A messenger from the House appeared and announced that that body had passed Council Bill No. 82, entitled An Act to amend An Act of the 27th Legislative Assembly, Section 2, Chapter 71, entitled An Act relating to practice in the Supreme Court; also, Council Joint Resolution No. 5.

The committee on enrolled and engrossed bills through their chairman, Mr. Ancheta, reported Council Joint Resolution No. 5 as correctly enrolled.

The chair announced that he had signed Council Joint Resolution No. 5.

Upon motion of Mr. Perea the Council then adjourned until 2 p. m. Monday, February 2, 1891.

Council met pursuant to adjournment.

Session opened by prayer by the Rev. John Menaul. Roll call dispensed with, all members being present, The Journal of Saturday's proceedings was read and approved, upon motion of Mr. Perea.

A messenger from the House appeared and announced that that body had passed Council Bill No. 8, entitled An Act declaring certain trusts, pools and combinations illegal and providing for the punishment thereof; also

Council Bill No. 48-entitled An Act enabling the authorities having charge of the finances of any town or city of the Territory of New Mexico, to refund any bonds or other obligations of said towns or cities, by the issuance of similar obligations bearing a less rate interest, also

House Bill No. 44-entitled An Act to provide for the election of county prosecuting attorneys and prescribing their duties, also House Joint Memorial No. 4 in relation to depredations of Navajo Indians.

As a matter of privilege, the committee on enrolled and engrossed bills through its chairman, Mr. Ancheta, reported that Council Bill No. 55 was duly enrolled and upon motion of Mr. Stover the report was adopted.

The chair announced that he had signed Council Bill No. 55, entitled An Act to provide for the issuance of county current expense bonds in the Territory of New Mexico.

By unanimous consent Mr. Richardson introduced the following bills:

Council Bill No. 108-entitled An Act in relation to crimes, punishments and criminal procedure; the bill was read a first time by title, and under suspension of the rules read a second time, ordered printed and referred to the committee on the judiciary; also

Council Bill No. 109-entitled An Act to fix the salaries of the county treasurers of Lincoln, Chaves and Eddy; the bill was read a first time by title, and under suspension of the rules read a second time, ordered printed and referred to the committee on the judiciary; also

Council Bill No. 110--entitled An Act in relation to the Legislative Assembly of the Territory of New Mexico, fixing the time of assembling thereof; the bill was read a first time, and under the suspension of the rules read a second time in full, and referred to the committee on territorial affairs; also

Council Bill No. 111--entitled An Act in reference to the collection of delinquent taxes in the counties of Lincoln, Chaves and Eddy; the bill was read a first time by title, and under suspension of the rules read a second time, and referred to the com mittee on finance.

By unanimous consent Mr. Mills introduced:

Council Bill No. 112-entitled An Act to establish, govern and maintain the normal school of New Mexico; the bill was read a first time by title, and under suspension of the rules, read a second time, ordered translated and printed and referred to the committee on education; also

Council Bill No. 113--entitled An Act relating to the assessors and collectors of taxes in the several counties of the Territory of New Mexico; the bill was read a first time, and

under suspension of the rules read a second time, ordered translated and printed and referred to the committee on finance; also

Council Bill No. 114-entitled An Act to amend Chapter 49 of the Session Laws of the 28th Legislative Assembly of the Territory of New Mexico, the bill was read a first time by title and under suspension of the rules read a second time, ordered translated and printed and referred to the committee on territorial affairs; also

Council Bill No. 115-entitled An Act making an appro priation for the construction of a suitable building for the territorial insane asylum; the bill was read a first time and under suspension of the rules read a second time and referred to the committee on finance.

By unanimous consent the committee on territorial affairs through its chairman, Mr. Ancheta, made a report on Council Bill No. 58, entitled An Act fixing the compensation of probate clerks and ex-officio recorders in the Territory of New Mexico, recommending the passage of the bill; the report and bill were ordered to lie on the table and await there regular order.

Mr. Ancheta presented a petition from the citizens of Hillsboro, N. M., praying for an appropriation for New Mexico's exhibit at the World's Columbian Exposition, which was read and referred to the committee on finance.

Upon motion of Mr. Perea the Council then resolved itself into a committee of the whole to resume the consideration of Council Bill No. 81, entitled An Act providing funds and making appropriations for the 42d and 43d fiscal years and for other purposes.

Upon the committee of the whole arising, the President as chairman of said committee, reported that they had had under consideration Council Bill No. 81 and had come to no resolution thereon.

Mr. Stover moved that the Council now adjourn out of respect to the memory of Secretary Windom, and presented the following resolution which was adopted:

Whereas, This body has learned with profound sorrow of the sudden and appalling death of Hon. William Windom, late secretary of the treasury of the United States, while in the prime of life and his usefulness as an official, and at the moment when he had concluded the utterance of sentiments calculated to ex

tend and broaden the influence of his country among the nations of the earth,

Be it resolved, By the Council of the 29th Legislative Assembly of the Territory of New Mexico, that in the death of William Windom, the people of the United States have lost a true friend, and firm advocate of American principles; the nation has lost an upright and honored officer, and the President a wise and conservative adviser.

Resolved, That as a mark of respect to the memory of the deceased, the flag upon the north dome of the capitol be at half mast the remainder of the day; and that this body do now adjourn.

Resolved, That these resolutions be spread upon the Journal of this Council, and an engrossed copy thereof be sent to the President of the United States, and that the same be communicated to the House of Representatives of this Territory, now in session.

The Journal of yesterday's proceedings was read and upon motion of Mr. Perea adopted.

Unanimous consent was granted Mr. Stover presented the following resolution:

Resolved, That the reports of the several territorial officers and employes be referred to appropriate committees. Which upon motion of Mr. Jaramillo was adopted.

By unanimous consent Mr. Stover introduced Council Bill No. 116, entitled An Act to establish the office of oil inspector and to require a safety test for illuminating oil; the bill was

read a first time by title, under suspension of the rules read a second time, ordered translated and printed and referred to the committee on territorial affairs.

Unanimous consent being granted Mr. Mills presented a memorial from the Commercial Club of Las Vegas, New Mex. ico, in relation to community land grants and the statute of limitation; which was read in full and referred to the commit tee on municipal and private corporations.

Mr. Ancheta presented a petition from J. H. McCrarey in relation to "water culture," which was read in full and referred to the committee on irrigation.

Mr. Santistevan presented a petition from the citizens of Precinct No. 1, Taos County, New Mexico, in relation to waterrights, which was read in full and referred to the committee on irrigation.

Upon motion of Mr. Stover, House Joint Resolution No. 5 in relation to recalling from the Governor House Bill No. 32, entitled An Act in relation to sewers in cities and incorporated towns for amendment, was taken up.

Mr. Stover moved that House Joint Resolution No. 5 be adopted, which motion was carried.

By unanimous consent Mr. Santistevan introduced Council Bill No. 117, entitled An Act to prevent illegal allowances against counties in this Territory; the bill was read a first time by title, and under suspension of the rules read a second time, ordered translated and printed, and referred to the committee on counties and county lines.

Mr. Ancheta introduced the following:

Council Bill No. 118-entitled An Act to ainend Section 11, of Chapter 96, of the Session Laws of 1889; the bill was read a first time by title, and under suspension of the rules read a second time and referred to the committee on the judiciary; also,

Council Bill No. 119-entitled An Act for the redemption of merchandise checks, orders, tickets and due bills at their face value, in cash or merchandise; the bill was read a first time, and under suspension of the rules read a second time, ordered translated and printed, and referred to the committee on territorial affairs.

Upon motion of Mr. Perea the Council then resolved itself into a committee of the whole with the President in the chair, to resume the consideration of Council Bill No. 81, entitled An
