III. The attention of Commanding Officers, and of the officers of the Adjutant General's Department, and Regimental Adjutants, is specially directed to the great importance of a prompt and full distribution of orders received from superior Headquarters. Orders, whether General or Special, are distributed from these Headquar ters, only to the Commanders of Divisions, detached Brigades or Districts, and to such Staff Officers as report direct to Department Headquarters. It is the duty of the independent commanders to see that all orders received by them are immediately distributed, in like manner; if General Orders, to all Commanders and Staff Officers who report direct to them; if Special Orders, to such of the commanderg and other officers concerned as report direct to them. Except in cases when the public exigency forbids delay, officers aud enlisted men receive orders only from their immediate commanders.

Regimental Commanders will see that all General Orders from these Headquarters are read at the next evening parade after their receipt.

Inspecting officers will pay special attention to this subject.

HEADQUARTERS, DEPARTMENT OF THE GULF,
New Orleans, August 12, 1863.

1. Before a General Court Martial convened at Carrollton, Louisiana, pursuant to General Orders No 24, of February 28th, 1863, from the Headquarters, 3d Division, Department of the Gulf, and of which Lieutenant Colonel JOHN A. FOSTER, 175th Regiment New York Volunteers, is President, was arraigned and tried:

Private Jacob A. Miller, Company E, 162d Regiment New York Volunteers.

CHARGE.
"Desertion."

SPECIFICATION—"In this, that he, Private Jacob A. Miller, Company E, 162d Regiment New York Infantry, having been duly enlisted in the service of and received pay from the United States, afterwards, to wit, on or about the 5th day of February, A. D. 1863, deserted said service. This at Camp Mansfield, Louisiana.” To which charge and specification the accused pleaded—“ Guilty.”

The Court, after mature deliberation, cor firms the plea of the accused, and does therefore sentence him "to suffer death, by being shot by musketry; two-thirds of the Court having concurred therein."

II. The proceedings, findings and sentence are approved by the Major General Commanding. Private Jacob A. Miller, Company E, 162 Regiment New York Volunteers, will accordingly be shot to death, with musketry, at a time and place to be hereafter designated.

GENERAL ORDERS

No. 61.

HEADQUARTERS, DEPARTMENT OF THE GULF,
New Orleans, August 17, 1863.

I. Corps Commanders have authority to accept resignations of officers and to discharge enlisted men.

II. The Commanders of Corps and separate Divisions may give leave of absence for seven days, in cases of necessity, not to go beyond the limits of this Department.

III. Corps Commanders may grant leaves of absence for twenty days, on surgeon's certificate, to go beyond the limits of this Department, to the officers of their commands, within the following limits:

At least one Colonel must be present with each Brigade.

At least one field officer must be present with each regiment.

At least one company officer must be present with each company.

Leaves of absence to go beyond the Department will not be granted by the Corps Commanders except on surgeon's certificate, approved by the Medical Director of the Corps, as required by General Orders No. 61, of 1862, from the War Department, Adjutant General's Office.

Applications for leave of absence, if forwarded to Department Headquarters, must invariably state the number of officers of each grade present for duty with the regiment, and if the applicant be a field officer, the number of field officers present for duty with the Brigade.

IV. Corps Commanders are authorized to approve furloughs for not exceeding sixty days to the enlisted men of their commands, provided that not more than four men shall be so absent from the same company at any one time. During the season of active operations, no furloughs shall be granted except on surgeon's certificate, approved by the Medical Director of the Corps.

V. Corps Commanders will transmit to these Headquarters, on the day succeeding their publication, copies of all General and Special Orders issued from their Headquarters.
