SECTION 7. That the directors of common schools of the borough of Newville, Cumberland county, be and they are hereby authorized to assess and collect [in the usual way.] on each and every dog owned or harbored by any citizen of said borough, the sum of fifty cents, and for each and every bitch owned and harbored as aforesaid, the sum of one dollar, for the use of the aforesaid school district.

SECTION 8. That the district of Spring Garden, in the county of Philadelphia, shall hereafter be entitled to six additional directors of public schools, making the whole number twenty-one.

SECTION 9. That the additional directors authorized by this act, shall be elected before the first day of June, the present year, in the same manner now provided for by law in the several districts.

SECTION 10. That hereafter all candidates for school directors to be ballotted for by the board of commissioners of Spring Garden, shall be placed on nomination at the previous stated meeting of the board of commissioners of said district, and all nominees and all directors of said sectional board, shall be residents of the said section.

SECTION 11. And the said directors elected in the year one thousand eight hundred and forty-nine, in the fourth section, shall meet at the usual place of meeting on the first Monday after their election, and board of commis- divide themselves by lot into three classes; the seats of the first class shall be vacated at the expiration of the first year, the seats of the second class shall be vacated at the expiration of the second year, and the seats of the third class shall be vacated at the expiration of the third year; and annually thereafter the commissioners of said district shall elect one third of the whole number of directors of said section, to serve a term of three years.

SECTION 12. That the directors of public schools of the fourth section of the first school district, shall meet on the first Monday in July, in each and every year, and elect viva voce three controllers of the public schools for the city and county of Philadelphia, in the same manner as controllers are now elected by law; and so much of any previous act as is hereby altered or supplied, be and the same is hereby repealed.

SECTION 13. That Thomas Urie Chambers, of the county of Cumberland, be and he is hereby authorized to change his name; and his name is hereby changed to that of Thomas Davidson Urie, by which name he shall hereafter be called and known, and by that name he shall be capable to sue, and may be sued, grant, receive and inherit property, and to do all other legal acts and things, as fully and effectually to all intents and purposes, as he could have done under his former name if no change had been made therein.

SECTION 14. That the commissioners of the county of Warren, shall examine the situation and condition of the bridge over the Kinsua creek, near the mouth of said creek, and if in their opinion it would be too burdensome for the township of Kinsua to re-construct said bridge in a proper and permanent manner, it shall be the duty of said commissioners to re-construct the same, or to appropriate so much money for that purpose as in their judgment will bring it within the means of said township to erect said bridge: Provided, That after said bridge shall have been completed, it shall not be considered a county bridge, but shall be kept in repair by the township of Kinsua.

SECTION 15. That the qualified voters of the borough of Rochester, in the county of Beaver, are hereby authorized to elect in the manner directed by the act incorporating said borough, approved the twentieth day of March, one thousand eight hundred and forty-nine, all the officers to which the said borough is entitled by virtue of said act, on the

fifteenth day of May next; anything in said act of incorporation to the contrary notwithstanding.

AN ACT

Authorizing the laying out of a state road on the south side of the West Branch of the Susquehanna, from the bridge at Williamsport to Lock Haven.

Location.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Hezekiah B. Packer and Robert Faries, of Lycoming county, and Commissioners. George Crawford, of Clinton county, be and they are hereby appointed commissioners to view and lay out a road on the south side of the West Branch of the Susquehanna, from the southern end of the bridge at Williamsport, Lycoming county, to Lock Haven, in Clinton county. SECTION 2. That it shall be the duty of the said board of commissioners, or a majority of them, after taking and subscribing an oath or affirmation before a justice of the peace to perform the duties enjoined on them by this act with fidelity and impartiality, to carefully view the ground over which the said road may pass, and lay out the same as near to a straight line, from point to point, as the nature of the ground and other circumstances will permit, so that the vertical departure from a horizontal line shall at no place exceed five degrees, excepting only at the crossing of ravines and streams where, by moderate filling or bridging, the declination of the said road may be preserved within that limit.

SECTION 3. respectively noting thereon courses and distances as they occur, the improvements passed through, and also the crossing of township lines, roads and waters, with such other matters as may serve for explanation, one copy whereof to be deposited in the office of the secretary of the commonwealth on or before the first day of January next, and one copy in the offices of the clerks of the courts of quarter sessions of the respective counties in which the said road may be laid out, on the day aforesaid, or as much sooner as practicable; and said road shall to all intents and purposes be a public highway, and shall be opened to the breadth and repaired in all respects as roads are opened and repaired which are laid out by order of the courts aforesaid.

SECTION 5. That the accounts of the said commissioners, for their own pay and the pay of the chain carriers and axeman, shall be made out and returned to the commissioners of the county in which said road may be laid out, in proportion to the time spent in the said county in locating said road, and they shall be paid out of the treasury of each of the respective counties, on warrants drawn in the usual way.

SECTION 6. That the said commissioners shall meet on or before the

Time of meeting first day of August, at such place as a majority of them shall agree upon, and complete the location of said road as soon as practicable; and if any vacancy shall happen by resignation or any other cause, the court of quarter sessions of Lycoming county is hereby authorized to supply such vacancy or vacancies by a suitable appointment; and in the event of a difference of opinion, a majority of the commissioners shall determine, and report of such majority shall be conclusive and as available as if made by all of them.

telegraph lines and communications from the point where the Susque- Location of telehanna river intersects the boundary line between the state of Pennsyl- graph lines. vania and Maryland, along the said Susquehanna river, and along the Pennsylvania canal, through or into the counties of York, Lancaster, Dauphin, Perry, Juniata, Union and other adjacent counties or any of them, to the junction of the North and West Branches of the said river; and along the North Branch canal, through or into the counties of Northumberland, Columbia and Luzerne, to Pittston; thence along the contemplated line of continuation of the said North Branch canal, through or into the counties of Wyoming, Bradford and other adjacent counties, to the point where the contemplated canal is intended to intersect the boundary line between the state of Pennsylvania and New York; and from the said junction along the West Branch of the said Susquehanna river, and along the Pennsylvania canal, through or into the counties of Northumberland, Union, Lycoming, Clinton, Centre, Clearfield, Jefferson, Clarion, Venango, Mercer, Crawford and Erie, to the town of Erie, with branches into or through the counties of Susquehanna, Wayne, Pike, Tioga, Potter, M'Kean, Warren, Forest, Elk, Butler, Armstrong and other adjacent counties, or any of them, and intermediate towns and villages; and with power to purchase, make, use and maintain any connecting or side lines, which are now or hereafter shall be within the aforesaid counties or any of them, by the said name, style and title of The Susquehanna River and North and West Branch telegraph company;" and by the said name, style and title, shall have all the powers, rights, privileges and immunities, and be sub- Privileges. ject to all the restrictions and provisions contained in an act, entitled

The persons named in the first section of this act, or any four of them, shall call a meeting, to be held on the third Tuesday of September next, or at any time previous, of the corporate body hereby created, giving three weeks' notice of the time and place of holding the same, in at least one newspaper published in the city of Philadelphia, and one in each of the boroughs of Columbia, York, Harrisburg, Northumberland, Berwick, Wilkesbarre, Pittston, Tunkhannock, Towanda, Williamsport, Lock Haven, Bellfonte, Clearfield, Brookville, Clarion, Franklin, Meadville and Erie, for the purpose of choosing a president, secretary, treasurer and directors, not exceeding one for each Board of direc- county, in which the line may be established, which directors, with the president, shall constitute the board of directors for the management of the affairs of the company: Provided, That the annual and other meetings of the corporation shall be held at such time and place as may be prescribed by the by-laws.

Relative to the destruction of wolves, panthers and other wild animals in the county of Franklin; relative to the destruction of fish in certain streams in said county; relative to fox and wolf scalps in Dauphin county; to extend certain auction laws to Washington county; to enable Charles Oliver Logan and William Logan, to sell certain real estate; to legalize an election held by the supervisors of White Deer township, Union county; and fixing the places of holding elections in Kidder and Penn Forest townships, Carbon county.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the first section of an act, entitled "An Act to encourage the destruetion of wolves, panthers and other wild animals in Franklin, Cumberland, Bedford and Indiana counties, and for other purposes," passed the thirty-first day of March, Anno Domini, one thousand eight hundred and forty-one, be and the same is hereby repealed, so far as relates to the county of Franklin.
