Senator Smith moved that the Report of the Committee be received and laid on the table to be considered with the Bill. Seconded by Senator Lane and carried.

Senator Makekau gave notice of intention to introduce a Bill entitled "An Act to Amend Act 39 of the Session Laws of 1905, by Adding a new Section in Chapter 4 to be called Section 3A." Under suspension of the Rules, Senator Makekau introduced a Bill (S. B. No. 76) entitled "An Act to Amend Act 39 of the Session Laws of 1905, by Adding a new Section in Chapter 4 to be called Section 3A."

Senator Makekau moved that the Bill pass First Reading and be referred to the Printing Committee. Seconded by Senator Brown and carried.

The Senate proceeded with the Order of the Day.

Third Reading of Senate Bill No. 49 entitled "An Act to Establish the Rights of Inn-Keepers and like persons with respect to Baggage and Property of Guests."

Third Reading of Senate Bill No. 65 entitled "An Act Amending Chapter 104 of the Revised Laws of Hawaii and providing for an additional Section therein to be known as Section 1521A, providing for payment to Public Accountants of Claims in favor of the Territory under Protest."

Senator Dowsett moved to amend by striking out the word "therefor" in line 8 of Section I and inserting in lieu thereof the words "of such protest." Seconded by Senater Smith and carried.

Senater Dowsett moved to amend by inserting the words "by the said Public Accountant" after the word "transferred" in line 22 of Section 1. Seconded by Senator Hewitt and carried.

Senator Dowsett moved to amend by inserting the word "final" before the word "decision" and by striking out the words "by the court" in line 24 of Section 1. Seconded by Senator Coelho and carried.

Senator Dowsett moved to amend by inserting the word "final" after the word "the" in line 24 of Section 1 and by inserting the word "cause" in lieu of the word "court" in line 25 of Section 1. Seconded by Senator Lane and carried.

Senater Dowsett moved to insert the words "in which the cause was finally determined" atter the word "court" in line 29 of Section 1. Seconded by Senator Lane and carried.

The Bill passed Third Reading as amended on the following showing of Ayes and Noes:

Senator Chillingworth moved to defer action on the Bill for one week. Seconded by Senator Hewitt.

Senator Dowsett moved as an amendment that the Bill be recommitted to the Judiciary Committee. Seconded by Senator Coelho.

Senator Chillingworth withdrew the motion to defer action on the Bill for one week.

Senator Lane raised the point of order that after the Bill is read through on Third Reading it cannot be recommitted to a Committee.

The Chair considered the point well taken.

Senator Chillingworth moved to defer action on the Bill for one week. Seconded by Senator Brown and carried.

Second Reading of House Bill No. 74 entitled "An Act making Appropriations for the Departmental use of the Territory." Referred to the Ways and Means Committee.

Senator Smith moved that the Report of the Committee on the Bill be adopted. Seconded by Senater Chillingworth and carried. Second Reading of Senate Bill No. 68 entitled "An Act to Amend Section 212 of the Revised Laws of Hawaii."

Senator Smith moved that the Report of the Committee on the Bill be adopted. Seconded by Senator Hayselden and carried. Under suspension of the Rules, Senator Lane for the Printirg Committee reported Senate Bills Nos. 73, 74 and 75 printed and ready for distribution.

Senator Makekau gave notice of intention to introduce a Bill entitled "An Act to Amend Paragraph 1 of Section 62 of Act 39 of the Session Laws of 1905."

Under suspension of the Rules, Senator Makekau introduced a Pill (S. B. No. 77) entitled "An Act to Amend Paragraph I of Section 62 of Act 39 of the Session Laws of 1905."

The Bill was read first time by title and, upon motion of Senator Makekau, seconded by Senator Brown, passed First Reading and was referred to the Printing Committee.

At 2:05 o'clock, upon motion of Senator Dowsett, seconded by Senator Coelho, the Senate adjourned.
