The Senate met pursuant to adjournment; President in the chair.

Roll called. The following gentlemen were present and answered to their names: Messrs. Blair, Brandley, Butler, Barker, Moonlight, Morrill, O'Neil, Palmer, Simons, St. John, Topping, Wilson, V. P., and Winter. No quorum present.

Mr. Butler moved a call of the Senate, which motion prevailed. The Sergeant-at-Arms was directed to bring in absentees.

After some time the Sergeant returned with Messrs. Crichton, Judd, McFarland, and Murdock.

Mr. Butler moved that further proceedings under the call be dispensed with, which motion prevailed.

Quorum present.

Prayer by the Chaplain, Rev. F. S. McCabe.

Mr. McFarland moved that the reading of the journals be dispensed with.

The President laid before the Senate the following communication from the agricultural society:

To the President of the Senate and the Speaker of the House of
Representatives:

In obedience to Senate concurrent resolution No. 40, we have the honor to report that the MS. of the agricultural report for 1872 was placed in the hands of the public printer on the 18th day of November last, with the understanding that the report would be ready to place upon the desks of members during the first week of the legislative session. Owing to the press of other public printing, (as we are informed by the public printer,) the report has been subjected to this extraordinary delay. The volume will make about 500 pages, with contents as follows, to

wit:

Proceedings of the board.

Report of the eighth annual exhibition held at Topeka, September 16-20, inclusive.

Reports of twenty-one county agricultural societies, under the law of last winter.

Paper on economic entomology, with illustrations.

Prize essays on raising, feeding and management of hogs; of cattle; of horses; proper uses of manures, and the maintenance of the fertility of the soil.

Practical papers on forest trees in Kansas; agricultural education; building stones of Kansas; timber planting.

Under the auspices of the Academy of Science: History and proceedings of the Academy of Science; plants of Kansas; birds of Kansas; coals of Kansas; red sandstones of central Kansas; meteorological tables from 1868 to 1873, inclusive, five years; geology of the Arkansas Valley; agricultural farm experiments.

The report will also contain the report of the State Horticul tural Society for 1872, and the report of the Secretary of the State Board of Agriculture to the Board. The latter will contain statistical and other information concerning the various

industries of the state, so far as it has been possible to obtain them, and a general review of agriculture for 1872. The report will be furnished members of the legislature at the earliest possible moment. We have the promise of it before adjournment. Respectfully submitted.

Mr. McFarland, chairman of the commmittee on judiciary, made the following reports:

MR. PRESIDENT: Your committee on judiciary, to whom was referred House bill No. 132, "An act to amend sec. 470 of art. 20 of the code of civil procedure, approved February 25, 1868," have had the same under consideration, and I am directed to report the said bill to the Senate with the recommendation that it be rejected.

PRESIDENT: Your committee on judiciary, to whom was referred House bill No. 144, "An act to amend sec. 72, chap. 80, general statutes of Kansas, of 1868, and to provide for constructive service in case of change of venue," have had the same under consideration, and I am directed to report the said bill to the Senate with the recommendation that it be rejected.

PRESIDENT: Your committee on judiciary, to whom was referred Senate bill No. 148, "An act to amend sections 16 and 139 of chapter 80 of the general statutes," have had the same under consideration, and I am directed to report the said bill to the Senate with the recommendation that the first section of said Senate bill 148 be rejected, and recommend the passage of the remaining sections of said bill.

Mr. Moonlight presented a petition of seven hundred and ninety mechanics from all parts of the state, praying the legislature to protect them against penitentiary labor, as in competition with business carried on by private enterprise, which was referred to the committee on manufactures.

Mr. Moonlight, chairman of the special committee on House bill No. 245, made the following report:

MR. PRESIDENT: Your special committee to whom was referred House bill No. 245, "An act to provide for certain improvements in Leavenworth county," have had the same under consideration, and I report the said bill to the Senate with the recommendation that it be passed. Senator Winter dissenting.

Mr. Morrill, chairman of the committee on education, made the following report:
