Senator Chaney, chairman of the Committee on Ways and Means, offered the following reports:

MR. PRESIDENT: Your Committee on Ways and Means, to whom was referred House bill No. 289, An act making an appropriation for the former judge and stenographer of the court of common pleas of Cherokee and Crawford counties, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, House bill No. 470, An act to amend section 1 of chapter 131, Session Laws of 1891, entitled "An act to establish the salaries of state officers, their assistants and clerks, judges, officers and employees of the legislature," the same being section No. 6076 of the General Statutes of Kansas, 1901, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, House bill No. 269, An act making an appropriation to Eric E. Walgren, a private soldier and member of battery B of the Kansas National Guards, for leg broken while performing military duty and acting under orders of his superior officers, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, Senate bill No. 424, An act authorizing the Executive Council to participate in the semi-centennial of the passage of the Kansas-Nebraska bill on behalf of the state of Kansas, and making an appropriation therefor, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, House bill No. 735, An act making an appropriation for conveying prisoners to the Penitentiary for the fiscal years ending June 30, 1904, and June 30, 1905, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, House bill No. 158, An act making an appropriation for the forestry stations at Ogallah and Dodge City, Kan., for the fiscal years ending June 30, 1904, and June 30, 1905, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, House bill No. 314, An act making appropriation to reimburse the Atchison, Topeka & Santa Fe Railway Company for moneys advanced by it to the state of Kansas to pay the salary of a live-stock sanitary inspector during a portion of the year 1899, and instruct me to report the bill back to the Senate with the recommendatiou that it be passed. Senator Simons, acting chairman of the Committee on Engrossed Bills, offered the following reports:

MR. PRESIDENT: Your Committee on Engrossed Bills, to whom was referred Senate bill No. 368, An act relating to bonds and undertakings, to allow certain corporations to be accepted as sureties thereon, regulating the admission of such corporations to Kansas,

the control and regulation of all corporations engaged in the surety bonding business, and imposing penalties in violation of this act;

Also, Senate bill No. 274, An act to provide for the indeterminate sentence of persons convicted of certain felonies, for the termination of such sentence and the release of such persons, defining the duties of the directors and warden of the Penitentiary in relation thereto, and repealing section 5686 of the General Statutes of 1901 and all acts and parts of acts in conflict herewith;

Also, Senate bill No. 297, An act amending section 3392 of the General Statutes of 1901, and repealing said section 3392, in relation to insurance;

Also, Senate bill No. 302, An act amending section 3404 of the General Statutes of Kansas for 1901, in relation to insurance, and repealing said section 3404;

Have compared the engrossed copies with the original bills, and instruct me to report the bill back to the Senate correctly engrossed. R. T. SIMONS, Acting Chairman.

MESSAGES FROM THE HOUSE.

MR. PRESIDENT: I am directed by the House to inform the Senate that the House has amended, and passed as amended, Senate bill No. 359, An act making appropriation for certain improvements and repairs at the Kansas State Industrial Reformatory, at Hutchinson, for the purchase of pasture land and live stock, and for current expenses and salaries of officers and employees for said State Industrial Reformatory, for the fiscal years ending June 30, 1904, and June 30, 1905.

Also amended, and passed as amended, Senate bill No. 407, An act making appropriation for state printing for the balance of the fiscal year ending June 30, 1903.

The bills are transmitted herewith.

MR. PRESIDENT: I am directed by the House to inform the Senate that the House has non-concurred in Senate amendments to House bill No. 1, An act authorizing the erection, equipment and furnishing of a county building for a court-house and county-office building in Neosho county, Kansas, the purchase or condemnation of a site therefor, providing means to pay for the erection, equipment and furnishing of said building and to pay for said site, and authorizing the sale or leasing of the present county building and court-house of said county, and asks for a committee of conference.

Also, has concurred in the Senate amendments to House bill No. 443, An act to confer the rights of majority upon Wallace Cole Mallette and Clair W. Thurman, minors.

MR. PRESIDENT: I am directed by the House to inform the Senate that the House has passed House bill No. 415, An act authorizing -41 Sen.

Plum Grove township, Butler county, Kansas, to issue bonds to aid in the construction of railroads.

Also, passed House bill No. 173, An act to limit the amount of bonded indebtedness of cities of the first class having a population of 50,000 or more.

Also, passed House bill No. 673, An act to change the names of certain citizens of Sedgwick county, Kansas.

Also, passed House bill No. 542, An act authorizing Twin Grove township, in Greenwood county, Kansas, to vote bonds not to exceed $5000 for the purpose of prospecting for coal, ore, natural gas, or other valuable minerals, and utilizing the same if found.

Also, passed House bill No. 656, An act fixing the salary of clerk of the district court of Ottawa county, Kansas.

Also, passed House bill No. 687, An act relating to the salary of commissioner of the poor in certain counties.

Amended, and passed as amended, Senate bill No. 460, An act regulating the salary of the county commissioners of Douglas county, and repealing all acts and parts of acts in conflict with this act. The bills are transmitted herewith.

MESSAGE FROM THE GOVERNOR.

EXECUTIVE DEPARTMENT,

TOPEKA, February 24, 1903.

I have this day received and approved Senate bill No. 50, An act to regulate the practice of dentistry, prescribing penalties for the violation thereof, and repealing chapter 123 of the Session Laws of 1885, chapter 152 of the Session Laws of 1887, and chapter 110 of the Session Laws of 1891.

Also, Senate bill No. 239, An act to erect and maintain certain dams across the Kansas river, granting the right to erect and maintain certain dams across the Kansas river, and the right of way

over a certain strip of land over and across the Insane Asylum grounds, in Shawnee county, for certain purposes.

Senator Householder introduced Senate resolution No. 65, as follows:

Resolved, That the secretary of the Senate be and is hereby directed to request the House to return Senate bill No. 522 and House bill No. 513 to the Senate, for further consideration.

The resolution was adopted.

Senator Chaney moved that Senate bills Nos. 562 and 563 and House bill No. 30 be placed on the Calendar under the head of "Bills on Third Reading," subject to amendment and debate.

The motion prevailed.

On motion of Senator Peterson, Senate bill No. 524 was ordered recalled from the House.

The chair appointed Senators Carpenter and Stewart as a conference committee on House bill No. 1.

On motion of Senator Cubbison, Senate bill No 568 was ordered placed on the Calendar under the head of "Local Bills on Third Reading."

Senator McMillan introduced Senate petition No. 27, as follows:

To the Honorable Senate and House of Representatives, Topeka, Kan.:

GENTLEMEN-The undersigned desire in this manner to call your attention to the equity and the advisability of fixing fair and moderate tuition fees for all students attending the higher educational institutions supported by the state. It is our opinion that the student should pay a part of the expense of supporting and maintaining these institutions. In the name of justice and equity, and as opposed to a dangerous paternalism which desires to get everything free of charge from the state and government, we petition you, gentlemen, to enact the laws necessary to enforce the above suggestion. Signed by M. C. Shaible and seventy-eight others.

The petition was referred to the Committee on Educational Institutions.

Senator Allen moved that the Senate concur in the amendments made by the House on Senate bill No. 460.

The motion prevailed and the roll was called, with the following result: Yeas 26, nays 1; absent or not voting, 13.

Senators voting in favor of concurring were: Allen, Branine, Carpenter, Chaney, Codding, Crum, Cubbison, Findlay, Fulton, Gabriel, Henley, Householder, Hurrel, Kennedy, McMillan, Morrow, Peterson, Porter, Simons, Smith, Sponable, Stewart, Tapp, Ward, Wright, and Wulfekuhler.

Senator Morehouse voted in the negative.

Senators absent or not voting were: Buschow, Caldwell, Conrad, Fitzpatrick, Fullington, King, Leidy, McKnight, Miller, Noftzger, Pestana, Vincent, and White.

A constitutional majority having voted in favor of concurring with the amendments made by the House, the Senate concurred.

On motion of Senator Carpenter, Senate bill No. 486 was withdrawn from the custody of the Senate.

Senator Chaney moved that the rules be suspended, and Senate bill No. 424 and House bills Nos. 269, 158, 314, 735, 470 and 289 be placed on third reading, subject to amendment and debate.

The motion prevailed and it was so ordered.

On motion of Senator Peterson, the Senate adjourned.
