No. 37. AN ACT Erecting the township of Cass, in the county of Schuylkill, into a separate election district. SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the township of Cass, in the county of Schuylkill, is hereby erected into a separate election district; and the qualified voters thereof shall hereafter hold their general and township elections at the house of Abraham Hock, in said township; and that John Kelly is hereby appointed judge, and Andrew Patton and Martin Kaercher inspectors, to hold the township elections in said township, for the year one thousand eight hundred and forty-nine. A SUPPLEMENT To an act, entitled "An Act to incorporate the Lykens Valley coal company in SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Enlarge capital it shall be lawful for the president and directors of the Lykens Valley coal company in Dauphin county, Pennsylvania, at any time when they may deem the same expedient, to enlarge the capital stock of the said company, by the sale of any number not exceeding eight thousand shares, at their par value of fifty dollars each share, in addition to the stock the said company are now entitled to hold; and it shall also be lawful for them, at any time they may deem the same expedient, to convert the bonds of the said company, issued by virtue, and under SECTION 2. That the said corporation shall have the right to hold, May hold, possess possess and enjoy, not exceeding three thousand acres of land; and and enjoy lands. that the charter of said corporation is hereby extended for a period of Charter extended twenty years, from the time the same shall expire by the ninth section of the act incorporating said company, approved the third day of June, one thousand eight hundred and thirty-six. AN ACT Entitled "An Act to authorize the commissioners of Huntingdon county to borrow money. SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the commissioners of Huntingdon county be and are hereby authorized to borrow, on the credit of said county, any sum not exceeding twelve thousand dollars, at a rate of interest not exceeding six per cent. per annum, payable in eighteen hundred and fifty-six, or sooner, at the pleasure of said commissioners; said money to be appropriated, at once, to the payment of the debts of the said county. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the treasurer of Westmoreland county, be and he is hereby authorized and required to refund to Robert Anderson, the sum of twenty-five dollars, paid by him to the said treasurer, for a license to hawk and peddle, on the twenty-first of February, one thousand eight hundred and fortyeight; said money having been paid by mistake. A SUPPLEMENT To the act of fifteenth April, one thousand eight hundred and forty-five, and the act of twenty-third January, one thousand eight hundred and forty-six, authorizing the erection of a poor house in Somerset county. SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same. That the act, entitled " An Act to provide for the erection of a house for Certain act dethe employment and support of the poor of the county of Somerset, clared valid, &c. and for other purposes, approved fifteenth April, one thousand eight hundred and forty-five, and the supplement thereto, approved twentythird January, one thousand eight hundred and forty-six, be and the same are hereby declared to be legal and valid; and that all contracts made, and all official acts performed, in pursuance of said acts, shall have the force and effect intended to have been given to them by virtue thereof. idiots, lunatics, &c. SECTION 2. That the directors of the poor house in said county, be Directors of poor hereby authorized and required to make suitable provisions for the re- house to make ception and maintenance of all idiots, lunatics or insane persons within provisions for the said county, who have been heretofore, or may be hereafter acquitted maintenance of of any crime or misdemeanor, on the ground of their idiocy or insanity, agreeably to the provisions of the fifty-eighth section of the act of thirteenth June, one thousand eight hundred and thirty-six, relating to lunatics and habitual drunkards; and that the judges of the courts of general quarter sessions and oyer and terminer of said county, are hereby authorized and directed to order any such lunatic, now in the jail of said county, acquitted on the ground of insanity, as aforesaid, and all such persons hereafter so acquitted, into the charge and custody of said directors, to be supported at the expense of the county, notwithstanding the provisions of the sixty-first section of said. act of thirteenth June, one thousand eight hundred and thirty-six : Provided, That the said judges shall be satisfied that said idiots or Proviso. lunatics can be restrained, in said poor house, from the commission of any further crimes or offences: And provided further, That the rela- Proviso. tives of such idiots and insane persons, mentioned in the twenty-eighth section of the act of thirteenth June, one thousand eight hundred and thirty-six, entitled "An Act relating to the support and employment of the poor," shall not be absolved from the duties and liabilities therein named. No. 42. AN ACT To view and lay out a state road from Carmichaelstown, in Greene county, to SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Commissioners. Boas Boydson, of Greene county, and George Whiting and Stephen W. Snyder, of Fayette county, be and the same are hereby appointed commissioners to view and lay out, and mark a state road, beginning at or near Carmichaelstown, Greene county, and leading to M'Clellandtown, Fayette county, by the easiest and most practicable route, having reference to distance of the route, surface of the country, and cost of construction. That it shall be the duty of said commissioners, or a majority of them, after having been duly sworn or affirmed before a justice of the peace, who shall file and preserve the same in his office, to perform all the duties enjoined by this act with impartiality, carefully to view the ground over which the road to be laid out by them may pass, having due regard to a straight and easy road for the public, at an elevation of not more than five degrees from a horizontal line; and that they shall clearly and distinctly mark the road in such a manner, as shall render the route agreed upon readily found by the supervisors; and for fulfilling the duties enjoined by this act, the commissioners shall be allowed the sum of one dollar and fifty cents per day, for every day they shall be necessarily employed in performing the duties assigned by this act; and the said commissioners are hereby authorized to employ P. J. Nelson Patrick, surveyor, at one dollar and fifty cents per diem, two chain-bearers and one axeman, at a sum not exceeding, for each, one dollar per diem. SECTION 3. The said commissioners shall make out a fair and accucurate draft of the location of the road, noting thereon courses and distances, and the places, waters, county and township lines, with such other matter as may serve for explanation; one copy whereof shall be deposited in the office of the secretary of the commonwealth, on or before the first day of January next, and one copy in the office of the clerks of the court of quarter sessions of the respective counties through which the said road may pass, on the time aforesaid, or as much sooner as practicable; and from thenceforth the said road shall be a public highway, and shall be opened and repaired as all other roads laid out by the courts are made and repaired. SECTION 4. And the commissioners shall draw on the commissioners of the counties through which the said road shall pass, who shall adjust the account of the commissioners, surveyor, chain-bearers and axeman, and pay them as other accounts by orders on the treasurer of the county are paid. SECTION 5. And said commissioners shall meet on or before the first sioners to meet. Monday of August next, or as soon thereafter as a majority of them shall agree on, and complete the location of said road as soon as praeticable; and if any vacancy shall occur by resignation or otherwise, it |
