On motion of Mr. Dickey, seconded by Mr. Makekau, the Bill was ordered re-typewritten and placed on the order of the day for March 11th.

Mr. Prendergast, Chairman of the Committee on Enrollment, Revision and Printing, reported the following Bills printed and ready for distribution:

H. B. No. 16, by Mr. Robertson, entitled "An Act relating to the criminal jurisdiction of District Magistrates and amending Section 1 of Act 40 of the Laws of 1896 and Section 11 of Chapter LVII of the Laws of 1892.”

H. B. No. 17, by Mr. Robertson, entitled "An Act relating to practice in criminal cases and amending Sections 1, 2, 3 and 4 of Chapter XL of the Session Laws of 1876."

H. B. No. 18, by Mr. Robertson, entitled "An Act to amend Section 2 of Chapter I of the Penal Code, defining felonies and misdemeanors."

H. B. No. 19, by Mr. Robertson, entitled "An Act relating to the sale of alcohol; amending Section 15, and repealing Sections 10, 13 and 14 of Act 64 of the Session Laws of 1896."

BILLS ON THIRD READING.

The following Bill was taken up for consideration on its third reading:

H. B. No. 5, by Mr. Robertson, entitled "An Act to authorize the removal of persons under guardianship and the personal property of such persons out of this Territory." On motion of Mr. Ewaliko, the Bill was amended by striking out the words. "of the Circuit Court of the First Circuit" and inserting the word "Circuit" before the word "Judge" and after the word "any" in Section 1, line 1 thereof, and by striking out the words "of the Circuit Court of the First Circuit" and inserting the word "Circuit" before the word "Judge" and after the word "any" in Section 2, line 1 thereof. On motion of Mr. Dickey, the Bill was ordered re-typewritten and placed on the order of the day for March 11th.

On motion of Mr. Kekaula, the House thereupon adjourned.

The Journal of Proceedings of the preceding day was read and approved.

REPORTS OF STANDING COMMITTEES.

The following reports of Standing Committees were presented:

Mr. Emmeluth, Chairman of the Committee on Finance, presented a corrected report of the majority of the committee in connection with the II. M.. Dow claim, making a change in the total amount found, recommending that the claimant be reimbursed from $339.95 to $439.95. On motion of Mr. Mahoe, seconded by Mr. Robertson, the report was laid upon the table, to be considered with the minority report March 11th.

Mr. Makainai, Chairman of the Committee on Public Lands and Internal Improvements, presented a report on the Resolution offered by Mr. Kekaula, relating to appropriation of $250.00 for Hoopuloa Warehouse, recommending that the amount asked for be inserted in the Appropriation Bill. On motion of Mr. Dickey, consideration of the report was postponed, to be taken up with the Appropriation Bill.

RESOLUTIONS.

The following Resolutions were introduced:

H. R. No. 14, by Mr. Beckley, instructiing the Committee on Public Lands and Internal Improvements to wait upon the

Governor in relation to the matter of the absence of the Land Commissioner, as follows:

Whereas, J. F. Brown, Commissioner of Public Lands for this Territory, has for a long time been absent from his office; and,

Whereas, it is currently reported through the press and otherwise that he is in Washington, D. C., at the request and under the direction of the Governor, lobbying in Congress for the repeal of that clause in Section 55 of the Organic Act which provides: "That no corporation, domestic or foreign, shall acquire and hold real estate in Hawaii in excess of one thousand acres; and that all real estate acquired or held by such corporation or association contrary hereto shall be forfeited and escheat to the United States, but existing vested rights in real estate shall not be impaired"; and,

Whereas, it is all important to the best interests of the people of this Territory that said clause should not be repealed; therefore,

Be It Resolved by the House of Representatives of the Territory of Hawaii, that the Committee on Public Lands be and such Committee is hereby instructed to wait upon the Governor and ascertain the whereabouts of the said J. F. Brown, Commissioner, and the nature and the extent of the Governor's instructions to him.

Resolution adopted. On motion of Mr. Monsarrat, the said Committee was further instructed to ask if said Commissioner has been in receipt of his salary during his absence from this Territory, and also who is paying the expenses of his trip.

H. R. No. 15, by Mr. Beckley, asking the Superintendent of Public Works to forward certain information to the House within a week in regard to the sewerage system of Honolulu. Adopted. H. R. No. 16, by Mr. Kekaula, instructing the Sergeant-atArms to furnish each member with fifty two-cent stamps. Adopted.

H. R. No. 17, by Mr. Nailima, as follows:

Resolved, that the Governor is hereby requested to forthwith recall Mr. J. F. Brown, Agent of Public Lands, and that the Clerk is hereby instructed to forward a copy of this resolution to the Governor of the Territory.

On motion of Mr. Emmeluth, consideration of the resolution was postponed, to be taken up with the report of the Committee on Public Lands and Internal Improvements on H. R. No. 14.

H. R. No. 18, by Mr. Monsarrat, changing the hour of convening from 10 to 9 o'clock a. m. Mr. Kaniho moved to post

pone consideration of the resolution until March 11th. Lost. Mr. Makekau moved that the resolution be adopted and take effect from the date of its adoption. Carried.

H. R. No. 19, by Mr. Beckley, directing the Clerk to post up daily the Order of the Day in a prominent place within the Hall. Adopted.

On motion of Mr. Mahoe, the House thereupon adjourned.

The following Bills, notice of which had previously been given, were introduced, read by title, passed first reading, and were ordered printed:

H. B. No. 45, by Mr. Dickey, entitled "An Act to amend Chapter XLII of the Penal Code, entitled 'Keeping a disorderly house,' by adding two new sections thereto, relating to the landlords and owners of houses, buildings and premises wherein disorderly houses are kept."

H. B. No. 46, by Mr. Ewaliko, entitled “An Act to amend Section 812 of the Civil Laws, relating to carriage tax."

H. B. No. 47, by Mr. Makainai, entitled "An Act to amend Section 374 of the Civil Laws of 1897, relating to the maintenance of highways."

RESOLUTIONS.

The following Resolutions were introduced:

Mr. Makekau offered a Concurrent Resolution to rescind the rules and regulations and resolutions adopted by the Board of Health in force after the date of the first alleged Bubonic Plague case made its appearance in the City of Honolulu up to the present date. On motion of Mr. Paele, consideration of the Resolution was postponed, to be taken up with H. B. No. 20, by Mr. Paele, entitled "An Act to amend Sections 872 and 873 of the Penal Laws of 1897."

H. R. No. 19A, by Mr. Makekau, asking for an appropriation of $100,000.00 for roads, Hamakua, Hawaii. On motion of Mr. Robertson, the Resolution was referred to the Committee on Finance.

H. R. No. 20, by Mr. Monsarrat, asking information fron the Superintendent of Public Works relating to Pahala---Volcano House Road. On motion the Resolution was adopted.

H. R. No. 20A, by Mr. Dickey, instructing the Committee on Finance to ask the late Postmasters of the Republic of Hawaii, who had Hawaiian stamps in their possession when said Republic was dissolved, and which have not been redeemed, to send in sworn statements of the amounts due them, in order that the amount due them may be entered in the Appropriation Bill. Adopted.

BILLS ON SECOND READING.

Under a suspension of the Rules, the following Bills were taken up for consideration on their second reading:

H. B. No. 13, by Mr. Robertson, entitled "An Act to repeal certain obsolete laws," upon report from the Committee on Judiciary, recommending the passage of the Bill with the following amendments: In Section 1, line 3 thereof, before the word "Chapter" insert "Sections 2, 3, 4 and 5 of". On motion of Mr. Mahoe, the report was adopted. Whereupon the Bill was declared to have passed its second reading.
