Powers of trustees.

Proviso.

SECTION 3. All elections that shall be holden in pursuance of this law, shall be conducted by three members of the said corporation, who shall be appointed inspectors at the same time and place where the trustees are chosen, as aforesaid, by the electors then assembled, in such manner as shall be agreed upon by the said electors; and the said inspectors so chosen shall appoint one or more persons as their clerk or clerks, to perform such duties as the nature of the case may require. SECTION 4. When such election so had, as aforesaid, shall be closed, and the number of votes for each person shall have been ascertained, the inspectors of said election, or a majority of them, shall thereupon make out, under their respective hands, a return thereof, with the names of the officers elect, and shall deliver said returns to the secretary of said corporation, who shall within three days thereafter, give notice in writing to each of the officers so elected, of their respective elections.

SECTION 5. The said trustees and their successors in office shall have power to enact and enforce such by-laws and ordinances as may be proper and necessary for the regulation and transaction of the business of the corporation: Provided, That said by-laws and ordinances shall not be inconsistent with the constitution and laws of this state, or of the United States, and that the same be approved by a majority of the members of the corporation, at any annual or special meeting called by the trustees for that purpose; and that the by-laws and ordinances of the said corporation shall be fairly entered and registered by the secretary, in a book to be provided for that purpose, signed by the president and attested by the secretary, which book and other records of the corporation shall be open to the inspection of any member of the corporation, at all reasonable hours, on application to the secretary.

AN ACT

To annul the marriage contract between Justus Osborn, and Parthenia, his wife.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the marriage contract entered into between Justus Osborn of Erie county,

and Parthenia Osborn, his wife, late Parthenia Milks, be and the same is hereby annulled and made void, and the parties released and discharged from said contract, and from all duties and obligations arising therefrom, as fully, effectually and absolutely, as if they never had been joined in marriage.

We do certify, that the bill, entitled "An Act to annul the marriage contract between Justus Osborn and Parthenia, his wife," was presented to the Governor on the twentieth day of February, one thousand eight hundred and forty-nine, and was not returned within ten days (Sundays excepted) after it had been presented to him; wherefore, it has, agreeably to the constitution of this commonwealth, become a law in like manner as if he had signed it.

SECTION 1. authorized and empowered to sell at public or private sale, the lot of ground upon which a house for public worship is erected, with the appurtenances thereto belonging, to wit: beginning at a stone in the public road; thence south seventy-two degrees west seventeen and one fourth perches to a post; thence north eight degrees west eight perches to a post; thence north seventy-two degrees east seventeen and one-half perches to a post; thence south twenty-eight degrees east eight perches to the place of beginning, being part of a tract of land, number seven hundred and forty-six, in the fourth district of donation land, and to assure and convey unto the purchaser or purchasers, by deed or other legal conveyances, in fee simple, the said lot with the appurtenances thereto belonging: Provided, That the proceeds arising from the sale of said property shall be faithfully appropriated to the purchase of materials for, and the erection of a new house of public worship, for the use of said church.

AN ACT

Relative to the courts of Wayne county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, the county of Wayne shall be and is hereby attached to the Eastern district of the supreme court, and that all writs of error and certiorari, and all appeals and proceedings now depending in the Northern district of said court, or which shall be depending therein, prior to the second Monday in July next, from the said court of Wayne county, shall be returned and removed into the Eastern district for determination.

AN ACT

and extend Ann street, in the borough of Petersburg, in the county of

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the town council of the borough of Petersburg, in the county of Perry, Ann street. are hereby authorized and required to lay out, open and extend Ann street, in said borough, so as to intersect the great road leading to Bloomfield, in said county.

SECTION 2. of them, said street ought to be opened and extended, then they shall make out a plot or draft of said street so to be opened, by its courses and distances, having regard to the best ground and the least possible damage to property; and they shall also make report of the width of said street, and make return of the same, under their hands and seals, to the court of quarter sessions of Perry county, to be entered on record; and thereupon, the said street shall become a public highway, and it shall be the duty of the street commissioner of the said borough of Petersburg, to proceed forthwith to open the same.

SECTION 3. The court of quarter sessions of the county of Perry, on the petition of any owner of a lot or land through which said street shall be extended and opened, representing that he or she has sustained damages, shall appoint three freeholders of said county to view the premises and adjudge the amount of damages (if any) sustained, taking into consideration the probable advantages of the said street to the complainant; and the said amount shall be paid after being approved by the court, out of the county treasury: Provided always, That the said viewers shall, each of them, before they proceed to assess the said damages, take an oath or affirmation, before a justice of the peace of said county, justly and truly to value the same, and to consider the advantages as well as disadvantages of the extension and opening of the said street to complainant.
