Under suspension of the Rules, Senator Hayselden introduced a Bill (S. B. No. 109) entitled “An Act to Abolish the Office of Commissioner of the Department of Public Instruction of the Territory of Hawaii."

The Bill was read first time by title and, upon motion of Senator Hayselden, seconded by Senator Brown, passed First Reading and was referred to the Printing Committee.

A Communication (No. 38) from the Secretary of Hawaii. irforming the Senate that the Governor had signed Acts 63 and 64, was read by the Clerk as follows:

The Communication was ordered received and placed on file. At 2:58 o'clock, upon motion of Senator Lane, seconded by Senator Dowsett, the Senate tock a recess subject to the call

of the Chair.

At 3:10 o'clock the Senate reconvened, proceeding with the consideration of House Bill No. 213 entitled "An Act to Amend Section 1 of Act 93 or the Session Laws of 1905, as amended by Act 15 of the Session Laws of 1907." on Second Reading.

Senator Dowsett moved to insert the words "and fines and cests in all criminal cases" after the word "fees" in line 6 of Section 1. Seconded by Senator Lane and carried.

Senator Dowsett moved to add the following at the end of Section I:

"1. The Auditor of the Territory shall cn the last legal day or each and every month issue a monthly warrant on the Treasurer of the Territory in favor of each County Treasurer, such monthly warrants for the last half year from July to December, 1905, inclusive, shall be in an amount not less than ten per cent., ard thereafter in an amount not less than fifteen per cent., of the estimated Tax payable to each County within every half year, and within the first fifteen days of January and July in each year, the said Auditor of the Territory shall issue a Warrant on the Treasurer of the Territory in favor of each County Treasurer for an amount equal to any balance in favor of each County under the provisions of this Act, less the amount of the Warrants issued and interest paid for such Warrants, during the last preceding six months.

2. When any such Warrant is presented to the Treasurer of the Territory for payment, if there is money in the Treasury for that purpose, he shall pay the same and write or stamp on the face thereof "Paid," the date of payment and sign his name thereto, but when the same is not paid for want of funds, the Treasurer of the Territory shall first register the same in a book to be kept for that purpose, shall then endorse thereon "Not paid for want of funds" with the date of presentation, and sign his name thereto and return said Warrant to the party presenting the same. From that time until paid the Warrant shall bear five (5) per cent interest per annum and it shall thereafter be paid in the order of its registration out of the funds properly chargeable therewith.

3. When there are sufficient moneys in the Treasury to pay the Warrants drawing interest, the Treasurer of the Territory shall give notice for one week in some newspaper published in each County, or, if none is published therein, by written notice posted upon the Court House docr at the County Seat for the same length of time, stating therein that he is ready to pay such Warrants. Ten days after the first publication or posting of such notice, such warrants cease to draw interest.

4. When the Treasurer pays any Warrant upon which interest is due, he shall note on the Warrant the amounts of interest paid therein, and enter on his account the amount of such interest from the principal."

Seconded by Senator Lane and carried.

Senator Lane moved that the Bill pass Second Reading as amended. Seconded by Senator Dowsett and carried.

Upon suspension of the Rules, Senator Dowsett for the Ways and Means Committee reported verbally on House Bill No. 84, recommending that the Bill be laid on the table.

The Report was ordered received.

Senator Lane moved that House Bill No. 84 be laid on the table. Seconded by Senator Coelho and carried.

At 3:22 o'clock, upon motion of Senator Lane, seconded by Senator Brown, the Senate adjourned.

The Senate met, pursuant to adjournment, at 9:30 o'clock. After prayer by the Chaplain, the Roll was called showing Senators Chillingworth and Dowsett absent.

The Journal of the Forty-Sixth Day was read and, upon motion of Senator Coelho, seconded by Senator Lane, approved as read.

Senator Lane for the Printing Committee reported Senate Pills Nos. 106 and 107 printed and ready for distribution. The Report was ordered accepted.

Senator Woods presented the Report (No. 19) of the Special Committee of Hawaii Senators on House Bill No. 5 as follows:

Sir:-Your Special Committee, consisting of the members of the Senate from the Island of Hawaii, to whom was referred House Bill No. 5 entitled "An Act to alter the boundaries of the First Senatorial District by dividing the same into two Senatorial Districts, and to apportion the Senators to be elected therefrom," begs leave to report that they have had the same under careful consideration.

Third Reading of Senate Bill No. 98 entitled "An Act to Provide for Biennial Reports to the Legislature of the Territory of Hawaii by County Officers."

The Bill passed Third Reading on the following showing of Ayes and Noes:

Ayes: Senators Brown, Coelho, Gandall, Hewit, Kalama, Knudsen, Lane, McCarthy, Makekau, Smith and Woods-11. Noes: Senator Bishop-1.

Not Present: Senators Chillingworth, Dowsett and Hayselden-3.

Third Reading of House Bill No. 34 entitled "An Act Amending Sections 1122, 1123 and 1126, Chapter 94 of the Revised Laws of Hawaii, relating to Leper Settlement and Hospitals and adding a new Section thereto."

Senator Lane moved to defer action on the Bill. Seconded by Senator Knudsen and carried.

Third Reading of House Bill No. 213 entitled "An Act to Amend Section 1 of Act 93 of the Session Laws of 1905, as amended by Act 15 of the Session Laws of 1907."

Senator Makekau moved to insert the words "and all license fees obtained for licenses granted to operate in each County" after the word "County" in line 7 and strike cut the words "all license fees and" in line 6 of Section I. Seconded by Senator Woods and carried.

Senator Lane moved to insert the words "Section 1" before the words "of Act 59" in line 1 of Section 1. Seconded by Senator Dowsett and carried.

The Bill passed Third Reading as amended on the following showing of Ayes and Noes:

Ayes: Senators Brown, Coelho, Dowsett, Gandall, Hayselden, Hewitt, Kalama, Knudsen, Lane, McCarthy, Makekau, Smith, Woods and Bishop-14.
