I have the honor to transmit, herewith, House Bill No. 94, which this day passed Third Reading in the House of Representatives of the Territory of Hawaii.

The Communication was ordered received and placed en file. First Reading of House Bill No. 94 entitled "An Act to Amend Chapter 89 of the Revised Laws of the Territory of Hawaii, relating to the Practice of Medicine and Surgery."

Senator Knudsen moved that the Bill pass First Reading. Seconded by Senator Smith and carried.

Under suspension of the Rules, Senator Hewitt presented the Report (No. 78) of the Committee on Education on Senate Bill No. 66 as follows:

President of the Senate.

Sir: Your Committee on Education to whom was referred Senate Bill No. 66, beg leave to report. The Bill amends Section 206, Revised Laws of Hawaii which reads "All schools established and maintained by the department in accordance with laws are public schools. All other schools are private schools."

The amendment provides that all other schools established and conducted in compliance with law are private schools. Your Committee therefore recommend the passage of the Bill.

Senator Chillingworth moved that the Report of the Committee on the Bill be adopted. Seconded by Senator Lane and carried.

Under suspension of the Rules, Senator Hewitt presented the Report (No. 79) of the Committee on Education on Senate Bill No. 67 as follows:

President of the Senate.

Sir: Your Committee on Education beg leave to report on Senate Bill No. 67 as follows:

The object of the Bill is to amend Section 211, Revised Laws, of Hawaii, and provides that any school where English is not the basis and medium of instruction is not a public or private school under the provisions of the Chapter, and attendance at such school shall not be considered a compliance with law. Your Committee consider the amendment to be proper and recommend that the Bill pass.

The Senate met, pursuant to adjournment, at 10 o'clock, the Vice-President in the Chair.

After prayer by the Rev. W. N. Lono, the Roll was called showing Senators Knudsen and Bishop (sick) absent.

The Journal of the Twenty-Fourth Day was read and, upon motion of Senator Dowsett, seconded by Senator Brown, approved as read.

A Communication (No. 16) from the Secretary of Hawaii. informing the Senate that the Governor had signed Act 17, was read by the Clerk as follows:

The Communication was ordered received and placed on file. Senator Smith presented the Report (No. 80) of the Judiciary Committee on Senate Concurrent Resolution No. 6 as follows:

Sir:-The Judiciary Committee report consideration of Concurrent Resolution No. 6 introduced by Senator John C. Lane, and recommend the adoption of the Resolution.

The object of the Resolution is to enable the several counties to obtain from the Territory from time to time such of the public property and utilities as may be needed for public benefit.

Senator Lane moved that the Report of the Committee be adopted. Seconded by Senator Brown and carried.

Senator Smith presented the Report (No. 81) of the Judiciary Committee on House Bill No. 120 as follows:

President of the Senate.

Sir:-The Judiciary Committee have had under consideration House Bill No. 120, entitled "An Act relating to the Registration of co-partnership, and amending Section 2653 of the Revised Laws of Hawaii," and recommend the passage of the Bill.

The Section relates to the registering of co-partnership and amends Section 2653 by adding at the end of the Section the following, "Such statement shall be acknowledged by each of the partners before a notary public in the manner provided by law for the acknowledgment of deeds." The purpose is obviously to add certainty and to prevent partners from denying their liability.

Senator Smith moved that the Report of the Committee be received and laid on the table to be considered with the Bill. Seconded by Senator Hewitt and carried.

Senator Hewitt presented the Report (No. 82) of the Comm.ttee on Education on Senate Bill No. 68 as follows:

President of the Senate.

Sir:-Your Committee on Education, to whom was referred Senate Bill No. 68, respectfully recommend that the Bill pass. The Amendment of Section 212 strikes out the words "both inclusive" thus making it agree with Sections 217, 218 and making all the Sections to uniformly agree.
