repaired, upheld, fupported, fustained, and kept (except as before excepted) at the end, expiration, or other fooner deternaination of the faid term of, &c.. hereby granted; fhall and will quietly and peaceably leave, furrender, and yield up unto the faid A. B. his, &c. together with the faid goods, household stuff and furniture, the use whereof is herein before granted, as aforefaid (if any fuch there be) and alfo all and every the doors, locks, keys, bolts, ftaples, latches, hooks, hinges, wainscots, cifterns, pipes, pumps, conduits, dreffers, tables, fhelves, hearths, grates, ftoves, chimnies, chimney-pieces, fashes and glass of and belonging to the fame premifes, particularly comprifed, expreffed and mentioned in the faid fchedule or inventory hereunto prefixed (but annexed, if the Schedule be to be fixed to the back part of the leafe) in good and fufficient repair and condition (reafonable use and wearing thereof, and damage by fire as aforefaid, only excepted :) And that it fhall and may be lawful to and for the faid A. B. his, &c. and all and every other perfon and perfons having intereft in the premifes, with workmen and others in their, every or any of their company or companies, or without, twice, or oftener every year, during the faid term, at convenient times in the day time, to enter and come into and upon the faid demifed premises, and every part and parcel thereof, there to view, fearch and see the state and condition of the reparations of the faid premises, and of all defects, decays and want of reparations then and there found, to give or leave notice in writing or otherwife, to and for the the faid C. D. his executors, administrators or assigns, for repairing and amending of the fame within the space of months, then pext following: In which faid space or time of, &c. after every or any fuch notice or warning fo left, as aforefaid, he the faid C. D. for himself, his heirs, executors and administrators, doth covenant, promife, grant and agree, to and with the faid A. B. his, &c. well and fufficiently to repair and amend the decays, defects, and want of reparations fo to be found, as aforefaid, (except as is before excepted :) And alfo, he the faid C. D. his executors, administrators and affigns, fhall and will from time to time, and at all times hereafter, during the faid term hereby granted, bear, pay and difcharge all taxes, charges, impofitions and parifh duties, which fhall be taxed, charged, impofed, or affeffed upon the faid meffuage or tenement or premifes, or any part thereof

A Leafe of Lands from Two to One.

HIS indenture made, &c. between A. B. of, &c. and C. D. of, &c. of one part, and E. F. of the other part, witneffeth, That the faid A. B. and C. D. for and in confideration of the rent, covenants and agreements herein after mentioned, referved and contained on the part and behalf of the faid C. D. his executors, adminiftrators and affigns, to be paid, done and performed, have, and each of them hath granted, demifed, leafed, and to farm letten, and by these prefents do, and each of them doth grant, demife leafe and to farm let unto the faid E. F. his executors, administrators and affigns, All that piece or parcel of arable land called, &c. containing, &c. and alfo four closes of pasture ground, lying and being in, &c. (here particularly defcribe the premises) with all and fingular the appurtenances thereunto belonging (except and always excepting out of this prefent demife or leafe, all timber trees ftanding or growing, in or upon the faid demifed premifes, or any part thereof, and alfo the ways through the fame to the other lands, at prefent belonging or appertaining to the faid A. B. and C. D. or either of them :) To have and to hold all and fingular the faid demifed premises, with their and every of their appurtenances, (except as is before excepted) unto the faid E. F. his executors, administrators and affigns, from the day of, &c. for and during the term of one and twen

by years from thence next enfuing and fully to be complete and ended; yielding, St. (Here infert the rent referved and the days of payment according to the method preferibed in the two former leafes.) Provided always, nevertheless, &c. (Here infert as in the other leafes, the provifo for re-entry, or non-payment of rent, and likewife the covenant for payment.) And also that he the faid E. F. his executors, &c. fhall and will from time to time, and at all times during the faid term hereby granted, at his and their own proper colts and charges, well and fufficiently repair, amend, fence and keep all the hedges, gates, pofts, bars, rails, bridges, pounds and pales, of and belonging to the faid demifed premifes, and fcour and cleanfe the ditches and water-courfes appertaining to the fame, and maintain and keep the quick frith and fences in a good and husbandlike manner; And the faid premifes hereby demifed, with the faid hedges, gates, posts, bars, rails, bridges, pounds and pales fufficiently repaired and kept, ditches and water courfes cleanfed and fcoured, iuclofures maintained, and quick frith preferved, at the end, or other fooner determination of this prefent demife or leafe unto the said A. B. and C. D. or the one of them, their or the one of their heirs or affigns (If the leffor have only a temporary estate in the premises, then fay, executors, &c. as directed in the first leafe.) fhall and will leave, furrender and yield up And that the faid E. F. his executors, adminiftrators or affigns, fhall not at any time or times during the faid term, break up, plough, fow, or convert into tillage, an y of the lands hereby demifed, or have at any time any corn or grain growing, ftanding or being on any part thereof, under the penalty of dollars, yearly, for every acre fo broken up, ploughed, fowed or converted into tillage, or having corn or grain growing standing or being thereon, contrary to the true intent and meaning of thefe prefents, over and above the yearly rent, hereby referved, as aforefaid; the faid penalty of dollars a year to be paid, &c. next and immediately after fuch ploughing or fowing or have corn or grain growing or being as aforefaid; And further, that he the faid E. F. his executors, administrators, or affigns,. fhall not or will not carry off or from the faid demifed premifes, or any part thereof, any hay, straw, grass, dung, foil or compoft there made, or thereon arifing, during the faid term; but the fame fhall fodder, fpread, ufe and employ, on the

faid premifes, or fome part thereof, on pain of forfeiting three dollars for every load fo carried off or from the faid demifed premises, as aforefaid: And that he the faid E. F. his executors, administrators and affigns, fhall and will permit and fuffer the faid A. B. and C. D. or the one of them, their, or the one of their agents, heirs or affigns, (or executors, &c. as above obferved) from time to time and at all times, during the faid term hereby granted, to enter upon and view the ftate and condition of the faid demifed premifes. And the faid A. B. and C. D. for themselves, and either of them, their and either of their heirs, executors, and adminitrators, &c. (Here infert the covenant for quiet enjoyment as in the preceding leafes.)

Whereas the faid A. B. by a certain writing or letter of attorney under his hand and feal, duly executed, dated the amongst other things therein contained, did authorise the said C. D. in in the name of him the said A. B. and on his behalf, to execute leafes of fuch part of his lands, tenements and hereditaments in as by the faid C. D. fhall be thought fit to be leafed: Now this indenture witneffeih, That for and in confideration of the rent, covenants and agreements, herein after mentioned, referved and contained, on the part and behalf of the faid E. OF LEASE AND RELEASE..

THE

HE common conveyance of eftates of inheritance, now in ufe, is a leafe and releafe. The leafe, or bar gain and fale, must be made for one year, to commence from the day before the date thereof, and must bear date the day. before that of the release; and though both of thofe deeds make but one conveyance in law, and are executed at the fame time, yet the bargain and fale must be first executed, a poffeffion being thereby directly conveyed to the purchafer or réleafee ; and by that means livery and feizin, which was neceffary to be made on the former method of conveying,
