HAY, General Appraiser: The articles in question are made of one of the materials named in paragraph 95 and properly come under that paragraph, and the question we have to decide is whether or not the collector correctly assessed duty at 60 per cent, which is the rate applicable to decorated ware.

The articles in question are of a solid color and certain figures appear that are raised above the surface. The testimony shows that the articles were shaped on a potter's wheel and the figures were made by superadding a certain quantity of clay, and working thereon with a tool the figures as they appear upon the finished article. We think these facts bring the case fairly within the rule laid down by this Board in Collamore's case, G. A. 6820 (T. D. 29305), that the merchandise in question is otherwise decorated or ornamented within the meaning of that phrase as used in paragraph 95.
