I have the honor to transmit herewith House Bill No. 241, which this day passed Third Reading in the House of Representatives of the Territory of Hawaii.

The Communication was ordered received and placed on file. First Reading of House Bill No. 241 entitled "An Act to Amend Section 1122, Chapter 94 of the Revised Laws of Hawaii, relating to Leper Settlement and Hospitals, and to add a new Section thereto to be known as Section 1122A."

Senator Dowsett moved that the Bill pass First Reading. Secended by Senator Hewitt and carried.

At 3:30 o'clock, upon motion of Senator Kalama, seconded by Senator Hayselden, the Senate took a recess subject to the call of the Chair.

At 3:40 o'clock the Senate reconvened.

Under suspension of the Rules, Senator Smith reported verbally for the Judiciary Committee on the Message (No. 23) of the Governor, vetcing Senate Bill No. 76, that the Bill as passed was defective and the Committee could not recommend overriding the Veto.

The Report was ordered received.

Senator Makekau moved that the Bill pass notwithstanding the Veto of the Governor. Seconded by Senater Lane and lost on the following showing of Ayes and Noes:

Ayes: Senators Brown, Chillingworth, Coelho, Hewitt, Kalama, Lane, McCarthy, Makekau and Woods-9.

Nees: Senators Dowsett, Gandall, Hayselden, Knudsen, Smith and Bishop-6.

Senator Dowsett moved to reconsider the action taken on House Bill No. 197. Seconded by Senator Knudsen and carr.ed. Third Reading of House Bill No. 197 entitled "An Act to Encourage the extermination of Mongoose.'

Senator Dowsett moved to insert a new Section to read "Section 7. Any person harboring, feeding or in any way caring for a mongoose, shall be guilty of a misdemeanor and upon convictien, punished by a fine not exceeding fifty dollars or by imprisonment not exceeding fifty days, or by both such fine and imprisonment."

Seconded by Senator Lane and carried.

Senator Dowsett moved that Section 7 be renumbered Section 8. Seconded by Senator Lane and carried.

The Bill passed Third Reading as amended on the following showing of Ayes and Noes:

Ayes: Senators Chillingworth, Coelho, Dowsett, Gandall, Hayselden, Hewitt, Kalama, Knudsen, Lane, McCarthy and Woods

-II.

Noes: Senators Brown, Makekau, Smith and Bishop-4. Senator Smith moved that House Bill No. 116 be taken off the table. Seconded by Senater Knudsen and carried.

Senator McCarthy moved that the Bill be referred to the Judiciary Committee. Seconded by Senator Knudsen and carried. Under suspension of the Rules, Senator Hewitt for the Committee on Education reported verbally on House Bill No. 219, recommending that the Bill pass.

The Report was ordered received.

Second Reading of House Bill No. 219 entitled "An Act to Amend Chapter 17 of the Revised Laws of Hawaii by adding a new Section thereto to be known as Section 213A.”

Senator McCarthy moved that the Bill pass Second Reading. Seconded by Senator Hewitt and carried.

Senator Makekau moved to reconsider the action taken on Senate Bill No. 117. Seconded by Senator Dowsett and carried. Second Reading of Senate Bill No. 117 entitled "An Act to Amend Section 1 of Act 93 of the Session Laws of 1905 as amended by Act 15 of the Session Laws of 1907."

Senator Makekau moved to strike out the word "criminal" in line 5 of Section 1 and insert in lieu thereof the word "all" and insert the words "in which no appeals are taken" in line 6 of Section I after the word "cases." Seconded by Senator Woods and lost.

Senator Coelho moved that the Bill pass Second Reading. Seconded by Senator Hayselden and carried.

At 4:36 q'clock, upon motion of Senator Coelho, seconded by Senator Hayselden, the Senate adjourned.

The Senate met, pursuant to adjournment, at 9:30 o'clock. After prayer by the Chaplain, the Roll was called showing Senator Chillingworth absent.

The Journal of the Fifty-Sixth Day was read and, upon motion of Senator Lane, seconded by Senator Coelho, approved as read.

A Communication (No. 305) from the House of Representatives, transmitting House Bill No. 242, was read by the Clerk as follows:
