The Senate met, pursuant tc, adjournment, at 9:30 o'clock. After prayer by the Chaplain, the roll was called showing Senator Chillingworth absent.

The Journal of the Fifty-Ninth Day was read and, upon motion of Senator Lane, seconded by Senator Dowsett, approved as read:

A Communication (No. 51) from the Secretary of Hawaii, informing the Senate that the Governor had signed Acts 118, 119, 120 and 121, was read by the Clerk as follows:

House Bill No. 219, Act 120, An Act to Amend Chapter 17 of the Revised Laws of Hawaii by adding a new Section thereto to be known as Section 213A.

House Bill No. 235, Act 121, An Act to Provide a Sinking Fund for the Redemption or Purchase of Bonds issued by any County of the Territory of Hawaii.

Senator Smith moved that Senate Bill No. 37 be laid on the table. Seconded by Senator Knudsen and carried.

Senator Smith for the Judiciary Committee reported verbally on Senate Bill No. 54, recommending that the Bill be laid on the table.

Senator Smith moved that Senate Bill No. 54 be laid on the table. Seconded by Senator Dowsett and carried.

Senator Smith for the Judiciary Committee reported verbally on Senate Bill No. 34, recommending that the Bill be laid on the table.

The Report was ordered received.

Senator Smith moved that Senate Bill No. 34 be laid on the table. Seconded by Senator Knudsen and carried.

Senator Knudsen for the Special Committee on Loan Appropriations reported verbally on Senate Bill No. 102, recommending that the Bill be laid on the table.

The Report was ordered received.

Senator Knudsen moved that Senate Bill No. 102 be laid on the table. Seconded by Senator Smith and carried.

Senator Coelho offered the following Resolut on (No. 45) requesting the Auditor of the Territory to advertise for Claims against the Territory outstanding and unpaid up to, June 30th, 1907:

RESOLUTION.

RESOLVED that the Auditor of the Territory of Hawaii be and he is hereby requested to advertise for all claims against the Territory of whatsoever nature which may be outstanding and unpaid up to June 30, 1907, including such claims against the Counties created under Act 31 of the Session Laws of 1903 which are also outstanding and unpaid, to be filed in the office of the said Auditor not later than November 30, 1908; and to submit said claims to the Legislature of 1909.

Senator Coelho moved that the Resolution be adopted. Seconded by Senator McCarthy and carried.

Senator Coelho offered the following Resolution (No. 46) that the Clerks of the several Circuit Courts be requested to report all cases and matters still pending to the Chief Justice of the Judiciary Department:

RESOLUTION.

RESOLVED that the Honorable Walter F. Frear, Chief Justice of the Judiciary Department of the Territory of Hawaii, be and he is hereby requested to direct the Clerks of the several Circuit Courts to forthwith examine all records of their respective courts and report to said Justice all cases and matters which are still pending and which should be terminated, and to append to such report the cause of failure to determine and close such proceedings where neglect is apparent; and to submit said reports to the Legislature of 1909 with such recommendations as the said Justice or his associates may

suggest.

Senator Coelho moved that the Resolution be adopted. Seconded by Senator Lane.

Senator Smith moved to amend by inserting the word "probate" before the words 'cases and matters." Senator Coelho accepted the amendment which carried.

The Resolution as amended was adopted.

Senator Coelho offered the following Resolution (No. 47) that heads of Departments and Bureaus and Boards of Supervisors have reports ready by February 1st, 1909:

RESOLUTION.

RESOLVED that the heads of the several Departments or Bureaus of the Territory and Board of Supervisors of each County be and they are hereby requested to prepare and have their respective reports to the Legislature of 1909 ready for submission to the members of the Legislature of 1909 the first day of February, 1909, or as soon thereafter as may be possible so to do, in order that the members of the said Legislature may be able to have prepared the necessary measures suggested to promote the success of the business of the people in charge of said officials.

Senator Lane moved that action on the Message be deferred until 2 o'clock this afternoon. Seconded by Senator Kalama and carried.

The Message (No. 27) of the Governor, vetoing House Bill No. 34, was read by the Clerk.

Senator Coelho moved that action on the Message be deferred. until 2 o'clock this afternoon. Seconded by Senator Lane and carried.

The Message (No. 28) of the Governor, vetoing House Bill No. 213, was read by the Clerk.
