Senator Lane moved that all items under the head of "Department of Public Instruction" already disposed of be recons'dered. Seconded by Senator Knudsen and carried.

The motion to refer all items under the head of "Department of Public Instruction" to the Committee on Education was then put and carried.

Under suspension of the Rules, Senator Lane moved that all items under the head of "Board of Health" be referred to the Committee on Public Health. Seconded by Senator Coelho and carried.

Under suspension of the Rules, Senator Dowsett moved that all items under the heads of "Judiciary Department," and "De

partment of the Attorney General" be referred to the Judiciary Committee. Seconded by Senator Hewitt.

Senator Chillingworth raised the point of order that Senator Dowsett could not move for the reconsideration of the items, having voted in the minority on the previous motion to refer to the Judiciary Committee.

The Chair considered the point not well taken.

Senator Dowsett withdrew his motion, and Senator Lane moved that the item:

Second Reading of Senate Bill No. 44 entitled "An Act Amending Section 1223 of the Revised Laws of Hawaii, relating to the Exemption from Taxation of Property used in Certain Industries."

Under suspension of the Rules, Senator Makekau offered the following Resolution (No. 13) relating to the Hilo, LaupahoeLoe and Waimea Water Works:

RESOLUTION.

RESOLVED, that the Superintendent of Public Works is hereby requested to answer the following questions, to wit: 1. When the Hilo, Laupahoehoe and Waimea Water Works were established?

2. How much it cost the Territorial Government for permanent improvements for each of said Water Works?

3. How much it cost the Territorial Government for repairs to each of said Water Works?

4. How much income has been received by the Territorial Government from each of the Water Works from the time they were established to date?

AND IT IS FURTHER RESOLVED that the Clerk of the Senate is hereby ordered to send a certified copy of this Resolution to the Superintendent of Public Works.

The Senate reconvened at 2 o'clock.

Under suspension of the Rules, Senator Coelho offered the following Resolution (No. 14) that the sum of $8,000.00 be inserted in the Appropriation Bill to cover the cost of fighting forest, grass and brush fires on Government Land:

RESOLUTION.

BE IT RESOLVED by the Senate of the Territory of Hawaii that the sum of Eight Thousand Dollars ($8,000.00) be inserted in the Appropriation Bill for the biennial period ending June 30, 1909, to cover the cost of fighting forest, grass and brush fires on Government lands or on other lands where the spreading of such fires might prove injurious to Government property. This appropriation to be expended by the Board of Commissioners of Agriculture and Forestry only with the approval of the Governor.

Second Reading of Senate Bill No. 42 entitled "An Act Incorporating the City and County of Honolulu."

Senator Lane moved that the Bill be referred to the Special County Committee. Seconded by Senator Knudsen and carried. Under suspension of the Rules, Senator Lane gave notice of intention to introduce a Bill entitled "An Act Authorizing the Appointment by the Assessor of each Taxation Division, Deputy Assessors in Election Precincts."

Under suspension of the Rules, Senator Lane introduced a Bill (S. B. No. 45) entitled "An Act Authorizing the Appointment by the Assessor of each Taxation Division, Deputy Assessors in Election Precincts."

Senator Lane moved that the Bill pass First Reading and be referred to the Printing Committee. Seconded by Senator Brown and carried.

Senator Dowsett for the Ways and Means Committee reported verbally on Senate Bill No. 31 that in view of the action taken referring the Appropriation Bill to various Committees, the Committee desired to return the Bill with the recommendation that it be printed.

The Report of the Committee was received and the Bill ordered referred to the Printing Committee.

At 2:10 o'clock, upon motion of Senator Makekau, sconded by Senator Hewitt, the Senate adjourned.

The Senate met, pursuant to adjournment, at 10 o'clock. After prayer by the Chaplain, the roll was called showing all Senators present.

The Journal of the Tenth day was read and, upon motion of Senator Kalama, seconded by Senator Coelho, approved as read.

A communication (No. 6) from the Superintendent of Public Works, relating to a recommendation adopted by the Board of Health relative to certain lands in the Waikiki District, Honolulu, was read by the Clerk as follows:

DEPARTMENT OF PUBLIC WORKS,

Honolulu, T. H., March 4, 1907.

Honorable E. Faxon Bishop,

President of the Senate,

Territory of Hawaii.

Sir: I have the honor to submit to you statement and recommendation adopted by the Board of Health on February 21st, 1906, relative to certain lands in the Waikiki District, Honolulu, County of Oahu.

Section 1025 of the Revised Laws of the Territory provides that "whenever in the opinion of the board of health any tract or parcel of land situated in the district of Honolulu, Island of Oahu, shall be deleterious to the public health in consequence of being low, and at times covered or partly covered by water, or of being situated between high and low water mark, or of being improperly drained, or incapable by reasonable expenditure of effectual drainage, or for other reason in an insanitary or dangerous condition, it shall be the duty of the board of health to report such fact to the superintendent of public works, together with a brief recommendation of the operation deemed advisable to improve such land."

Sections 1026 to 1031 inclusive give authority to the superintendent of Public Works to compel owners of such land to carry out the improvements recommended by the board of health and provides for a commission of two to act in conjunction with the district magistrate to determine whether the lands in question are deleterious to public health, and the decision of a majority of the Commissioners shall be final and conclusive upon all parties in interest.

By referring to the report of Mr. L. E. Pinkham, President of the Board of Health, it will be seen that the project is such a large one that it would be impossible to carry out the proposed improvement without additional legislative action which might possibly include funds for condemning cer
