SECTION 2. That the capital stock of said company shall consist of two hundred shares, at twenty-five dollars per share: Provided, That said company may from time to time by a vote of the stockholders at a meeting called for that purpose, increase their capital stock so much as may be necessary in their opinion, to carry out the true intent and meaning of this act.

SECTION 3. That if said company shall not commence the construction of their road within two years after the passage of this act, and complete the same within five years thereafter, this act shall be null and void, except so far as the same may be necessary to wind up the affairs, and pay the debts of said company.

Authorizing the governor to incorporate the Wattsburg and Warren plank road

company.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Commissioners. Rufus P. King, Silas L. Axtell, Samuel P. Johnson, Lewis Arnett, William A. Irvine, John M'Kinney, Charles Whitney, E. H. Day, Carter V. Kinnear, Philip Mead, second, William Siggins, John Mead, William B. Acocks, William F. Dalyrymple, C. Messenger, Lester Wright, Daniel Walton, Milo P. Osburn, George Cady, J. P. Matter, of Warren county, and Lyman Robinson, H. Moore, W. R. Black, J. Comestock, Matthew A. Gray, William Gray, and Gurden Crook, of Erie county, be and they are hereby appointed commissioners to open books, receive subscription, and organize a company, by the name, style and title of the "Wattsburg and Warren plank road company," with power to construct a plank road, from the borough of Warren to Wattsburg, in the county of Erie, by the way of Irvine,

Curtis, be and they are hereby appointed commissioners to open books, receive subscriptions and organize a company by the name, style and title of "The Tionesta plank road company, "with power to construct a plank road from some point on the Tionesta creek, near the residence of John Gibson, in the county of Warren, to the Allegheny river, in said county, with the privilege of extending the same to the borough of Warren, by the nearest and best route, subject to all the provisions and restrictions of an act regulating turnpike and plank road companies, approved the twenty-sixth day of January, one thousand eight hundred and forty-nine: Provided, That the commissioners provided for in the twelfth section of said act, shall

be appointed by the court of common pleas of Warren county, and
instead of the tolls authorized to be collected by the thirteenth section
of said act, it shall be lawful for the said company to collect the fol-
lowing, for every five miles: for every carriage, sled, or other vehicle Tolls.
