House Bill No. 187, Act 96, An Act to Amend Chapter 102 of the Revised Laws of Hawaii by adding thereto Ten Sections to be known as Sections 1379A, 1418A, 1418B, 1418C, 1418D, 1418E, 1418F, 1418G, 1418H, and 14181, relating to licenses.

House Bill No. 194, Act 97, An Act to Provide a Sinking Fund for the Redemption or Purchase of Territorial Bonds.

The Communication was ordered received and placed on file. With the unanimous consent of the Senate, Senator Kalama gave notice of intention to introduce a Bill entitled "An Act to Provide for the disposition of Net profits arising from Agricultural and Industrial Pursuits in the Lahainaluna Seminary and the Waialee Boys Industrial School."

Under suspension of the Rules, Senator Kalama introduced a Bill (S. B. No. 116) entitled "An Act to Provide for the Disposition of Net Profits arising from Agricultural and Industrial Pursuits in the Lahainaluna Seminary and the Waialee Boys Industrial School."

The Bill was read first time by title and, upon motion of Senator Coelho, seconded by Senator Hayselden, passed First Reading and was referred to the Printing Committee.

Second Reading of House Bill No. 116 entitled "An Act to Establish a Retirement Fund for Pensioning retired Teachers of the Public Schools of the Territory of Hawaii, and to Regulate the Collection, Management and Disbursement thereof.”

Senator McCarthy moved to adopt the Majority Report of the Committee. Seconded by Senator Coelho.

Senator Dowsett moved to adopt the Minority Report of the Committee. Seconded by Senator Brown.

The motion to adopt the Minority Report of the Committee was then put and carried.

Second Reading of House Bill No. 197 entitled "An Act to Encourage the Extermination of Mongoose."

Senator Chillingworth moved that the Bill pass Second Reading. Seconded by Senator Hewitt and carried on the following showing of Ayes and Noes:

Ayes: Senators Chillingworth, Dowsett, Hayselden, Hewitt, Kalama, Lane, McCarthy, Makekau and Woods-9.

Noes: Senators Brown, Coelho, Gandall, Knudsen, Smith and Bishop -6.

A Communication (No. 288) from the House of Representatives, informing the Senate of its concurrence in the amendments made to House Bill No. 198, was read by the Clerk as follows:

The Senate met, pursuant to adjournment, at 9:30 o'clock, the Vice-President in the Chair.

After prayer by the Chaplain, the Roll was called showing Senators Chillingworth, Gandall and Bishop absent.

The Journal of the Fifty-Fourth Day was read, and, upon motion of Senator Lane, seconded by Senator Coelho, approved as read.

A Communication (No. 289) from the House of Representatives, returning Senate Bill No. 103, as amended, was read by the Clerk as follows:

THE HOUSE OF REPRESENTATIVES,

To the Honorable President and

Members of the Senate of the

Territory of Hawaii.

I have the honor to return herewith Senate Bill No. 103 which this day passed Third Reading in the House of Representatives of the Territory of Hawaii, with the following amendments:

Amend Section 1, line 2, by striking out the figures "$3225" and inserting in lieu thereof the figures "$7263.39", so that Section 1 shall read as follows:

"Section 1. The following sums of money, amounting to $7263.39 are hereby appropriated to be paid out of any moneys in the Treasury of the Territory, to pay certain claims against the Territory of Hawaii."

Amend Section 1 under Department of Public Lands by inserting two new items to read as follows:

"Claim of R. Maka for land taken for the widening of

Beretania Street, Honolulu.......

.$2,500.00"

"Claims of F. R. Lucweiko, damages for non-fulfill-
ment by the Government of Agreement of June
15th, 1903, in re land and buildings situated on
Beretania and King Streets, Moiliili, Honolulu...$1,500.00"

Amend Section 1, under "Department of Public Lands," by inserting a new item after item "Claim of Estate of M. V. Holmes of Ahualoa, Hamakua, Hawaii, $950.00. Improvements on Lot 16, Map 10, Ahualoa; Sold November 7th, 1906; Deposited in Treasury, January 7th, 1907," to read as follows: "Claim of Antone S. Costa, for over-payment of $38.39;

Patentee of Lot 41, Public Lands Map 41.... .38.39" Amend Section 2, lines 3 and 4, by striking out the words "Commissioner of Public Lands" and inserting in lieu thereof the words "Head of the Department under which the items are inserted," so that Section 2 shall read as follows:

"Section 2. The Auditor shall not issue warrants in payment of any of the above amounts unless receipts in full are filed therefor, and the same are approved by the Head of the Department under which the items are inserted.” Amend the total so that it shall read as follows: "$7,263.39."

A Communication (No. 290) from the House of Representatives, informing the Senate of the passage of House Bill No. 147, notwithstanding the Vetc, of the Governor, was read by the Clerk as follows:

First Reading of House Bill No. 217 entitled "An Act authorizing the repayment of money wrongfully collected for Licenses to sell imported Goods, Wares and Merchandise after the Organic Act, creating the Territory of Hawaii, took effect on the 14th day of June, A. D. 1900, and appropriating money therefor."

Senator Coelho moved that the Bill pass First Reading. Seconded by Senator Lane and carried.

Under suspension of the Rules, Senator Lane presented a Petition (No. 42) from 674 citizens and voters praying that J. Lor Wallach be permitted to treat lepers at the Kalihi Receiving Station and at the Leper Settlement at Molokai.
