2-15. Public works and public utilities at aeronautic establishments. The Bureau of Yards and Docks shall have cognizance of the design and construction of public works and public utilities at aeronautic shore establishments, but all requirements in connection therewith shall be subject to the approval of the Bureau of Aeronautics. REPAIR, UPKEEP, AND OPERATION OF PUBLIC WORKS AND PUBLIC UTILITIES.

2-16. The duties of the Bureau of Yards and Docks shall comprise the design and construction of the public works and public utilities of the Navy and their repair, upkeep, and operation, except as otherwise prescribed in this chapter [Chapter 11, N. R.]. (N. R. 481-1.) (See also N. R. 486.)

2-17. General naval station care and maintenance. The Bureau of Yards and Docks shall provide watchmen and labor for cleaning naval stations, and for the protection of public property therein, except that at the naval ordnance establishments as designated in article 505 these duties shall be performed by the Bureau of Ordnance; at the Naval Academy, Naval War College, Naval Observatory, and naval training stations, they shall be performed by the Bureau of Navigation; at the engineering experiment station they shall be performed by the Bureau of Engineering; at fuel plants not at a navy yard or naval station by the Bureau of Supplies and Accounts; at the experimental model basin, navy yard, Washington, by the Bureau of Construction and Repair; at naval hospitals and medical supply depots they shall be performed by the Bureau of Medicine and Surgery; and at marine barracks they shall be performed by the Marine Corps. 2-18. Power plants. The Bureau of Yards and Docks shall have such control over the upkeep and operation of these [power] plants as may be necessary to enable it properly to safeguard expenditures under it and to insure that such plants are at all times kept up and operated in an efficient and economical manner. 484-10.)

2-19. Telephone plants; construction and maintenance. In case a telephone plant or any part thereof is to be Navy owned and maintained, the Bureau of Yards and Docks directs the construction and maintenance of such telephone plant, or Navy part thereof, in

the same manner as other public works and utilities, subject in the case of divided ownership to any contract provisions. (N. R. 424–2.)

2-20. Furniture for all public works. The furniture for all public works shall be provided and repaired by the Bureau of Yards and Docks, except where otherwise provided by law. (N. R. 491.)

2-21. Officers' quarters in Washington. In the cases of officers on duty in Washington, not attached to the navy yard, the Chief of the Bureau of Yards and Docks shall furnish the required certificate that application for and no assignment of quarters has been made. (N. R. 1821-5.)

EXCEPTIONS IN COGNIZANCE AT CERTAIN STATIONS.

2-22. At naval ordnance establishments as designated in article 505, repairs to public works and utilities within the capacity of the force employed, as well as their upkeep and operation, shall be under the cognizance of the Bureau of Ordnance. (N. R. 484-4.)

2-23. At hospitals and medical supply depots, repairs to public works and utilities within the capacity of the force employed, as well as their upkeep and operation, shall be under the cognizance of the Bureau of Medicine and Surgery. (N. R. 484-5.)

2-24. At naval training stations, the Naval Observatory, the Naval War College, and the Naval Academy repairs to public works and utilities within the capacity of the force employed, as well as their upkeep and operation, shall be under the cognizance of the Bureau of Navigation. (N. R. 484-6.)

2-25. At Marine barracks and Marine posts repairs to public works and utilities within the capacity of the force employed, as well as their upkeep and operation, shall be under the cognizance of the Marine Corps. (N. R. 484-7.)

2-26. At radio stations and the engineering experiment station repairs to public works and utilities within the capacity of the force employed, as well as their upkeep and operation, shall be under the cognizance of the Bureau of Engineering. (N. R. 484-8.)

2-27. Fueling plants. The upkeep and operation of all fueling plants not at a navy yard shall be under the cognizance of the Bureau of Supplies and Accounts. (N. R. 484-12.)

2-28. Dry docks. The Bureau of Construction and Repair shall have charge * * *: of the operating and cleaning of dry docks. (N. R. 519-3.)

2-29. Aeronautic establishments. Repairs of public works and public utilities at aeronautic shore establishments within the capacity of the force employed, as well as their upkeep and operation, shall be under the cognizance of the Bureau of Aeronautics. (G. O. 65-13.)

PREPARATION OF ESTIMATES FOR PUBLIC WORKS AND PUBLIC UTILITIES.

2-30. Departmental budget office. The budget act approved June 10, 1921, provides a departmental budget office as follows:

SEC. 214. (a) The head of each department and establishment shall designate an official thereof as budget officer therefor, who, in each year under his direction and on or before a date fixed by him, shall prepare the departmental estimates.

(b) Such budget officer shall also prepare, under the direction of the head of the department or establishment, such supplemental and deficiency estimates as may be required for its work.

SEC. 215. The head of each department and establishment shall revise the departmental estimates and submit them to the Bureau [of the Budget] on or before September 15 of each year.

2-31. Provisions of the Navy Regulations as to estimates. The procedure in submitting estimates is in accordance with the Navy Regulations quoted below where these are in harmony with the budget law.

2-32. Estimates for public works and public utilities to be prepared by bureau. In general, and unless the Secretary of the Navy shall direct to the contrary in specific cases, all formal estimates for appropriations for public works and public utilities shall be prepared by the Bureau of Yards and Docks and be submitted to the Assistant Secretary of the Navy. When any other bureau or office desires the construction of any public work or public utility it shall so report to the Secretary of the Navy, who will, in his discretion, direct the Bureau of Yards and Docks to prepare the necessary estimates, in consultation with the chief of the bureau or office concerned, and submit them to him for further action. 2-33. Current appropriation act governs. When the current appropriation act provides funds for any of the purposes mentioned in this section [Articles 482-492, inclusive, N. R.] under other bureaus or offices than those set forth herein, the provisions of such appropriation act shall govern. (N. R. 494–1.)

2-34. Future estimates to follow provisions herein. in every case in which the condition described in the preceding paragraph exists, however, future estimates shall be prepared (in accordance with the legal forms and methods applying to such cases) in such a manner that subsequent appropriation acts, if accepted by Congress in the form in which submitted, will enable the provisions of this section to be fully complied with. REAL ESTATE: ACQUISITION, CUSTODY, LAND SURVEYS, RECORDS, DISPOSITION.

2-35. Abstract of bureau duties with respect to real estate. The procedure to be followed by various bureaus and offices of the Navy Department regarding the acquisition and disposition of real estate is set forth in detail in articles 426 and 427 of the Navy Regulations; the duties of the Bureau of Yards and Docks have been extracted therefrom and are given hereinbelow in tabular form. With respect to all real estate owned, leased, or occupied for naval purposes, the bureau's duties comprise:

(a) Advisory consultation in the selection of new sites.

(b) Preparation of estimates for all purchases of property; renewals of leases.

(c) Making of all land surveys and preservation of records thereof. (d) Maintenance of corrected lists of all real estate and records of fixed improvements thereon.

(e) Custody and care of all properties vacated and no longer required for original purposes, and recommendation as to their disposition.

(f) Preparation of data for canvass to ascertain whether other Government departments require vacated properties.

(g) Decision as to the method of disposing of fixed improvements and surplus removable property prior to relinquishment of title to land.

GENERAL DUTIES AND PROCEDURE COMMON TO ALL BUREAUS; DEPARTMENTAL RELATIONS.

2-36. Custody of records and accounts. The several bureaus. shall retain the charge and custody of the books of records and accounts pertaining to their respective duties (N. R. 393-2.)

2-38. Procurement and custody of public property. Each bureau shall determine upon and require for or have manufactured all material, apparatus, tools, stores, fuel, transportation, stationery, blank books, forms, and appliances of every kind needed for its own use in carrying out its duties, as hereinafter defined. Each bureau shall be charged with the preservation of the public property under its cognizance. (N. R. 393-8.)

2-39. All work done by one bureau for another bureau, including the construction, alteration, and repair of public works, shall be done by the former after approval by, and to the satisfaction of, the latter; and such work shall at all times be open to the inspection of the bureau for which it is done. (N. R. 393-10.)

2-40. Each bureau shall inspect all material for its use, except at navy yards, where inspection shall be made as provided for in article 1612. Controversial questions as to the acceptance of manufactured or purchased articles shall be referred to the bureau having cognizance. (N. R. 393-11.)

2-41. Bureaus to defray own costs. Each bureau shall estimate for and defray from its own funds the cost necessary to carry out its duties as hereinafter defined. (N. R. 393-12.)

2-42. Recommendations for assignment of officers. Each bureau shall make recommendations for assignment of officers to duty under its cognizance. (N. R. 393–13.)

2-43. Extraneous activities forbidden. No bureau or office. under the jurisdiction of the Navy Department shall issue any orders or directions except in connection with duties specifically prescribed for it by law, regulation, or general order, and in order to prevent duplication of work no bureau or office shall create or maintain any office, section, or division occupied on matters other than those for which specific authorization to issue orders is granted such bureau or office. 2-44. Communications with Congress. No bureau, office, or division chief, or subordinate in the Navy Department, and no officer of the Navy or Marine Corps shall apply to either House of Congress, or to any committee of either House of Congress, or to any Member of Congress, for legislation, or for appropriations, or for congressional action of any kind, except with the consent and knowledge of the Secretary of the Navy; nor shall any such person respond to any
