Mr. Ely, Chairman of the Committee on Engrossed Bills, made the following report:

Mr. President: Your Committee on Engrossed Bills, have examined

Senate Bill No. 17, An act with reference to cities of the first class,

And find the same correctly engrossed.

Mr. Murdock moved that the Senate now resolve itself into Committee of the Whole for the consideration of bills upon the Calendar.

Which motion prevailed.

COMMITTEE OF THE WHOLE.

Mr. Guerin in the chair.

After some time spent therein the Committee arose and, through their Chairman, made the following report:

MR. PRESIDENT: Your Committee of the Whole have had under consideration

Senate Bill No. 44, To amend section 1 of chapter 35, General Statutes of 1868, relating to dram shops.

And I am instructed to report the said bill to the Senate with the recommendation that it be passed.

Senate Bill No. 39, To amend an act entitled an act relating to the sale of property without appraisement, approved March 1, 1872,

And recommend that it be passed.

Senate Bill No. 63, To amend an act entitled an act to amend an act entitled an act to incorporate and establish the city of Leavenworth, Kansas territory, and for revising and

repealing all laws and parts of laws heretofore enacted on that subject, approved February 27, 1872,

And recommend that it be recommitted to the Leavenworth delegation as a Special Committee, and retain its place upon the Calendar.

Senate Bill No. 13, An act making an appropriation for the State Asylum for the Deaf and Dumb,

And recommend that it be referred to the Committee on Ways and Means, and retain its place upon the Calendar.

House Bill No. 5, An act authorizing the county commissioners of Cowley county, Kansas, to issue bonds to liquidate the indebtedness of said county,

And recommend that it be passed over and retain its place upon the Calendar.

Senate Bill No. 28, An act to postpone sale of real estate for taxes of 1872,

And recommend that it be passed over and retain its place upon the Calendar.

Was recommitted to the Committee on Judiciary be reconsidered.

Which motion prevailed.

Mr. Johnson asked, and by unanimous consent obtained, leave to introduce

Senate Bill No. 117, An act to authorize counties and cities to fund matured indebtedness.

Read first time.

Mr. Johnson asked, and by unanimous consent abtained, leave to introduce

Senate Bill No. 118, An act in relation to challenges of jurors in criminal cases, and to repeal section 205 of an act to establish a code of criminal procedure, approved February 20, 1868.

Read first time.

Mr. Guerin asked, and by unanimous consent obtained, leave to introduce

Senate Bill No. 119, An act relating to the printing and binding of the reports of the decisions of the supreme court, and to provide for the purchase, sale and disposal thereof. Read first time.

Mr. Guerin asked, and by unanimous consent obtained leave to offer

Senate Concurrent Resolution No. 36, Relating to the Indian Territory and concerning Indians.

Laid over under the rules.

The Senate resolved itself into an executive session.

MESSAGE FROM THE GOVERNOR.

The following message from the Governor were received and read:

For the unexpired term caused by the removal of W. C. Webb, I hereby nominate Edward Russell, for the office of Superintendent of Insurance.

The nomination of Edward Russell as Superintendent of Insurance was confirmed.

Ordered that the Secretary inform the Governor thereof.

The executive session was dissolved.

Mr. Johnson moved that the vote by which the vote recommitting Senate Bill No. 35 to the Committee on Judiciary was reconsidered, be reconsidered.
