Capital stock.
Proviso.

Commencement and completion of road.

SECTION 2. That the capital stock of said company shall consist of one thousand shares, at twenty-five dollars per share: Provided, That said company may, from time to time, by a vote of the stockholders at a meeting called for that purpose, increase their capital stock so much as in their opinion inay be necessary to complete the road or roads, and to carry out the true intent and meaning of this act.

SECTION 3. That if said company shall not commence the construction of their road within three years after the granting of this charter, and to complete the same within seven years thereafter, this act shall be null and void, except so far as the same may be necessary to wind up the affairs and pay the debts of said company.

Authorizing the governor to incorporate the Perrysville and Zelienople turnpike or plank road company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Commissioners. Alexander Hilands, Robert Hay, Martin Byrane, Peter Mosser and

Thomas Gibson, of Allegheny county; and P. L. Passavant, Christian Buhl, Robert Hay, George Howell, Rudolph Keeker, John Reed, Abraham Ziegler, Jacob H. Ziegler, Francis Burkhart, Francis Wallace, Leonard Esterling, John Herr, David Garvin, Matthew Graham, James Covert, John Covert, Adam Gochring, Henry Honadel, Joseph Ziegler, Robert Sample, Samuel Marshall, John Burry, O. D. Palmer, Michael Knauff, John Swartz, William Rea, Joshua Stoolfire, John Randolph, William Garvin, H. J. Levis and H. Wiehl, of Butler county, be and they are hereby appointed commissioners to open books, receive subscriptions, and organize a company by the name, style and title of The Perrysville aud Zelienople turnpike or plank road company," with power to construct a turnpike or plank road, commencing at the terminus of the Allegheny and Perrysville turnpike road company, and extending towards Erie, through Zelienople, to the division line Subject to all the between Zelienople and Harmony, with power to extend it further, if said company shall deem it expedient so to do, by the nearest and best route or routes as the stockholders may determine upon, subject to all the provisions and restrictions of an act regulating turnpike or plank road

A FURTHER SUPPLEMENT

To the act, entitled « An Act to incorporate the Hazleton coal company."

SECTION 1. SECTION 2. That the rate of toll to be charged by said company on coal, salt, gypsum, lime, limestone and iron ore, shall not exceed one and a half cents per mile, for each ton of two thousand two hundred and forty pounds; and that no toll shall be charged on the engines, tenders or cars employed in transporting the same, either going or returning.

SECTION 3. That if the company shall at any time misuse or abuse any of the privileges hereby granted, or heretofore granted, the legislature may revoke all and singular the rights and privileges so granted to said company; and the legislature hereby reserves the power to resume, alter or amend the charter of said company, and take for public use, any road constructed in pursuance thereof: Provided, That taking such road for public use, full compensation shall be made to the stockholders. Charles Nace, John Leicy, Enos Hunsberger and Henry Moyer, of the county of Bucks, or any five of them, be and they are hereby appointed commissioners to open books, receive subscriptions, and organize a company, by the name, style and title of "The Hilltown turnpike road company," with power to locate and construct a turnpike road from Line Lexington, in the county of Bucks aforesaid, on the bed of the present public road by Leidy's tanyard and James' tavern, to a point at or near Kramer's smith shop, except where it may be necessary to widen, straighten or avoid hills on the said road, subject to all the provisions and restrictions of an act regulating turnpike and plank road companies, approved the twenty-sixth day of January

one thousand eight hundred and forty-nine: Provided, That the said Proviso.
Hilltown turnpike road company shall not be subject to that part of said
act regulating tolls, but is hereby authorized to charge the same rate of
tolls as are allowed to be charged by the acts incorporating the Chesnut
Hill, Springhouse and Northampton turnpike road company.

SECTION 2. SECTION 4. A SUPPLEMENT

To an act, entitled "An Act to enable the governor of this commonwealth to incorporate a company for making an artificial road by the best and nearest route from Berwick, on the North-east Branch of the Susquehanna, or from the mouth of the Wapehawley, to that point on the north line of the state which is nearest to Newtown, on the river Tioga, in the state of New York," approved the twenty-eighth day of March, one thousand eight hundred and six.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the stockholders of said company shall, from and after the passage of Annual election. this act, hold their annual election on the first Monday of May in every

year, for the purpose of electing the several officers required by said corporation, and all laws that are inconsistent with this act, be and the same are hereby repealed, so far as relates to said corporation.

Henry Frick, relief of.

Byberry and Bensalem turnpike road company authorized to borrow money.

No. 304.

AN ACT

For the relief of the estate of Henry Frick, deceased; and authorizing the Byberry and Bensalem turnpike company to borrow money.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the claim of the commonwealth against the estate of Henry Frick, late of Northumberland county, deceased, who was one of the sureties of Robert Moodie, late a collector of bridge and canal tolls at Northumberland, in the county of Northumberland, be and the same is hereby released for the benefit of the heirs of the said deceased.

SECTION 2. That the president and managers of the Byberry and Bensalem turnpike road company, be and they are hereby authorized to borrow, to be applied to the completion of said road, any sum of money not exceeding two thousand dollars, under the same provisions and restrictions as are imposed and provided for by the second section of an act, entitled "A supplement to an act, entitled An Act to incorporate the president and managers of the Danborough and Point Pleasant turnpike road company,' approved the thirtieth day of March, one thousand eight hundred and forty-eight."
