AN ACT

To authorize the auditor general to settle the accounts of Joseph K. Saeger, and to authorize John Foresman to institute a suit against Lycoming county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the auditor general be authorized and empowered to settle the accounts of the acting brigade inspector, Joseph K. Saeger, of the second brigade, seventh division, Pennsylvania militia, in all respects as if he had been regularly elected and commissioned brigade inspector for the said brigade: Provided, That this act shall not be construed so as to interfere with the just and legal claim, for services rendered by his predecessor, brigade inspector Strouss, previous to the appointment of said Joseph K. Saeger.

SECTION 2. That it shall be lawful for John Foresman, of the county authorized to in- of Lycoming, or his heirs or assigns, to institute a suit or action at law, stitute suit against or otherwise, against the said county of Lycoming, and to recover of Lycoming county and from said county such sum or sums of money as shall be found to

be equitably due to him, for extra work done by him for said county, in the erection and construction of a bridge over White Deer creek, in said county; any law or usage to the contrary notwithstanding: Provided, That no suit or action heretofore brought by the said John Forseman against the said county, shall be a bar to a recovery of any amount of money which shall be found equitably due to the said John Forseman, for the extra or additional work aforesaid.

AN ACT

To incorporate the congregation of Saint Vincent de Paul, in West Philadelphia.

WHEREAS, Thaddeus Amat, M. Anthony Frenayne, Michael Domenec, William Wilcox and John Sullivan, having purchased certain lots Preamble. in the borough of West Philadelphia, for the purpose of erecting thereon ) a church for the use of the-Catholic congregation; and, also, with a view to build thereon a dwelling house for them, and a house of education, and have desired to be incorporated under the name, style and title of "The congregation of St. Vincent de Paul;" therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the said Thaddeus Amat, John B. Tornatore, Michael Domenec, An- Corporators. drew Roni and John Sullivan, together with James Wilcox and Mark Wilcox, and their successors, be and hereby are declared and consti tuted a body politic and corporate in law, under the name, style and Style. title of The congregation of St. Vincent de Paul.”

SECTION 2. That the persons named in the first section of this act, shall be the first board of trustees of "The congregation of Saint Vincent de Paul," and that five of them shall be a quorum, and be competent to perform the duties hereinafter authorized and required to be performed by the said trustees.

SECTION 3. That said trustees, or a quorum of them, shall have Power of truspower to provide for their succession, by filling such vacancies in the tees. board of said trustees as may, from time to time, be caused by death, resignation, or otherwise, and to prescribe the duties to be performed

by the officers of the institution.

SECTION 4. That the said trustees and their successors, forever, shall Further powers. be empowered and authorized, and are hereby declared capable, in law, to hold the lots by them purchased in the borough of West Philadelphia, for the use of "The congregation of Saint Vincent de Paul," and take by purchase, gift, bequest, devise, or otherwise, real and personal estate, not exceeding in its clear yearly value the sum of five thousand dollars, and the same to hold for the purposes of said congregation, and to sell, convey, mortgage and transfer the same, from time to time, as occasion may require, for said purposes, and to enjoy all the usual privileges and rights of religious corporate bodies; to sue and be sued, to make by-laws, rules and regulations for their own government, as the said by-laws shall determine: Provided, That the said Proviso. by-laws, rules, regulations, or any of them, be not repugnant to the laws and constitution of the United States, or of the laws and constitution of this Commonwealth; to have a corporate seal, which may be altered when necessary, and generally to do every thing needful for the support and government of the institution, subject always to the proviso last aforesaid.

SECTION 5. No misnomer of said corporation shall defeat tended gift, grant, conveyance, devise, or bequest thereto, if the intent Misnomer. shall sufficiently appear therein.

Reservation.

SECTION 6. The legislature hereby reserves the right to alter, amend or annul the charter hereby granted, whenever, in their opinion, the same may be necessary.

To incorporate the Limekiln turnpike road company.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Commissioners. John Fitzwater, Jacob Fitzwater, James White, Charles Paxon,

Roberts, Joseph Paxson, Robert Atkinson, Charles Stout, Jesse Gilbert, David Ileist and Anthony Williams, of Montgomery county; and George Knight, Owen Cadwalader, Henry Goodman and Spencer Roberts, of Philadelphia county, be and they are hereby appointed commissioners to open books, receive subscriptions, and organize a company by the name, style and title of "The Limekiln turnpike road company," with power to construct a turnpike road, commencing in Jarrettown, at the intersection of the Limekiln road and a road leading from the Welch road to the Susquehanna street or road, near the blacksmith shop, in the township of Upper Dublin, in the county of Montgomery, and proceeding thence through Dreshertown, Fitzwatertown and Edgehill village, in said county, and through Pittville to the intersection of said Limekiln road and the Cheltenham and Willow Subject to all the Grove turnpike road, at Branchtown, in Bristol township, Philadelphia provisions and re- county, subject to all the provisions and restrictions of an act regulating strictions of a turnpike and plank road companies, approved the twenty-sixth of January, one thousand eight hundred and forty-nine.

SECTION 2. That the capital stock of said company shall consist of four hundred shares, at twenty-five dollars per share: Provided, That said company may, from time to time, by a vote of the stockholders, at a meeting called for that purpose, increase their capital stock so much as in their opinion may be deemed necessary to complete the road, and to carry out the true intent and meaning of this act.

SECTION 3. That if said company shall not commence the construction of their road within two years after the passage of this act, and

complete the same within five years thereafter, this act shall be null and void, except so far as the same may be necessary to wind up the affairs and pay the debts of the company.

AN ACT

To extend the charter of the Bank of the Northern Liberties.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the charter of the Bank of the Northern Liberties be and the same is Charter extended hereby extended and continued for the term of fifteen years, from the for the term of fifteen years. expiration of its present charter, subject to all the restrictions and provisions, and with all the immunities and privileges contained in an act, entitled "An Act to reinstate the capital and extend the charter of the Farmers' and Mechanics' Bank of Philadelphia," approved the sixteenth day of March, one thousand eight hundred and forty-nine, except : so much of said act as relates to reinstating the capital of said bank, and so much of said act as is hereby altered or supplied, and subject to all general laws which may hereafter be passed, for the regulation of banking institutions: Provided, That so much of said act as requires Proviso. said Farmers' and Mechanics' Bank of Philadelphia, to pay into the treasury two per cent. on the amount of its capital stock, within three months after the passage thereof, shall be so construed as far as it is applicable to the Bank of the Northern Liberties, as to require said Bank of the Northern Liberties, to pay said tax into the treasury within three months from and after the expiration of its present charter.

SECTION 2. The total liabilities of the said bank, exclusive of deLiabilities of said posits, shall not at any time exceed double the amount of its capital bank exclusive of stock paid in, nor shall the debts of every kind due, and to become due deposits, not to to the said bank, except debts due from the government of the United exceed double the States, and the state of Pennsylvania, ever amount to more than three amount of its times its capital stock paid in; and the said bank shall neither loan nor capital stock discount, when its circulation shall be equal for thirty consecutive days, paid in. to three times the amount of specie, and notes of specie paying banks in its possession belonging to said bank, and any balances standing to

the credit thereof in specie paying banks, convertible into specie at the pleasure of the said bank.

AN ACT

To incorporate the Tunkhannock Creek turnpike road company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Commissioners. Sherman D. Phelps, Samuel Starke, second, Andrew Gordiner, Nathaniel Bacon, Webster Ousterhourt, Daniel H. Wade and Asa Howan, of the counties of Wyoming and Susquehanna, or a majority of them, be and they are hereby appointed commissioners to open books, receive subscriptions, and organize a company by the name, style and title of The Tunkhannock Creek turnpike road company," with power to construct a turnpike road from the borough of Tunkhannock, in Wyoming county, and thence by the best route up the Tunkhannock creek, passing near Bacon's, Grow and Brothers and D. H. Wades', to the Jackson and Harmony turnpike road, in Susquehanna county, the route of the road to be agreed upon and adopted by the stockholders, or a majority of them, at a meeting called for that purpose, subject to all the provisions and restrictions of an act regulating turnpike and plank road companies, approved the twenty-sixth day of January, one thousand eight hundred and forty-nine.

SECTION 2.
