House of Representatives has concurred in Senate amendments to House bills Nos. 197, 203, 323, 402 and 241.

HOUSE MESSAGES CONSIDERED.

House bill No. 387, "An act making appropriations for miscellaneous expenses," was read the first time.

Mr. Edwards moved that the rules be suspended, and House bill No. 387 be read the second time and referred now, which motion prevailed, and House bill No. 387, "An act making appropriations for miscellaneous expenses," was read the second time and referred to the committee of the whole Senate.

Mr. Butler moved that the request of the House for a committee of conference on the appropriation bills be granted, which motion prevailed.

The President appointed as such committee, on the part of the Senate, Messrs. Butler, Moonlight, and St. John.

Mr. Murdock moved that the Senate do now resolve itself into committee of the whole for the consideration of appropriation bills, which motion prevailed.

After some time spent therein, the committee arose, and through its chairman made the following report:

MR. PRESIDENT: Your committee of the whole Senate has had under consideration the following bills:

House bill No. 385, "An act making appropriations for the state agricultural college at Manhattan," and I am directed to report the said bill to the Senate with the recommendation that it be passed.

House joint resolution No. 4, "Making an appropriation to James M. Matheny," and recommend that it be passed, subject to amendment on third reading.

House bill No. 406, “An act making appropriations to the insurance department," and recommend that it be passed, subject to amendment on third reading.

J. C. WILSON, Chairman. On motion, the report of the committee of the whole Senate was agreed to.

Mr. York moved that the rules be suspended, and House bills

Nos. 157 and 333 be considered engrossed and ordered to the third reading, which motion prevailed.

On motion, the Senate adjourned.

SENATE CHAMBER, TOPEKA, KANSAS, March 5, 1873, 2 o'clock P. M. The Senate met pursuant to adjournment; President in the chair.

Roll called. The following gentlemen were present and answered to their names: Messrs. Blair, Brandley, Butler, Barker, Crichton, Edwards, Ely, Grimes, Guerin, Matheny, McFarland, McWirt, Moonlight, Morrill, Murdock, Rogers, Schmidt, Simons, St. John, Topping, Wilson, J. C., Wilson, V. P., Winter, and York. Quorum present.

Mr. Butler, from the committee of conference on the appropriation bills, submitted the following report:

MR. PRESIDENT: Your committee of conference on House bills Nos. 324, 364, 358, 361, 344, and 386, beg leave to make the following report: Your committee recommend, in House bill No. 324, the Secretary of State be allowed $3,200 for clerical force; Auditor of State, for clerical force, $3,000; Treasurer of State, clerical force, $3,200; Adjutant General's office, $550, out of which shall be paid the claims of the outgoing Adjutant General; strike out "postage stamps, $50," and "contingent fund, $100," in Adjutant General's allowance; Superintendent Public Instruction, strike out "assistant superintendent," and allow clerk hire, $1,200, traveling expenses, $500; strike out "desk, $100;" allow shelving, $200; Supreme Court, allow contingent fund, $200; shelves, $300; strike out all relating to misdemeanors. House bill No. 364, state penitentiary appropriations, strike out section 3, relating to misdemeanors.

House bill No. 358, strike out the section relating to misde

meanors.

House bill No. 361, strike out that part of the section relating to misdemeanors, and retain the remainder of the section, and the Senate to recede from all other amendments.

House bill No. 344, strike out all relating to misdemeanors. House bill No. 386, strike out all relating to misdemeanors. The above embraces all the differences between the House and Senate. All of which is respectfully submitted.

And the question being, Will the Senate adopt the conference report on House bill No. 386? the roll was called with the following result: Yeas, 20; nays, 1.

Gentlemen voting in the affirmative were: Messrs. Brandley, Barker, Crichton, Edwards, Ely, Grimes, Guerin, Moonlight, O'Neil, Price, Rogers, Schmidt, Simons, Simpson, St. John, Topping, Wilson, J. C., Wilson, V. P., Winter, and York.

Mr. Blair voted in the negative.

Gentlemen absent or not voting were: Messrs. Butler, Johnson, Judd, Martin, Martindale, Matheny, McFarland, McWirt, Morrill, Murdock, Palmer, and Walker.

And so, a constitutional majority having voted in the affirmative, the report on House bill No. 386 was adopted.

Ordered that the Secretary inform the House thereof.

And the question being, Will the Senate adopt the conference report on House bill No. 344? the roll was called with the following result: Yeas, 23; nays, 0.

Gentlemen voting in the affirmative were: Messrs. Blair, Brandley, Barker, Crichton, Edwards, Ely, Grimes, Guerin, Judd, Matheny, McFarland, Moonlight, Murdock, O'Neil, Price, Rogers, Simons, Simpson, St. John, Wilson, J. C., Wilson, V. P., Winter, and York.

Gentlemen absent or not voting were: Messrs. Butler, Johnson, Martin, Martindale, McWirt, Morrill, Palmer, Schmidt, Topping, and Walker.

And so, a constitutional majority having voted in the affirmative, the report on House bill No. 344 was adopted.

Ordered that the Secretary inform the House thereof.

And the question being, Will the Senate adopt the conference

report on House bill No. 361? the roll was called with the following result: Yeas, 14; nays, 12.

Gentlemen voting in the affirmative were: Messrs. Crichton, Ely, Grimes, Judd, Moonlight, Price, Rogers, Simons, Simpson, St. John, Topping, and York.

Gentlemen voting in the negative were: Messrs. Blair, Butler, Barker, Edwards, Guerin, McFarland, Murdock, O'Neil, Schmidt, Wilson, J. C., Wilson, V. P., and Winter.

Gentlemen absent or not voting were: Messrs. Brandley, Johnson, Martin, McWirt, Morrill, Palmer, and Walker.

And so, a constitutional majority not having voted in the affirmative, the report on House bill No. 361 was not adopted.

Ordered that the Secretary inform the House thereof.

And the question being, Will the Senate adopt the conference report on House bill No. 358? the roll was called with the following result: Yeas, 23; nays, 0.

Gentlemen voting in the affirmative were: Messrs. Butler, Barker, Crichton, Ely, Grimes, Guerin, Judd, Martindale, Matheny, Moonlight, Murdock, O'Neil, Price, Rogers, Schmidt, Simons, Simpson, St. John, Topping, Wilson, J. C., Wilson, V. P., and Winter.

Gentlemen voting in the affirmative were: Messrs. Butler, Crichton, Grimes, Guerin, Judd, Martindale, Matheny, Moonlight, Morrill, Murdock, Price, Rogers, Schmidt, Simons, Simpson, St. John, Topping, Wilson, V. P., Winter, and York.

Mr. Ely voted in the negative.

Mr. Brandley, chairman of the committee on enrolled bills, made the following reports:

MR. PRESIDENT: Your committee on enrolled bills, to whom was referred Senate bill No. 61, "An act for the relief of John B. Scott, J. C. Hemingray, M. E. Grimes and Elijah Robinson, have had the same under consideration, and I am directed to report the said bill to the Senate correctly enrolled, and have presented the same to the Governor for his signature.

MR. PRESIDENT: Your committee on enrolled bills, to whom was referred Senate bill No. 19, "An act concerning the bridg ing of the Great Arkansas river in Rockford township, Sedgwick county, Kansas," have had the same under consideration, and I am directed to report the said bill to the Senate correctly enrolled, and have presented the same to the Governor for his signature.
