1 title, the record of hearings before the Commission and all 2 papers filed in connection with such hearings shall be confi3 dential; but the filing of an application for a writ of certiorari 4 to the Supreme Court of the United States, as provided in 5 section 1259 of this title, shall render public the record of 6 hearings before the Commission and before the Conference 7 and all papers filed in connection therewith to the extent 8 that such record or such papers are required for the disposi9 tion of such application and for the conduct of any sub10 sequent proceedings.

11 "8383. Disqualification

12 "A judge who is a member of the Commission or the 13 Judicial Conference of the United States shall not serve as a 14 member of such body in any proceedings when it inquires 15 into his own conduct or physical or mental condition or 16 claim. No judge of the same court as the judge whose con17 duct or physical or mental condition or claim is the subject 18 of any inquiry by the Commission or the Conference shall 19 participate in such inquiry or in the determination by such 20 body thereof. In the event that a Commission member is dis21 qualified under this subsection, the Chief Justice shall assign 22 a substitute judge to the Commission, to serve only in the 23 matter which caused this assignment.

24 "§ 384. Powers of the Commission and the Judicial Conference

"(a) In the conduct of investigations and hearings under

1 sections 378-381 of this title, the Commission and the Judi2 cial Conference of the United States may administer oaths, 3 order and otherwise provide for the inspection of books and 4 records, and issue subpenas for the attendance of witnesses 5 and the production of papers, books, accounts, documents, 6 and testimony relevant to any such investigation or pro7 ceeding.

8 "(b) No person shall be excused from attending and 9 testifying or from producing books, papers, and other records 10 and documents before the Commission or the Conference on 11 the ground that the testimony or evidence, documentary or 12 otherwise, required of him may tend to incriminate him or 13 subject him to a penalty or forfeiture; but no individual shall 14 be prosecuted or subject to any penalty or forfeiture for or on 15 account of any transaction, matter, or thing concerning which 16 he is compelled, after having claimed his privilege against 17 self-incrimination, to testify or produce evidence, documen18 tary or otherwise, except that such individual so testifying 19 shall not be exempt from prosecution and punishment for 20 perjury committed in so testifying.

21 "§ 385. Enforcement

22 "If any person refuses to attend, testify, or produce any 23 writings or things required by a subpena issued by the Com24 mission or the Judicial Conference of the United States the

1 issuing body may petition the district court for the district 2 in which such person may be found for an order compelling 3 such person to attend and testify or produce the writings or

things required by the subpena. The court shall order such 5 person to appear before it at a specified time and place and 6 then and there shall consider why he has not attended or testified or produced the writings or things as required. A

of the order shall be served upon him. If it appears to

the court that the subpena was regularly issued, the court 10 shall order such person to appear before the issuing body

at the time and place fixed in the order and to testify or to

produce the required writings or things. Upon failure to obey the order, such person shall be dealt with as for

contempt of court.

❝g 386. Depositions

"In pending investigations or proceedings before them, the Commission and the Judicial Conference of the United

States may order the deposition of any person to be taken in such form and subject to such limitation as may be prescribed in the order. The Commission or the Conference

may file in the district court for the district in which such

investigation or proceeding is pending a petition entitled "In

the Matter of Proceedings of the Commission on Judicial

Disability and Tenure (or Judicial Conference of the United

States) Numbered", stating generally, without identify

1 ing the judge, the nature of the pending matter, the name 2 and residence of the person whose testimony is desired, and 3 directions, if any, of the Commission or the Conference, 4 asking that an order be made requiring such person to ap5 pear and testify before a designated officer. Upon the filing 6 of the petition, the court may make an order requiring such 7 person to appear and testify. A subpena for such depositions 8 shall be issued by the clerk and the depositions shall be 9 taken and returned in the manner prescribed by law in civil 10 actions.

11 "8 387. Fees and mileage of witnesses

"Each witness, other than an officer or employee of the

13 United States, shall receive for his attendance the same fees, 14 and all witnesses shall receive the same mileage, allowed 15 by law to a witness in civil cases as provided in section 1821 16 of this title. The amount shall be paid by the Administrative 17 Office of the United States Courts from funds appropriated 18 for the judiciary.

19 "§ 388. Duty of marshals to serve process and execute orders 20 "It shall be the duty of the United States marshals, 21 upon request of the Commission or the Judicial Conference 22 of the United States, to serve process and to execute all law23 ful orders of the Commission or Conference.

24 "8 389. Commission and Conference staffs

"(a) The Commission shall have a permanent staff of 26 attorneys, and clerical and secretarial assistants.

"(b) The Commission and the Judicial Conference of

2 the United States may employ on a temporary basis such 3 counsel, assistants, and other employees as are necessary for 4 the performance of the duties and exercise of the powers 5 conferred upon them. The Commission and the Conference 6 may arrange for and compensate medical and other ex7 perts and reporters, and arrange for the attendance of wit8 nesses, including witnesses not subject to subpena. 9 "(c) The Director of the Administrative Office of the 10 United States Courts may pay from funds available to the 11 judiciary all expenses reasonably necessary for effectuating 12 the purposes of sections 377-381 of this title, whether or not 13 specifically enumerated herein.".

14 (b) The analysis of chapter 17 of title 28, United States 15 Code, is amended by adding at the end thereof the following 16 new items:

"379. Duties and powers of the Judicial Conference.

"380. Disability of a judge.

"381. Claim of a judge.

"382. Confidentiality of proceedings.

"387. Fees and mileage of witnesses.

"388. Duty of marshals to serve process and execute orders.

"389. Commission and Conference staffs.".

(c) Section 451 of title 28, United States Code, is

18 amended by adding at the end thereof the following new

19 definition:
