Senator Coelho moved to reconsider the passage of Senate Bill No. 10 on the veto of the Governor. Seconded by Senator Dowsett and carried.

Senator Hayselden moved that the Bill, with the Message of the Governor, be referred to the Judiciary Committee. Seconded by Senator Dowsett and carried.

Senator Makekau moved to reconsider the passage of Senate Bill No. 76 on the veto of the Governor. Seconded by Senator Woods and carried.

Senator Makekau moved that the Bill pass notwithstanding the veto of the Governor. Seconded by Senator Lane.

Senator Hayselden moved that the Bill, with the Message of the Governor, be referred to the Judiciary Committee. Seconded by Senator Dowsett and carried.

Second Reading of House Bill No. 220 entitled "An Act to Amend Section 290 of the Revised Laws of Hawaii."

Senator Knudsen moved that the Report of the Committee on the Bill be adopted. Seconded by Senator McCarthy and carried. Second Reading of House Bill No. 225 entitled "An Act to Authorize the Appointment of Fiscal Agents by the Treasurer of the Territory of Hawaii, adding a new Section to the Revised Laws of Hawaii to be known as Section 1172A.”

Senator Knudsen moved that the Report of the Committee on the Bill be adopted. Seconded by Senator Smith and carried. Second Reading of House Bill No. 116 entitled "An Act to establish a Retirement Fund for Pensioning Teachers of the Public Schools of the Territory of Hawaii, and to regulate the Collection, Management and Disbursement thereof.”

Senator Chillingworth moved that action on the Bill be deferred until Wednesday, April 24th, 1007, at 2 o'clock in the afternoon. Seconded by Senator Woods and carried.

Senator Knudsen moved that House Concurrent Resolution No. I be referred to the Judiciary Committee. Seconded by Senator Hayselden and carried.

At 11:56 o'clock, upon motion of Senator Coelho, seconded by Senator Woods, the Senate took a recess until 2 o'clock.

The Communication was ordered received and placed on file. Senator Kalama moved that action on the Message (No. 24) of the Governor, vetoing Senate Bill No. 64, be deferred until tomorrow afternoon at 2 o'clock. Seconded by Senator HayIselden and carried.

At 2:05 o'clock, upon motion of Senator Coelho, seconded by Senator Hayselden, the Senate took a recess for 15 minutes. At 2:20 o'clock the Senate reconvened.

Under suspension of the Rules, Senator Lane for the Printing Committee reported Senate Bill No. 115 printed and ready for distribution.

Senator Makekau on behalf of the Miscellaneous Committee presented the Report (No. 200) of the Committee on House Bill No. 198 as follows:

Sir: Your Miscellaneous Committee has had under consideration House Bill No. 198, entitled "An Act to Define the Powers and Duties of the Superintendent of Immigration, amending Act 49 of the Laws of the Territory of Hawaii, Session of 1905, entitled 'An Act to Provide for a Board of Immigration and Defining Its Duties'," and we recommend the passage of the Bill.

The object of the Bill is to more clearly define and amplify the duties of the Superintendent of Immigration and to provide more complete means for the obtaining of information bearing

upon the subject of immigration and matters relating to immigrants domiciled in the Territory.

Senator Knudsen moved that the Report of the Committee be received and laid on the table to be considered with the Bill. Seconded by Senator Makekau and carried.

Second Reading of House Bill No. 198 entitled "An Act to Define the Powers and Duties of the Superintendent of Immigration, amending Act 49 of the Laws of the Territory of Hawaii, Session of 1905, entitled 'An Act to Provide for a Board of Immigration, and Defining its Duties.""

Senator Lane moved to strike out the word "Measures" in line 8 of Section I and insert in lieu thereof the words "Rules and Regulations." Seconded by Senator Makekau.

Senator McCarthy moved that action on the Bill be deferred until tomorrow. Seconded by Senator Makekau and carried. At 2:31 o'clock, upon motion of Senator Woods, seconded by Senator Kalama, the Senate adjourned,

The Senate met, pursuant to adjournment, at 9:30 o'clock. After prayer by the Chaplain, the Roll was called showing Senators Chillingworth, Hewitt and Lane absent.

The Journal of the Fifty-Second Day was read and, upon motion of Senator Coelho, seconded by Senator Brown, approved as read.

A Message (No. 26) from the Governor, vetoing House Bill No. 184, was read by the Clerk as follows:

A MESSAGE

TO THE LEGISLATURE OF THE TERRITORY OF HAWAII:

Herewith I return House Bill Number One Hundred and Eighty-four, entitled "AN ACT TO DESIGNATE THE PAY OF LABORERS ENGAGED IN CONSTRUCTING OR REPAIRING ROADS, BRIDGES OR STREETS, WATER WORKS OR OTHER WORKS FOR THE TERRITORY OF HAWAII, OR FOR ANY POLITICAL SUBDIVISION THEREOF," which I am unable to approve.

This Bill is similar to Senate Bill Number Twenty-seven, vetoed by my Message of March 23rd, except that in this Bill the amount which it proposes to oblige the Counties and the Territory to pay for a day's labor is reduced from $1.50 to $1.25.

Without repeating the reasons given in my previous Message, which are equally valid arguments against this Bill, permit me to add that the Legislature, great as is its power, cannot pass any law impairing the obligation of any existing contracts, so that such contracts will not be affected; nor can a law be passed limiting a person's freedom of individual contract, so that on future contracts, if a laborer is willing to and agrees to work for less than $1.25, it will not be an infringement of this proposed law.

This Bill does not require that all future Government Contracts shall contain a stipulation requiring the payment fixed by this Bill, so that no duty to insert such a condition is im
