Senator Chillingworth moved that the Report of the Committee on the Bill be adopted. Seconded by Senator Woods and carried.

The Message (No. 21) of the Governor, vetoing House Bill No. 147, was read by the Clerk.

Senator Chillingworth moved that the Message be referred to the Judiciary Committee. Seconded by Senator Lane.

Senator Kalama moved as an amendment to defer action on the Message until tomorrow afternoon at 2 o'clock. Senator Chillingworth accepted the amendment which carried.

Under suspension of the Rules, Senator Smith presented the Report (No. 187) of the Judiciary Committee on Senate Bill No. 105 as follows:

Sir: The Judiciary Committee has had under consideration Senate Bill No. 105, entitled "An Act to Repeal Act 53 of the Session Laws of 1907," and recommends that the same be laid upon the table.

Act 53 of the Session Laws of 1907 is the same as Senate Bill No. 46 and provides for the payment of one dollar for each day's attendance to witnesses in criminal cases required to attend upon a Circuit Court or a Grand Jury, which Bill was heretofore favorably reported by this Committee.

We understand that the introducer of Bill 105, now under consideration, believes that Act 53 will increase the expenses

of criminal trials, but upon investigation we are led to believe that such will not be the result. Moreover Act 53 limits the per diem fee to one dollar besides the mileage fees for distance actually and necessarily traveled. Heretofore the amount to which witnesses in criminal cases attending upon the Circuit Courts and Grand Juries in criminal cases has not been fixed by statute, and upon conferring with the Attorney General we learn that he is of opinion that the provisions of Act 53 will not increase the expenses in such cases.
