RESOLUTIONS.

The following resolutions were introduced:

H. R. No. 44, by Mr. Kekaula, relating to an appropriation for the construction of a road from Ninole to Wailau, Kau, Hawaii. Referred to the Committee on Public Lands and Internal Improvements.

H. R. No. 43, by Mr. Kekaula, for widening and repairing road from Hoopuloa to Milolii, South Kona, Hawaii. Referred to the Committee on Public Lands and Internal Improvements.

NOTICES OF BILLS.

Notice was given of intention to introduce the following

By Mr. Beckley, entitled "The Public Health Act,' repealing Act 60 of 1896, also Chapter LXXII of the Session Laws of 1892, and all laws and regulations inconsistent herewith."

By Mr. Beckley, entitled "An Act creating the office of Transportation Commissioner; fixing his salary and defining his duties and the duties of common carriers, and providing penalties for violation thereof, and repealing all laws in conflict herewith." By Mr. Dickey, entitled "An Act fixing the salaries of certain Government officers."

BILLS ON FIRST READING.

The following Bill, notice of which had previously been given, was introduced, read by title, passed first reading, and was ordered printed:

H. B. No. 61, by Mr. Kawaihoa, entitled "An Act to amend the title of Chapter LXII of the Penal Laws as compiled in A. D. 1897, and Sections 987, 989 and 990 of the said Penal Laws."

On motion of Mr. Haaheo, the Rules were suspended in order to reconsider the vote upon which the following Bill was not rejected and consequently passed its first reading:

S. B. No. 5, by Mr. C. Brown, entitled An Act to define the biennial fiscal period of the Territory of Hawaii." Mr. Robertson moved to take up the order of the day. Carried. Mr. Prendergast moved to reconsider the motion upon which the ayes and noes were ordered upon the question of the rejection of said Bill. Carried. Mr. Makekau moved that the Bill be read again. Carried. The Bill was again read. Mr. Puuki moved to reject the Bill. Motion seconded.

HEADS OF DEPARTMENTS.

The following communication from Head of Department

was read:

No. 37, by Mr. Beckley, relating to certain roads in the District From the Superintendent of Public Works in reply to H. R. of Hana, Maui. On motion of Mr. Beckley, the communication was referred to the Committee on Public Lands and Internal Improvements, and authority was given said Committee to send for persons and papers, administer oaths, and employ counsel, if

necessary.

Under a suspension of the Rules, on motion of Mr. Makekau the following Bill was taken up for consideration:

S. B. No. 5, by Mr. C. Brown, entitled "An Act to define the biennial fiscal period of the Territory of Hawaii." Mr. Beckley moved that the Bill be rejected. On motion of Mr. Dickey, the ayes and noes were ordered upon the motion to reject, with the following result: Mr. Emmeluth was excused from voting.

The following Bill was read by title, and, on motion of Mr. Makekau, was rejected on its first reading:

RESOLUTIONS.

The following Resolutions were introduced:

H. R. No. 45, by Mr. Emmeluth, relating to the Pali Road contract, Honolulu, and requesting information thereon from the Superintendent of Public Works. Adopted.

H. R. No. 46, by Mr. Keliikoa, relating to an appropriation for roads, North Kona, Hawaii. Referred to the Committee on Public Lands and Internal Improvements.

H. R. No. 47, by Mr. Prendergast, as follows:

Resolved, that all communications received by the House of Representatives during this present session of the Legislature from the Honorable Governor of this Territory, other than the Governor's message, be spread upon the Journal of this House forthwith, and that all communications which may at any time in the future be received from the Honorable Governor be spread, immediately upon the receipt thereof by the House, upon the Journal of the House; and,

Be It Further Resolved, that all communications received during this present session of the Legislature from the Honorable Secretary of the Territory be spread upon the Journal of the House, and that all communications which may be received in the future from the Honorable Secretary be spread, immediately upon the receipt thereof by the House, upon the Journal of the

House.

REPORTS OF STANDING COMMITTEES.

The following reports of Standing Committees were pre

sented:

On Petition No. 18, by Mr. Paele, relating to macadamizing Iwilei street, from Mr. Makainai, Chairman of the Committee on Public Lands and Internal Improvements, recommending that the Petition be granted. Consideration was postponed, to be taken up with the Appropriation Bill.

On Petition No. 17, by Mr. Paele, relating to the macadamizing of Liliha street between Wylie and Puunui streets, from Mr. Makainai, Chairman of the Committee on Public Lands and Internal Improvements, recommending an appropriation of $1,500 for that purpose. Consideration was postponed, to be taken up with the Appropriation Bill.

On H. R. No. 41, by Mr. Kekaula, relating to an appropriation of $1,000 for Court House for East Kau; $500 for Jail, East Kau, and $500 for enlarging Waiohinu Court House, Kau, Hawaii, from Mr. Makainai, Chairman of the Committee on Public Lands and Internal Improvements, recommending the adoption of the Resolution. On motion of Mr. Mahoe, the report was adopted.

THE ORDER OF THE DAY.

Consideration of the two communications from His Excellency the Governor, which were received yesterday by this House, were taken up. On motion of Mr. Makainai, further consideration of these matters was postponed until the House should receive the reply of the Governor to a later communication from the Speaker, transmitting certified copies of H. R. No. 14, by Mr. Beckley, and H. R. No. 38, by Mr. Gilfillan; one of which the Governor had failed to receive with the Speaker's former let

ter.

BILLS ON THIRD READING.

The following Bill was taken up for consideration upon its third reading:

H. B. No. 17, by Mr. Robertson, entitled "An Act relating to practice in criminal cases and amending Sections 1, 2, 3 and 4 of Chapter XL of the Session Laws of 1876." In the absence of the introducer of the Bill, on motion of Mr. Dickey, consideration was postponed until the introducer should be present.

Consideration of the communication received by the House yesterday from the Secretary of the Territory was, on motion of Mr. Mossman, indefinitely postponed.

On motion of Mr. Monsarrat, the House thereupon stood in recess until 2 o'clock p. m.
