Senator Coelho moved that the Section pass as read. Seconded by Senator Knudsen and carried.

Section 8. Senator Coelho moved to insert the words "One Dollar and Fifty Cents" after the word "receive" in line 10. Seconded by Senator Smith and carried.

Senator Coelho moved to insert the figures "12" in line 18 before the word "days." Seconded by Senator Smith and carried.

Senator Coelho moved to insert the figures "12" in line 21 before the word "days." Seconded by Senator Smith and carried.

Senator Smith moved to insert the words "of any estray bearing the same brand or mark" after the word “mark” in line 14. Seconded by Senator Coelho and carried.

Senator Knudsen moved that the Section pass as amended. Seconded by Senator Smith and carried.

Section 9. Senator Coelho moved to strike out the words "accounted for by the Treasurer from the special deposit fund to the district road tax fund to be used as road taxes" in lines 12, 13 and 14 and insert in lieu thereof the words "become a county realization." Seconded by Senator Smith and carried. Senator Smith moved that the Section pass as amended. Seconded by Senator Coelho and carried.

Section II. Senator Dowsett moved that the Section pass as read. Seconded by Senator Coelho and carried.

Section 12. Senator Coelho moved that the Section pass as read. Seconded by Senator Lane and carried.

Section 13. Senator Smith moved to strike out the words "The owner of such land shall not be entitled to claim any damages for such trespass other than said sum of twenty-five cents.” in lines 6 and 7. Seconded by Senator Woods and carried.

Senator Coelho moved to strike out the figures "11" in line 2 and insert in lieu thereof the figures "12." Seconded by Senator Lane and carried.

Senator Dowsett moved that the Section pass as amended. Seconded by Senator Lane and carried.

Section 14. Senator Coelho moved to strike out the figures "12" in line 2 and insert in lieu thereof the figures "11." Seconded by Senator Lane and carried.

Senator Coelho moved that the Section pass as amended. Seconded by Senator Lane and carried.

Section 15. Senator Coelho moved to strike out the figures "11" in line 2 and insert in lieu thereof the figures "12" and to

strike out the figure "7" in line 21 and insert in lieu thereof the figure "8." Seconded by Senator Lane and carried.

Senator Coelho moved that the Section pass as amended. Seconded by Senator Dowsett and carried.

Senator Dowsett moved to reconsider Section 13. Seconded by Senator Knudsen and carried.

Senator Smith moved that the Bill be recommitted to the Committee on Public Lands. Seconded by Senator Kalama and carried.

Under suspension of the Rules, Senator Lane gave notice of intention to introduce a Bill entitled "An Act Incorporating the City and County of Honolulu."

Senator Chillingworth gave notice of intention to introduce the following Bills:

"An Act to Amend Section 2944 of the Revised Laws of Hawaii, Relating to the Crime of Burglary."

"An Act to Amend Section 3152 of the Revised Laws of Hawaii by Increasing the Punishment for the Crime of having Sexual or Carnal Intercourse with a Female under the Age of Fourteen Years."

Under suspension of the Rules, Senator Chillingworth introduced a Bill (S. B. No. 32) entitled "An Act to Amend Section 3152 of the Revised Laws of Hawaii by increasing the Punishment for the Crime of Having Sexual or Carnal Intercourse with a Female under the Age of Fourteen Years."

Senator Chillingworth moved that the Bill pass First Reading and be referred to the Printing Committee. Seconded by Senator Lane and carried.

Under suspension of the Rules, Senator Chillingworth introduced a Bill (S. B. No. 33) entitled "An Act to Amend Section 2944 of the Revised Laws of Hawaii, relating to Burglary."

Senator Lane moved that the Bill pass First Reading and be referred to the Printing Committee. Seconded by Senator Coelho and carried.

At 3:27 o'clock Senator Kalama moved to adjourn. Seconded by Senator Coelho and carried.

SIXTH DAY.

Wednesday, February 27th, 1907.

The Senate met, pursuant to adjournment, at 10 o'clock. After prayer by the Chaplain, the roll was called showing Senator Kalama absent.

The Journal of the Fifth Day was read and, upon motion of Senator Lane, seconded by Senator Knudsen, approved as read. A communication (No. 3) from the Secretary of Hawaii, informing the Senate that the Governor had signed Act 1, was read by the Clerk as follows:

Sir: I have the honor to inform you that the Governor has this day signed Senate Bill No. 15, Act 1, An Act Making Special Appropriation for the Purpose of Defraying the Expenses of Such Senators and Members of the House of Representatives of the United States as May Visit the Territory of Hawaii, as Guests of the Territory, During the Year A. D. 1907.

The communication was ordered received and placed on file. Senator Lane for the Printing Committee reported Senate Bills Nos. 6, 7, 30, 32 and 33 printed and ready for distribution. Senator Hewitt for the Committee on Education reported verbally on Senate Bill No. 16 recommending that the Bill pass Second Reading.

Senator Coelho moved that the Report be received to be considered with the Bill. Seconded by Senator Lane and carried. Senator Makekau gave notice of intention to introduce a Bill entitled "An Act to Amend Act 39 of the Session Laws of 1905, entitled 'An Act Creating Counties within the Territory of Hawaii, and Providing for the Government thereof.'"

Under suspension of the Rules, Senator Makekau introduced a Bill (S. B. No. 34) entitled "An Act to Amend Act 39 of the Session Laws, 1905, entitled 'An Act Creating Counties within the Territory of Hawaii, and Providing for the Government thereof.'"

Senator Woods moved that the Bill pass First Reading and he referred to the Printing Committee. Seconded by Senator Coelho and carried.

Senator Brown offered the following Resolution (No. 7) that $12,500.00 be inserted in the Appropriation Bill for School Houses in the District of Hilo:

RESOLUTION.

BE IT RESOLVED by the Senate of the Territory of Hawaii, that the sum of Twelve Thousand Five Hundred Dollars ($12,500.00) may be inserted in the Appropriation Bill for the building of School Houses in the District of Hilo, as follows:

Senator Makekau moved that the Resolution be adopted. Seconded by Senator Brown.

Senator Knudsen moved that the Resolution be referred to the Committee on Education. Seconded by Senator Hayselden. The motion to refer the Resolution to the Committee on Education was then put and carried.

The Senate proceeded with the Order of the Day.

Third Reading of Senate Bill No. 2 entitled "An Act to Encourage Diversified Industries."

The Bill passed Third Reading on the following showing of Ayes and Noes:

Ayes: Senators Brown, Chillingworth, Coelho, Dowsett, Gandall, Hayselden, Hewitt, Kalama, Knudsen, Lane, McCarthy, Makekau, Smith, Woods and Bishop-15.

Noes: 0.

Third Reading of House Bill No. 13 entitled "An Act to Appropriate Money for the Purpose of Defraying the Expenses of the Session of the House of Representatives, Territory of Hawaii, of the year 1907, from the Public Treasury."

The Bill passed Third Reading on the following showing of Ayes and Noes:

Ayes: Senators Brown, Chillingworth, Coelho, Dowsett, Gandal!, Hayselden, Hewitt, Kalama, Knudsen, Lane, McCarthy, Makekau, Smith, Woods and Bishop-15.

Second Reading of Senate Joint Resolution No. 1.

Senator Coelho raised the point of order that the appropriation intended to be carried with the Joint Resolution is contrary to the Organic Act. The Chair considered the point well taken. Senator Smith appealed against the ruling of the Chair, which ruling, was not sustained by a vote of 7 to 3.

Senator Lane moved that the Joint Resolution pass Second Reading. Seconded by Senator Smith.

Senator McCarthy moved as an amendment that Senate Bill No. 21 take the place of Senate Joint Resolution No. 1 and to amend the title to read "An Act to Provide for a Tax Commission." Seconded by Senator Smith.

Senator Dowsett moved that Senate Bill No. 21 and Senate Jo'nt Resolution No. 1 be referred to the Judiciary Committee. Seconded by Senator Hewitt and carried.

Second Reading of Senate Bill No. 6 entitled "An Act to Amend Section 1793, Chapter 119 of the Revised Laws of Hawaii, Relating to Juries and Trial by Jury."

Referred to the Judiciary Committee.

Second Reading of Senate Bill No. 7 entitled "An Act to Amend Section 2210 of the Revised Laws of Hawaii as amended by Act II of the Session Laws of 1905."
