No. 1273) entitled “An act in relation to revenues received by the city of Utica from taxes collected pursuant to article nine-a of the Tax Law from mercantile and manufacturing corporations for the year beginning November first, nineteen hundred and eighteen," was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

The Assembly returned the bill (No. 1271, Assembly Reprint No. 1720, Int. No. 925) entitled "An act to amend section two hundred and sixty-four of the charter of the city of Buffalo, as

amended by chapter two hundred and sixty of the Laws of nineteen hundred and sixteen, relating to the police pension fund of said city," with a message that they have concurred in the passage of the same, with the following amendments:

Page 4, line 21, place brackets around the word " quarterly' as it is omitted.

Page 5, line 3, after the last word "salaries" add this new matter in italics "into the police pension funds ".

Page 11, line 15, after the last word "immediately" strike out the period and insert in lieu thereof semicolon and add the following: provided, however that the council shall not grant any additional pensions for service of twenty-five years or more, as provided in subdivision three of section two hundred and sixty-four of the act hereby amended, until after the first day of May, nineteen hundred and nineteen" in italics.

Mr. Gibbs moved that the Senate concur in said amendments.

The President put the question whether the Senat would concur in said amendments, and it was decided in the affirmative.
