After some time spent therein, the President resumed the chair,

and Mr. D. F. Davis, from said committee, reported in favor of the passage of the first forty-four named bills, the fortieth, forty-second and forty-fourth named with amendments, which report was agreed to, and said bills ordered to a third reading.

Mr. D. F. Davis, from said committee, also reported progress on the forty-fifth, forty-sixth, forty-seventh and forty-eighth named bills, and asked and obtained leave to sit again.

Mr. Raines moved that the Senate take a recess until 4.30 o'clock p. m.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Feeter, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill introduced by Mr. Hallock, Rec. No. 361, entitled "An act in relation to the election of assessors and justices of the peace in the town of Southampton, in the county of Suffolk" (No. 1483), reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Feeter, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill introduced by Mr. Gould, Rec. No. 309, entitled "An act to make the office of sheriff of Seneca county a salaried office, and to regulate the management thereof” (No. 1539), reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

No. 261, entitled "An act to permit a highway to be laid out in the Ravena road district, in the town of Coeymans, in the county of Albany, not less than 30 feet wide in the narrowest part and 40 feet wide in the widest part of such highway' (No. 1167), reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

On motion of Mr. Norton, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

On motion of Mr. Graney, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

No. 307, entitled "An act to amend section 791 of the Code of Civil Procedure " (No. 1582), reported in favor of the passage of the same, with some amendments, which report was agreed to.

On motion of Mr. Ford, and by unanimous consent, the rules were suspended and said bill ordered to a third reading.

Mr. Malby, from the committee on codes, to which was referred the bill introduced by Mr. Marshall, Int. No. 948, entitled "An act to amend section 1670 of the Code of Civil Procedure, relating to the filing and recording of notices of pendency of action" (Nọ. 1282), reported in favor of the passage of the same, with some amendments, which report was agreed to, and the bill restored to its place on the order of third reading.

No. 936, entitled "An act to amend section 723 of the Code of Civil Procedure so as to extend the powers of the courts upon the allowance of amendments to pleadings or the service of supplemental pleadings" (No. 1246), reported in favor of the passage of the same, with some amendments, which report was agreed to.
