AN ACT

To convey to Emily Elliott certain real estate.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Joseph B. Ard, surviving trustee in a deed of trust executed by Ann Johnston to Elias W. Hale, and the said Joseph B. Ard, in trust for the use of Emily Elliott, wife of William P. Elliott, and recorded in Mifflin county, book R, page two hundred and seventy-four, be and is hereby authorized and empowered, upon the request of Emily Elliott, duly executed in writing and acknowledged before the president judge of the court of common pleas of Mifflin county, to convey to said Emily Elliott, the real estate held under said deed of trust in accordance with the provivions of the third section of the act of assembly, passed the twenty-second day of April, Anno Domini, one thousand eight hundred and forty-six ; also all notes, bonds, or evidences of debt, held by him as trustee of said Emily Elliott, to be held by the said Emily Elliott, under the provisions of the act of Assembly to secure the rights of married women, passed the eleventh day of April, Anno Domini, one thousand eight hundred and forty-eight.

AN ACT

To extend the limits of the district of Richmond, in the county of Philadelphia.

Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That so much of the township of the unincorporated Northern Liberties, as is contained within the boundaries-beginning at the river Delaware, and the northerly side of Tioga street; thence along the said river to a point at the distance of three hundred and fifty-feet north of Pike street, continued according to the plan of the survey of the unincorporated Northern Liberties; thence along a line at the said distance of three hundred and fifty feet north of Pike street, and parallel therewith, to the eastwardly side of Salmon street; thence along the same to the northwardly side of Westmoreland street; thence along the same to the eastwardly side of the Point road; thence along the same to the northwardly side of said 'l'ioga street, and thence along the same to the place of beginning, shall be added and become included in the corporation of the commissioners and inhabitants of Richmond, in the county of Philadelphia, and from henceforth shall be entitled to all the privileges and immunities contained in the act of incorporation of the said district of Richmond, and of any supplement thereto.

AN ACT

Authorizing the Lutheran congregations of Dauphin and Northumberland counties to sell real estate.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That J. George West, Henry Metz, John Miller, Jacob Clock, John Sny- Trustees. der, William Zartman, Michael Lenker and John Noblet, the present

Proviso.

trustees of the eight united congregations of Lutheran churches in the
counties of Dauphin and Northumberland, and their successors in office,
are hereby authorized and empowered to sell, either at public or private
sale, and to convey, in fee simple, and to make and execute to the
purchaser or purchasers thereof, a good and sufficient conveyance and
assurance in law, a certain tract of land, with all its appurtenances, in
the township of Washington, and county of Dauphin, known as a par-
sonage for the said united congregation; and the proceeds of the sale,
the said trustees, after the payment of the costs of sale, if any, shall
divide equally to and among each of the said congregations of Lutheran
churches in Dauphin and Northumberland counties, respectively, ac-
cording to the respective shares of said congregations: Provided, That
before such sale, the said trustees shall execute and file in the office of
the prothonotary of Dauphin county, a bond to the commonwealth,
with such security as the court of common pleas of said county shall
approve, conditioned for the faithful distribution and application of the
moneys arising from said sale, to the congregations entitled to the same.

AN ACT

To vacate part of an alley in the city of Lancaster.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the select and common councils of the city of Lancaster, are hereby authorized and directed to vacate or cause to be vacated, such part of the public alley in said city, parallel with and between East King and Orange streets, and east of Ann street, westward from the termination of the alley, at the road passing along the west end of the reservoir, from East King to Orange streets aforesaid, as the erection of the new prison by the county of Lancaster may require, and as the said councils may by ordinance or resolution specify in distance, and accordingly mark off on the ground.

AN ACT

To divide the Fifth ward, in the district of Southwark, in the county of Philadelphia, into two wards.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, the ward, known as "Fifth ward," Fifth ward in the in the district of Southwark, and county of Philadelphia, shall be divi- district of Southded into two wards, to be bounded as follows, viz: all that portion of wark, in the county of Philathe said ward, bounded on the south by the southern boundary of the delphia, divided district of Southwark, on the east by the Delaware river, on the north into two wards. by Washington street, and on the west by Third street, to its junction Boundaries. with Moyamensing road, and thence by said road to the southern boundary of the district, shall be called Fifth ward; and the remainder of said ward, bounded on the south by the southern boundary of the said district of Southwark, on the east by Moyamensing road and Third street, on the north by Washington street, and on the west by Passyunk road, shall be called Sixth ward; and the qualified electors residing within the above described wards, shall, at all general and special elections, vote at windows in the commissioners' hall, in the district of Southwark, to be provided and designated by the commissioners of the county of Philadelphia, according to law; each window to be distinguished by having the name of the ward for which it is used placed conspicuously upon it.

SECTION 2. The present commissioners, constable, alderman, judge, Officers of Fifth inspectors, and other ward officers of Fifth ward, shall continue to act ward. as officers of Fifth ward, until the expiration of their terms of office respectively, when others shall be elected to supply their places in the manner provided by law, for the election of similar officers in the other wards of the district of Southwark; they shall also continue to act as

officers of the Sixth ward, until the citizens of said ward shall have Officers of Sixth elected officers to supply their places, in the manner hereinafter pro- ward. vided.

SECTION 3. On the third Friday in March next, and on the third Meetings of qualiFriday in March in every year thereafter, the qualified citizens in fied citizens. Sixth ward aforesaid, shall meet at the place hereinafter designated, and then and there between the hours now fixed by law for the holding of ward elections in the other wards of the district of Southwark, and in the manner prescribed by law, choose one assessor, (and at the proper time two assistant assessors,) one constable, one judge, and two inspectors, of the elections for said ward.

SECTION 4. On the third Friday in March next, the qualified citizens of Sixth ward aforesaid shall, at the time and place of electing ward officers, elect three of the qualified citizens of said ward, to serve as commissioners of the district of Southwark, one of whom shall serve for one year, one for two years, and one for three years: any vacancy occasioned by the death, resignation, removal, or expiration of the term of office of said commissioners, or otherwise, shall be filled in the manner provided by law for similar cases in the other wards of the district

of Southwark; and at the first election the qualified electors of said ward shall designate on their tickets the terms of office for which each commissioner shall be elected respectively.

SECTION 5. On the third Friday in March next, and whenever required by law thereafter, the qualified citizens of Sixth ward shall, at the time and place of holding ward elections, elect one of the qualified citizens of said ward to serve as alderman thereof.

SECTION 6. Until otherwise ordered, the ward elections for Fifth Ward elections, ward shall be held at the house now occupied by Charles Boswell, corner of Moyamensing road and Federal street; and the ward elections for Sixth ward shall be held at the house of Henry D. Cozens, corner of Eighth and Federal streets, for the present year eighteen hundred and forty-nine, after which they shall be held at the house about to be erected at the south-west corner of Fifth and Wharton streets; and the electors of said wards shall be entitled to change the place of holding their elections in the manner now provided for by the fifty-sixth section of the act of July second, one thousand eight hundred and thirtynine.

SECTION 7. For the purpose of conducting the first ward election for Sixth ward, held under the provisions of this act, the judge and inspectors chosen at the last spring election in Fifth ward, or their successors appointed according to law, shall select and appoint as follows, viz: the judge of Fifth ward shall appoint a qualified citizen of Sixth ward to act as judge of the said election in Sixth ward; and each of the inspectors of Fifth ward shall appoint a duly qualified citizen of Sixth ward to act as inspector therein; and in case of any vacancy in said election board for Sixth ward, the same shall be filled by another appointment, on the part of the judge or inspector who made the original appointment: the said judge and inspector shall take the same oaths or affirmations, have the same powers, and perform the same duties, as are now required by law of judges and inspectors.

SECTION 8. The several officers elected or appointed under the provisions of this act, shall have the same power and authority, perform the same duties, and receive the same pay, as similar officers in the other wards of the district of Southwark do now by law receive.

SECTION 9. It shall be the duty of the commissioners of the county Duties of county of Philadelphia, to furnish to the judges and inspectors, chosen under the provisions of this act, the same ballot boxes, blank forms, list of taxables, and other matters as are now furnished to judges and inspectors of elections within said county: it shall also be the duty of the said commissioners to divide the duplicates of state and county taxes in Fifth ward, Southwark, for the year one thousand eight hundred and forty-nine, into two distinct and separate duplicates, one of which shall be composed of the taxes upon the property included in the limits herein designated as "Fifth ward," and the other of the taxes upon the property within the limits herein designated as "Sixth ward."

SECTION 10. The present assessor of Fifth ward shall return to the commissioners of Philadelphia county, the names of two persons, citizens of Fifth ward, and two persons, citizens of Sixth ward, as proper Collector of taxes persons to receive the appointments of collectors of state and county taxes in said wards, for the year one thousand eight hundred and fortynine.

SECTION 11. All laws and parts of laws, inconsistent with the provisions of this act, are hereby repealed: Provided, That nothing herein contained shall be deemed and taken to alter, or in any manner interfere with the limits of the congressional district, as established by the
