condemning for destruction any property without compensation,' upon report from the Committee on Public Health and Education, recommending that the Bill as well as the findings of the Commititee as set forth in the report be referred to the Committee on Judiciary. On motion of Mr. Mahoe, the report was adopted.

REPORTS OF STANDING COMMITTEES.

The following reports of Standing Committees were presented:

On Petition No. 5, by Mr. Beckley, asking for an appropriation of $800.00 for school house, Waialua, Molokai, from Mr. Beckley, Chairman of the Committee on Public Health and Education, recommending that the Petition be granted. On motion of Mr. Mahoe, the report was adopted.

On Petition No. 7, by Mr. Paele, on behalf of the Hawaiian Relief Society, praying for pecuniary aid, from Mr. Beckley, Chairman of the Committee on Public Health and Education, recommending that the prayer of society be not granted at this session. On motion of Mr. Dickey, the Report was adopted.

THE ORDER OF THE DAY.

Petition No. 2A, in regard to the Dow claim, was taken up for consideration, together with the Majority and Minority Reports thereon. Moved by Mr. Paele, seconded by Mr. Makekau, that the Minority Report be adopted. Upon the motion to adopt, the ayes and noes were called, with the following result:

Ayes---Messrs. Ahulii, Beckley, Ewaliko, Hihio, Kaauwai, Kauimakaole, Kaniho, Kawaihoa, Mahoe, Makainai, Makekau, Mossman, Nailima, Paele, Prendergast and Puuki---16.

BILLS ON THIRD READING.

The following Bills were taken up for consideration on their third reading:

H. B. No. 2, by Mr. Dickey, entitled "An Act to appropriate an Emergency Fund to be used in repairing the damage caused by the late storm." Mr. Prendergast offered an amendment by

inserting $2,000 in place of $3,000 for Wailuku Mountain Road to Lahaina, and also to insert the word "Molokai" and the figures "$1,000" between the word "Lahaina" and word "Kauai" in Section 2. Seconded by Mr. Beckley. Carried. Mr. Dickey Carried. moved that the amount in the Bill be raised from $25,000 to $30,000 and that $10,000 be spent on roads in Makawao. Lost. On motion of Mr. Dickey, the Bill was ordered re-typewritten and made the order of the day for March 12th.

H. B. No. 3, by Mr. Robertson, entitled "An Act relating to the jurisdiction of Circuit Judges at Chambers in matters concerning the relation of guardian and ward; and amending Section 1367 of the Civil Code and Sections 38 of Chapter 57 of the Session Laws of 1892 as amended by Act 56 of the Session Laws of 1898." Mr. Mahoe moved that the Bill do pass, upon which motion the ayes and noes were called, with the following result:

H. B. No. 9, by Mr. Kaniho, entitled "An Act to repeal Sections 922, 925, and the second paragraph of Section 924, Part V, Chapter 59, of the Penal Laws as compiled in 1897, relating to vaccination." Mr. Ewaliko moved that the Bill do pass. On motion of Mr. Kaniho, the Bill was ordered typewritten and placed upon the order of the day for March 12th, the motion that the Bill do pass having carried.

H. B. No. 16, by Mr. Robertson, entitled "An Act relating to the criminal jurisdiction of District Magistrates and amending Section 1 of Act 40 of the Laws of 1896 and Section 11 of Chap ter LVII of the Laws of 1892." On motion of Mr. Robertson, the Bill was referred to the Committee on Judiciary.

H. B. No. 17, by Mr. Robertson, entitled "An Act relating to practice in criminal cases and amending Sections 1, 2, 3 and 4 of Chapter XL of the Session Laws of 1876." On motion of Mr. Robertson, the Bill was referred to the Committee on Judiciary.

H. B. No. 18, by Mr. Robertson, entitled "An Act to amend Section 2 of Chapter 1 of the Penal Code, defining felonies and misdemeanors." Mr. Robertson moved that the Bill be referred to the Committee on Judiciary. Carried.

H. B. No. 19, by Mr. Robertson, entitled "An Act relating to the sale of alcohol; amending Section 15, and repealing Sections 10, 13 and 14 of Act 64 of the Session Laws of 1896." Mr. Robertson moved that the Bill be referred to the Committee on Judiciary. Carried.

H. B. No. 22, by Mr. Hihio, entitled "An Act to provide that eight hours shall constitute a legal day's work, either mechanical or industrial." Mr. Robertson moved that the Bill be referred to the Committee on Judiciary. Carried.

H. B. No. 24, by Mr. Dickey, entitled "An Act empowering District Magistrates to issue commissions to take testimony." Mr. Dickey moved that the Bill be referred to the Committee «n Judiciary. Carried.

H. B. No. 25, by Mr. Dickey, entitled "An Act providing for judgments by default in suits upon contracts before District Magistrates." Mr. Dickey moved that the Bill be referred to the Committee on Judiciary. Carried.

H. B. No. 26, by Mr. Dickey, entitled "An Act to repeal Section 1 of Chapter LVI of the Penal Code of 1869, and Chapter XXXVI of the Session Laws of 1890, relating to the desertion of husband or wife." Mr. Robertson moved that the Bill be referred to the Committee on Miscellany. Carried,
