into a bond to that amount, with at least one sufficient security, to be approved of by the court of quarter sessions of said county, in the same manner as now, with reference to the said constables of the several counties of this commonwealth, and for the same uses and trusts, to all intents and purposes, and the same penalties imposed for neglect or refusal to serve; and in case of a vacancy shall occur, by death, refusal to serve, or any other cause, the said court shall appoint, as they have power to do in such cases, in the several townships of this commonwealth.

SECTION 12. That from and after the passage of this act, the citizens Election district. of the borough of Millerstown, aforesaid, shall constitute a separate election district, and hold their place of election in the school house in said borough, and be subject to all the laws regulating elections in this commonwealth.

SECTION 13. That from and after the passage of this act, the borough School district. of Millerstown, aforesaid, shall constitute a separate school district, subject to the laws regulating schools in this commonwealth.

SECTION 14. That the burgess, one member of the council, and Appeal. treasurer, or any two of them shall constitute a court of appeal, and prior to the collection of any borough tax, they shall appoint a day for the hearing of appeals, of which and the amounts of his or her tax, and the place where the appeals will be held, the clerk shall notify each taxable by a written notice, in the usual form and manner, at least ten days before the day of appeal; and when the said tax shall have been properly adjusted, it shall be the duty of the burgess, or in case of his absence or inability to act, of the treasurer, and he is hereby authorized to issue his precept, directed to the collector, commanding him to collect all taxes so assessed, and vesting him with like powers and authorities, given to the collectors of the county rates and levies, by the laws of this commonwealth; and the amounts so collected shall be paid into the treasury for the use of the corporation.

SECTION 15. That in the absence of the burgess from the borough, Absence of buror his inability to act, it shall be the duty of the first named of the gess, &c.

town council who may be present, to perform the duties which are en

joined on the burgess by this act, or may be enjoined by the by-laws

which may be passed in pursuance of the same.

SECTION 16. That in any meeting of the burgess and town council, Quorum. it shall require at least three of the council to form a quorum to do business; but in passing the by-laws and ordinances, it shall require a majority of the whole number of the council.

SECTION 17. That Abram Addams and John Fertig, of said borough, Abram Addams, or either of them, shall publish and superintend the first election for John Fertig. borough officers, to be held on the third Friday in March next, after the passage of this act, at the place appointed by law for holding the annual elections for said borough; and they are hereby directed to give five days' notice, by advertisement, as before directed in other cases of holding elections, of the time and place of holding the same.

SECTION 18. That the election for justices of the peace shall be held Election of jusat the time and place, and in the manner as directed by the general tices of the peace. election law on that subject: Provided, That nothing herein enacted Proviso. shall affect the office of any justice of the peace in the township from

which this borough is separated.

SECTION 19. That all the taxes collected by said borough shall be Taxes. expended exclusively within their own boundaries, for the repairs of their own streets, and the other purposes heretofore enumerated; and no property within said borough, shall, after the passage of this act, be subject to a road tax for township purposes.

Deeds.

SECTION 20. That in all cases in which deeds have been or shall be made by trustees of school houses and school lots, to the school directors of any school district, such deeds shall be deemed valid and sufficient to pass the legal estate therein, to such school directors, if executed by a majority of the surviving trustees to whom the title had been made. AN ACT

To incorporate the Philadelphia hose company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That all and every the persons who shall at the time of the passing of this act, be members of the association called the "Philadelphia hose company," shall be and they are hereby created and declared to be one body politic and corporate, by the name, style, and title of the "Philadelphia hose company ;" and by the same name shall have perpetual succession, and shall be able to sue and be sued, implead and be impleaded in all courts of records or elsewhere, and to purchase, receive, have, hold, and enjoy, to them and their successors, lands, tenements, rents, annuities, franchises and hereditaments, goods and chattels, of what nature, kind or quality soever, real, personal or mixed, or choses in action, and the same from time to time to sell, grant, devise, alien or dispose of: Provided, That the clear yearly value or income of the necessary houses, lands and tenements, rents, annuities, or other hereditaments and real estate of the said corporation, and the interest of money by it lent, shall not exceed the sum of two thousand five hundred dollars; and also to make and have a common seal, and the same to break, alter and renew at pleasure; and also to ordain, establish and put in execution such by-laws, ordinances and regulations as shall appear necessary and convenient for the government of the said corporation, not being contrary to this charter, or the constitution and laws of the United States or of this commonwealth, and generally to do all and singular, the matters and things which to them it shall lawfully appertain to do for the well being of the said corporation, and the due management and ordering of the affairs thereof.

SECTION 2. That the object of the said corporation shall be the pro- Object. motion of the public good by the extinguishment of fires.

SECTION 3. That the charter granted to the said Philadelphia hose Repeal. company, by the court of common pleas, held at Philadelphia on the seventh day of June, Anno Domini one thousand eight hundred and forty-one, and all and singular the provisions thereof, be and the same are hereby repealed.

AN ACT

Relating to a special election in Adams county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the time for holding the special election in Adams county, to supply the vacancy in the house of representatives, occasioned by the resignation of James Cooper, be and the same is hereby changed to the sixteenth day of March, of the present year; said election to be held at the usual places of holding the spring elections in said county; and that so much of any law as requires fifteen days' notice to be given of such election, be and the same is hereby repealed so far as the same may have relation to the present case.

To change the place of holding elections in the townships of Henderson and Todd, in the county of Huntingdon.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That hereafter the qualified electors of the township of Henderson, in the county of Huntingdon, shall hold their elections at the court house in the borough of Huntingdon.

SECTION 2. That the qualified electors in the township of Todd. county of Huntingdon, shall hereafter hold their elections at the Green school house, in said township of Todd, and county aforesaid.

AN ACT

Authorizing the governor to incorporate the Mauch Chunk water company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Asa Packer, E. A. Douglas, John Lentz, Jacob H. Salkeld, Cornelius Conner, Conrad Miller, L. D. Knowles, Edward Lippincot, John Mears and George Weiss, or any four of them, are hereby appointed commissioners to do and perform all matters and things hereafter mentioned; that is to say, they shall on or before the first day of May next procure a book, and enter therein as follows:-"We the subscribers, promise to pay to the president and managers of the Mauch Chunk water company, the sum of twenty-five dollars for every share of stock set opposite to our respective names, in such manner and proportions, and at such times as shall be determined by the said company, in pur

SECTION 2. That when seventy-five shares of the stock shall have been subscribed, the commissioners shall certify under their hands and seals the names of the subscribers, and the number of shares subscribed by each. to the governor of this commonwealth; and thereupon it shall be lawful for the governor, under his hand and the seal of the state, to create and erect the subscribers, and also those who shall afterwards subscribe, and thei assigns, into one body politic and corporate, in deed Incorporate. and in law, by the name, style and title of the Mauch Chunk water Style. company; by which name the said subscribers shall have perpetual Privileges. succession, and all the privileges and franchises incident to a corporation; and shall be capable of taking and holding the capital stock, and the increase and the profits thereof, and of enlarging the same by new subscription, if it shall be found necessary to fulfil the intent of this act; and of purchasing, taking and holding to them, their successors and assigns, and of selling and transferring in fee simple, or for any less estate, such lands, tenements, hereditaments and estate, real or personal, as shall be necessary in the prosecution of their works; and of suing and being sued, and of doing any matter and thing which a corporation or body politic may lawfully do.

SECTION 3. That any three or more of the said commissioners shall, as soon as conveniently may be after the letters patents are obtained, Organization. give at least ten days' notice in one or more of the newspapers printed in the town of Mauch Chunk, of the time and place of holding an elec tion for officers of the company; at which time the subscribers shall meet and choose, by ballot, five managers, who shall be stockholders, Officers. to conduct the affairs of the company until the first Monday of February then next ensuing; and in all elections each stockholder shall be entitled to one vote for each share held by him, not exceeding three shares; and one vote for every two shares above three, and not exceeding ten; and one vote for every four shares above ten, and not exceeding twenty; and one vote for every five shares above twenty:
