By unanimous consent, leave of absence for the remainder of the day was then granted to Mr. Barksdale.

The said members were then severally arraigned and discharged on payment of fees.

On motion of Mr. Sherman, all further proceedings in the call were dispensed with.

Mr. Sherman moved that the House again resolve itself into the Committee of the Whole House on the state of the Union.

Pending which,

Mr. Sickles moved, at 10 o'clock and 35 minutes p. m., that the House adjourn; which motion was disagreed to.

The question then recurred on the motion of Mr. Sherman;
And being put, it was decided in the affirmative.

The House accordingly again resolved itself into the Committee of the Whole House on the state of the Union; and after some time spent therein, the Speaker resumed the chair, and Mr. Dawes reported that the Committee having, according to order, had the state of the Union generally under consideration, and particularly the bill of the House (H. R. 217) making appropriations for the construction, preservation and repairs of certain fortifications and other works of defence. for the year ending June 30, 1861, had found itself without a quorum, and that he had caused the roll to be called, when it appeared that the following named members were absent, viz:

On motion of Mr. Hickman, by unanimous consent,

Ordered, That the names of the members present at the call of the House be again called, in order to ascertain who of said members have absented themselves since the call of the roll.

The roll having been called pursuant to the said order, it appeared that the following members were so absent, viz: Messrs. Adrain, Horace F. Clark, H. Winter Davis, Gurley, De Witt C. Leach, Lee, Loomis, Reynolds, and Sherman.

Mr. Briggs moved, at 1 o'clock and 55 minutes a. m., that the House adjourn; which motion was disagreed to.

Mr. Maynard moved that all further proceedings in the call be dispensed with; which motion was disagreed to.

Mr. Florence moved, at 2 o'clock and 4 minutes a. m., that the House adjourn; which motion was disagreed to.

The Sergeant-at-arms again appeared at the bar, having in custody Mr. William Howard.

Mr. Howard having been arraigned, and, in response to the inquiry of the Speaker as to his excuse for absenting himself without the leave of the House, having proceeded to question the authority under which he was arrested and arraigned—

Mr. William A. Howard raised the point of order that it was only in order at this time for the member to submit an excuse for his absence; which point of order was sustained by the Chair, (Mr. Colfax.)

From this decision of the Chair Mr. Train appealed.

And the question being put, Shall the decision of the Chair stand as the judgment of the House?

It was decided in the affirmative.

So the decision of the Chair was sustained.

And then,

On motion of Mr. Hickman,

Ordered, That Mr. William Howard be discharged on the payment. of fees.

The Sergeant-at-arms again appeared at the bar, having in custody Mr. Hill, Mr. Stanton, Mr. James M. Leach, Mr. Vance, Mr. Love, Mr. John Cochrane, and Mr. Theaker.

Mr. Hill having been arraigned,

Ordered, That he be discharged on payment of fees.

Mr. Stanton was then arraigned, and while occupying the floor to render his excuse was called to order for not confining himself to the question of his excuse.

The Speaker pro tempore (Mr. Colfax) overruled the point of order.
From this decision of the Chair Mr. Hickman appealed.

Ordered, That the appeal be laid on the table.
