of Ypsilanti.

Under the third division, the committee would class the following: 1st. The bill to dissolve the bands of matrimony of Fowler and wife.

zd. The bill to dissolve the bands of matrimony of Johnson and wife.

3d. The bill authorising Thomas Palmer to convey certain real estate, &c.

The committee would recommend to the Council the propriety of taking up the bills in the order above arranged, and that no new bills (excepting those matters now before the several committees, and which offer grounds for a bill,) be introduced, except upon the special order of the Council.

The committee further recommend an adjournment of the Council on the 25th day of June inst. to the 1st Monday in May next, unless sooner convened by a proclamation from the Governor.

All of which is respectfully submitted.

Mr. Noble, from the committee on the Judiciary, reported,

"A bill in addition to, and amending "an act for the relief of Insolvent Debtors," which was read the first time; and, on motion, said bill was read the second time and laid on the table.

MSchoolcraft, from the committee on the Library, to whom the subject was referred, made the following report, which was read, and, on motion, accepted by the Council, viz:

REPORT.

The committee to whom was referred the resolution of the 17th May, 1828, making it their duty" to examine the situation of the Library-the number of volumes of statutes of the several Stes and Territories, and other books belonging thereto, and to make report to the Council, whether any, and what number of volumes are missing, and also such rules and regulations as they may deem necessary to prevent any loss or damage to the Library”—have had the same under consideration, and report:

ibat the number of volumes of sta.ures, state papers, and proTodings of various legislative bodies, belonging to the Library;

one hundred and thirty-one, agreeably to a catalogue herewith submitted marked A.-of which number sixteen are in the pamphlet form.

The number of volumes missing, is thirty-two, including seven volumes of the pamphlet laws, the titles of which are designated in the accompanying catalogue marked B.

In the execution of that part of the duties imposed by the resolu tion, which respects the adoption of such rules and regulations as may have a tendency to prevent loss or damage to the Library, the committee ask leave to report the following rules, for the govern ment of the Librarian:

1. The Librarian shall attend every day during the session of the Council, for half an hour immediately preceding the meeting of the Council, for the purpose of delivering such books as may be requir ed, or receiving such as may be returned by members.

2. Books shall be leaned to members of the Legislative Council, including their Clerk, and to the Governor and Supreme Judges of the Territory.

3. No book shall be retained more than one week, during the sessions of the Council, or one month during the recess, without renewal of leave.

4. All books loaned shall be entered in a book in the name of the person borrowing, to be kept for that purpose, with the date of loan, the number and size of the volume, or volumes, and the date of its being returned.

5. he Librarian shall cause every book to be labeled "Legisla tive Council of the Territory of Michigan," and to be recorded by its title, in a book to be kept for that purpose. He shall also be authorised to cause such pamphlets to be bound as may require it, and to take such measures for the preservation of the Library, or of the furniture and property committed to his charge, as may, on advice of the Governor, be deemed necessary-a due regard being always had to economy in the expenditures connected with this duty and for all such occasional and necessary expenditures he shall present bills, properly attested, on making his annual report.
