Senator Smith moved to amend the Bill in accordance with the recommendations of the Committee. Seconded by Senator Knudsen and carried.

The Bill passed Third Reading as amended on the following Ayes and Noes:

The Communication was ordered received and placed on file. Senator Smith presented the Report (No. 61) of the Judiciary Committee on House Bill No. 47 as follows:

Sir: The Judiciary Committee reports consideration of House Bill No. 47, entitled "An Act to Amend Section 115 of the Revised Laws of Hawaii, relating to Holidays." Under the provisions of Section 115 eight legal holidays are established, as follows:

The first day of January,

The twenty-second day of February,

The thirtieth day of May,

The eleventh day of June,

The fourth day of July,

The first Monday in September, known as labor day,
The third Saturday in September, and

The twenty-fifth day of December.

The Bill under consideration provides for an additional hollday on the twelfth day of February which is the anniversary of the birth of Abraham Lincoln.

The Bill is in due form and the advisability of enacting it would appear to be largely a matter of policy and the Committee makes no definite recommendation in regard to the matter.

There are reasons for the view that if another holiday is created that some day should be chosen which would commemorate an event in the history of Hawaii or in memory of some noted Hawaiian; and further it has been suggested that, if a new holiday is to be added, one should be chosen if possible which would tend to distribute the holidays more evenly throughout the year.

This matter is, however, one largely of opinion, and doubtless views will differ upon the subject.

We therefore report the Bill back for such action as may be deemed best.

Senator Smith moved that the Report of the Committee be laid on the table to be considered with the Bill. Seconded by Senator Brown and carried.

Senator Smith presented the Report (No. 62) of the Judiciary Committee on Senate Bill No. 59 as follows:

Sir:

The Judiciary Committee has had under consideration Senate Bill No. 59, entitled "An Act to Amend Section 1680 of the Revised Laws of the Territory of Hawaii relating to Clerks, Deputy Clerks and Assistant Clerks; such assistant clerks to be ex-officio bailiffs," and recommends the passage of the Bill.

Section 1680 of the Revised Laws provides for the appointment of the clerks and deputy clerks of the Judiciary Department and defines their duties. It also provides that there should be one deputy clerk appointed by each of the circuit judges and subject to be removed by the judge. It also provides that any deputy clerk may be removed by the Supreme Court for inefficiency or misconduct.

The amendment under discussion relates to the deputy clerks appointed by the circuit judges and provides for the appointment of assistant clerks who shall also act as bailiff. The provision reads as follows:

"There may also be one assistant clerk appointed and removable by each circuit judge with like powers and duties of the deputy clerks, and each assistant clerk so appointed by a circuit judge shall be ex-officio bailiff for the court of the circuit judge by whom he shall be appointed."

At present the judge of each circuit court has a clerk and a bailiff and it would seem very convenient to have the bailiff assist the clerk but there is now no authority for appointing him an assistant clerk.

The judges think that one person can perform the duty of assistant clerk and bailiff and desire the authority of law for the appointment of such an assistant.

The Bill meets with the approval of the judges and it would appear to be desirable that the provision should be made.

Senator Smith presented the Report (No. 63) of the Judiciary Committee on House Bill No. 29 as follows:

President of the Senate.

Sir: The Judiciary Committee has had under consideration House Bill No. 29, entitled "An Act to Regulate the Purchase of Material and Supplies by the respective Counties in the Territory of Hawaii," and recommends that the Bill be laid upon the table.

The Bill provides that no material or supplies of any nature shall be purchased by the Board of Supervisors of the Counties in the Territory of Hawaii from any person or persons not a citizen or citizens of the United States.

We believe this provision to be in conflict with the spirit, if not the letter, of the constitution; also in conflict with Treaty provisions; and furthermore that the enactment of such a law would in any event be unwise.

Senator Smith for the Special County Committee reported verbally that it had the various matters referred to it under consideration and asked for further time. Granted.

Senator Chillingworth for the Joint Committee on the Nuuan'ı Dam matter reported verbally that it had ceased taking testimony to await the arrival of Schuyler, the Dam Expert, and asked for further time. Granted.
