House Resolution No. 316. Disapproving certain sections of the Executive order dated December 9, 1932, pertaining to the Longshoremen's and Harbor Workers Act and transfer of the same to the Department of Labor. Executive Order No. 5962, December 9, 1932 House Document No. 493

Subject: Consolidation and grouping of education, health, and recreation activities in the Department of the Interior.

The plan included provision for the creation of an assistant secretary for education, health, and recreation, and for other purposes. This was probably the first move in the direction of establishing what is now the Department of Health, Education, and Welfare.

Action: Never effected. Order disapproved by House Resolution No. 334 of January 19, 1933, 76 Congressional Record 2126.

Other resolutions were also introduced: Senate Resolution No. 311. To suspend the operation of the Executive order, dated December 9, 1932, relating to Vocational education. Mr. Norbeck; ordered to lie on the table, December 22, 1932, 76 Congressional Record 891.

House Resolution No. 330. Disapproving transfer of the Federal Board of Vocational Education. Mr. Connery; Committee on Expenditures in the Executive Departments, December 20, 1932, 76 Congressional Record 816.

Executive Order No. 5963, December 9, 1932 House Document No. 493 Subject: Consolidation and grouping of land utilization agencies in the Department of Agriculture.

One Assistant Secretary of Agriculture was changed to an Assistant Secretary for Land Utilization, and other purposes.

Action: Never effected. Order disapproved by House Resolution No. 334 of January 19, 1933, 76 Congressional Record 2126.

Disapproving so much of the Executive order of December 9, 1932, as proposes to transfer the General Land Office from the Department of the Interior to the Department of Agriculture. Executive Order No. 5964, December 9, 1932 House Document No. 493

Subject: Consolidation and grouping of functions supervised by the Secretary of the Interior in the field of public works, these functions to be delegated to an Assistant Secretary of the Interior for Public Works.

Action: Never effected. Order disapproved by House Resolution No. 334 of January 19, 1933, 76 Congressional Record 2126.

Executive Order No. 5965, December 9, 1932 House Document No. 493 Subject: Consolidation and grouping of merchant marine activities in the Department of Commerce.

The plan also included the creation of an Assistant Secretary of Commerce for Merchant Marine.

Subject: Transferring to the Department of Justice certain functions previously performed by the Veterans' Administration.

Subject: Transfer of the duties, powers, and functions of the Alien Property Custodian to the Department of Justice.

Executive Order No. 5969, December 9, 1932 House Document No. 493

Subject: Transfer to the Civil Service Commission of certain functions previously performed by the Employee's Compensation Commission.

Under this order, compensation cases on civilian employees of the Federal Government and the District of Columbia employees were transferred to the Civil Service Commission.

Action: Never effected. Order disapproved by House Resolution No. 334 of January 19, 1933, 76 Congressional Record 2126.

S. 5538. To establish a Department of Development and Conservation, to abolish the Department of Agriculture and the Department of the Interior, and to transfer the functions thereof to the new Department of Development and Conservation, and for other purposes. Mr. Britton; Committee on Public Lands and Surveys, January 27, 1933, 76 Congressional Record 2644-2645. Reports on this proposal were submitted by the Secretary of Agriculture and the Secretary of the Interior, March 3, 1933, 76 Congressional Record 5430. The session ended on March 4, 1933, so action on this proposal was not completed.

LEGISLATIVE HISTORY

The legislation under which President Roosevelt proceeded in submitting the Executive orders and reorganization plans which he presented during his first year in office was enacted before he assumed office. Consequently, it has already been described. Additional legislation, however, soon followed. A rider to the Treasury-Post Office Appropriations Act of March 3, 1933 (47 Stat. 1517, ch. 212, sec. 16, amending title IV of the Legislative Appropriation Act of June 30, 1932, supra), authorized the President to make changes in the organization of the executive branch of the Government. It authorized, in addition to consolidation and transfer, the abolition of any executive agency or functions thereof.

CHANGES PROPOSED BY EXECUTIVE ORDER

Reorganization of the Agricultural Credit Agencies. House Document No. 7

Purpose: To consolidate into one agency to be called the Farm Credit Administration, the functions of all existing Federal organizations which deal primarily with agricultural credit.

Included in this plan were the Federal Board, the Federal Farm Loan Board, the functions of the Secretary of Agriculture relating to loans in aid of agriculture, and those of the Reconstruction Finance Corporation pertaining to the management of regional agricultural credit corporations. The functions of the Federal Farm Board with regard to further stabilization operations were abolished.

Action: Became effective through Executive Order No. 6084 of March 27, 1933. See also act of June 15, 1929.

Abolition of Indian Commissioners

Under the act of March 3, 1933 (47 Stat. 1517, ch. 212, sec. 16, supra), the President abolished the Board of Indian Commissioners in the Department of the Interior. This was accomplished by Executive Order No. 6145, May 25, 1933.

Reorganization of Executive Agencies. Executive Order No. 6166, June 10, 1933

The provisions of this Executive order may be summarized as follows:

Section 1.-Procurement Division in the Treasury Department established and procurement functions of all agencies transfered thereto. The transfers were delayed by Executive Order No. 6224, December 31, 1933, and when effected, the authority was amplified by Executive Order No. 7151, August 21, 1935.

The Office of the Supervising Architect of the Treasury was transferred to the Procurement Division, except that the buildings of the Treasury Department and Post Office Department were to be administered by those Departments.

The General Supply Committee in the Treasury Department was abolished.

The fuel yards of the Bureau of Mines were transferred to the Procurement Division.

The Federal Employment Stabilization Board was abolished and its records transferred to the Emergency Administration of Public Works. The effective date of this change was postponed by Executive Orders Nos. 6221 and 6624, and the functions of the Board were transferred by Executive Order No. 6623, to the Federal Employment Stabilization Office in the Department of Commerce, revoking the last paragraph of Executive Order No. 6166.

Section 2.-An Office of National Parks, Buildings, and Reservations to be known as the National Park Service was established in the Department of the Interior, and the administration of all public buildings, reservations, national parks, national monuments, and national cemeteries consolidated in this office. The National Park Service, Department of the Interior, was transferred to the new Office.

The national cemeteries and parks of the War Department within continental United States were transferred to the new Office; national cemteries located in foreign countries were transferred to the Department of State (this change was later revoked by Executive Order No. 6614, Feb. 26, 1934, and those cemeteries located in insular posessions were transfered to the Bureau of Insular Affairs, War Department). The effective date of these transfers was postponed by Executive Order No. 6227, July 27, 1933, and said section 2 was made more explicit by Executive Order No. 6228, July 28, 1933.

The functions of the following agencies were transferred to the new Office and the agencies abolished:

Arlington Memorial Bridge Commission.

Public Building Commission.

Public Buildings and Public Parks of the National Capital.
National Memorial Commission.

Rock Creek and Potomac Parkway Commission.

The expenditures of the following Commissions were to be administered by the Department of the Interior:

Commission of Fine Arts.

George Rogers Clark Sesquicentennial Commission.
Rushmore National Commission.

Section 3.-The functions of the Bureau of Prohibition of the Department of Justice with respect to granting permits under the national prohibition (Volstead) law were transferred to the Division of Internal Revenue, Treasury Department, and other functions to other functions to other divisons in the Department of Justice.

A Division of Investigation was established in the Department of Justice, consolidating the functions of the Bureau of Investigation and the investigative functions of the Bureau of Prohibition in the Division of Investigations. (See also Executive Order No. 6639, below.)

Section 4.-The function of the disbursement of money for all agencies was transferred to the Treasury Department, a Division of Disbursement being created to administer this activity. The effective date was postponed by Executive Orders Nos. 6224, 6540, 6727, 7077, 7261, and 7390, and the shift itself amended by Nos. 7526, 7639, and 7774.

The provision for the disbursement of money for other agencies by the Division of Disbursement in the Treasury Department, as provided in Executive Order No. 6166, was revoked insofar as it was applicable to disbursing functions under the jurisdiction of the War Department, Navy Department (including the Marine Corps), and the Panama Canal, through Executive Order No. 6728, May 29, 1934, except with respect to those disbursements pertaining to salaries and expenses within the District of Columbia.

Section 5.-The functions of prosecuting and defending claims by or against the United States were transferred to the Department of Justice, and this Department would be responsible for deciding upon the action to be taken-prosecution, defense, etc., of the cases referred to it.

The Solicitor of the Treasury was transferred from the Department of Justice to the Treasury Department for the exercise of functions not transferred to the Department of Justice under this section. The transfers were delayed, however, by Executive Order No. 6222, July 27, 1933, and Executive Order No. 6244, August 8, 1933.

Section 6.-The U.S. Court for China and the District Court of the United States for the Panama Canal Zone and the Virgin Islands of the United States were transferred to the Department of Justice. The effective date was postponed by Executive Orders Nos. 6243, August 3, 1933, and 6301, September 30, 1933, and the terms amended by Execu

tive Order No. 6390, November 3, 1933; see also Executive Order No. 6166, section 4.

Upon transfer of the District Court of the United States for the Panama Canal Zone from the War Department to the Department of Justice (see Executive Order No. 6166, above), the War Department was to continue to provide offices, quarters, etc., to the court, and its personnel, and the marshal of the Panama Canal Zone should continue to disburse funds. (See Executive Order No. 6390, Nov. 3, 1933.)

Section 7.-The Solicitors of the Department of Commerce and the Department of Labor were transferred from the Department of Justice to the Departments of Commerce and Labor, respectively.

Section 8.-The Bureau of Industrial Alcohol in the Treasury Department was consolidated with the Bureau of Internal Revenue to form a new Divison of Internal Revenue. The effective date was postponed by Executive Orders Nos. 6224, July 27, 1933, and 6540, December 28, 1933. The officers of these agencies were transferred to the Bureau of Internal Revenue, Treasury Department, by Executive Order No. 6639, March 10, 1934.

The Bureau of Industrial Alcohol and the Office of the Commissioner of Industrial Alcohol were abolished and the functions transferred to the Bureau of Internal Revenue under the Secretary of the Treasury; certain functions of the Attorney General were also transferred to the Bureau of Internal Revenue. (See Executive Order No. 6639, Mar. 10, 1934.)

Section 9.-The Assistant Secretary of Commerce for Aeronautics. was to be Assistant Secretary of Commerce.

Section 10.-The preparation of the Official Register was transferred from the Bureau of the Census, Department of Commerce, to the Civil Service Commission.

Section 11.-The Bureau of the Census function of compiling statisties of cities under 100,000 population was abolished for the period. ending June 30, 1935.

Section 12.-The U.S. Shipping Board was abolishing and its functions transferred to the Department of Commerce.

Section 13.-The National Screw Thread Commission was abolished and its functions and facilities transferred to the Department of Commerce.

Section 14.-The Bureaus of Immigration and Naturalization were consolidated into the Immigration and Naturalization Service of the Department of Labor.

Section 15.-The Federal Board for Vocational Education was transferred to the Department of the Interior, and its members were to serve in an advisory capacity without compensation. The status of the employees of this agency was extended by Executive Order No. 6227, July 27, 1933.

Section 16.-The functions of making and modifying appropriations was transferred to the Director of the Bureau of the Budget; the regulations under this order were contained in Executive Orders Nos. 6226, July 27, 1933, and 6869, October 10, 1934.

Section 17.-The Federal Coordinating Service was abolished, but the effective date was postponed by Executive Order No. 6239, August 2, 1933.
