writings affecting in law or in equity, or relating to real estate in the county of Wayne, to be recorded in the office of Register of Probate of said county, be and the same is hereby repealed.

"Sec. 3. That the third section of said act, to which this is amendatory, and the act entitled an act amendatory to the act entitled "an act concerning deeds and conveyances,” Approved the 14th of July, 1830, be and the same is hereby repealed.

"Sec. 4. That it shall be lawful for the said Register of deeds for the county of Wayne, to appoint under his hand and seal, a suitable person to be his deputy, who shall take an oath similar to the oath required of the Register of the county of Wayne; and in case of the sickness or absence of the Register, be authorised to act as Register during such sickness or absence, and for all whose acts the Register shall be accountable; and in case of death, removal, or resignation, of the said Register of the county of Wayne, the said deputy shall perform the duties of Register until a new one shall be appointed.

"Sec. 5. That all books and papers remaining in the office of Register of deeds in the city of Detroit, and all books and papers remaining in the office of Register of Probate, other than the books and records appertaining to the Probate Court of Wayne county, shall be placed in the office of Register of the county of Wayne; and the said Register shall hereafter perform all the duties heretofore required of the Register of said city and Register of Probate for recording deeds and other conveyances or other writings affecting in law or equity, or relating to real estate in the city of Detroit, and county of Wayne.

"Sec. 6. That it shall be the duty of the Register of the county of Wayne, to keep separate books for recording deeds and conveyances, or other writings affecting in law, or in equity, or relating to real estate, within the city of De

troit.

"Sec. 7. That in all cases where conveyances, or other writings affecting or relating to real estate, in the said county, situated within the said limits of the city of Detroit, have been recorded in the office of the Register of the said city only, it shall be the duty of the said Register of the county of Wayne, to record the same anew, in the proper books of record of said county, noting the dates and references of, and to the original record thereof; and all such records newly made, as herein directed, shall be valid in law.

"Sec. 8. That all deeds, conveyances, and other writings, affecting in law or equity, or relating to real estate, in the city of Detroit, which have been heretofore recorded in the office of the Register of Probate of the county of Wayne, shall be deemed and taken to be well recorded."

On motion of Mr. M'Donell, the bill and amendments, were laid on the table.

The bill to annex the county of Calhoun to the county of Washtenaw, was read a second time, and on motion of Mr. Kingsley,

Ordered, That the bill be engrossed and read a third time on Tuesday.

The bill to fix the compensation of the officers of the Legislative Council of the Territory of Michigan, and for other purposes, was read a second time, and having been reported without amendment,

Mr. Schoolcraft moved that the bill be engrossed and read a third time on Wednesday.

Mr. Drake moved to lay the bill on the table.

The question on the motion to lay the bill on the table, being taken, was decided in the affirmative.

The bill to authorise the board of Supervisors of the county of Lenawe, to raise a sum of money, to build a jail, read a third time yesterday, was taken up.

On motion of Mr. Stockton,

The bill was amended by striking out the word " thorised," and inserting the word "required," in the third line of the first section.

Mr. Stockton moved further to amend, by inserting after the word "not," in the fourth line, same section, the words" less than one half of, nor.”

The question being taken, the amendment was rejected. Mr. Drake moved that the bill pass.

The question being taken, it was decided that the bill do now pass, and that the title thereof be,

An act to authorise the board of supervisors of the county of Lenawe to raise a sum of money to build a jail. The Council went into the consideration of Executive business, and having disposed of the same,

The President submitted the following resolution:

Resolved By the Legislative Council of the Territory of Michigan, that the Secretary of War be, and he is hereby respectfully requested, to cause the rivers, called Cold Water, Swan Creek, Flag Creek, and the two Hog Creeks, at the points where the Chicago Road, so called, crosses the

aforesaid streams, to be bridged, and causeways constructed, leading to and from each stream where causeways are necessary, out of the funds that may be appropriated during the present session of Congress, towards constructing the said road; as the points herein designated are, at certain season of the year, difficult and hazardous to pass, the public interest, in the opinion of this Legislative Council, would be greatly promoted, if the requests herein contained, could be put into effect.

On motion of Mr. Drake, the resolution was adopted.
On motion of Mr. Drake,

Resolved, That the President of the Council be requested to forward copies of the foregoing resolution to the Secretary of War and the Chief Engineer.

Ön motion of Mr. M'Donell,

Resolved, That the committee on Claims be instructed to inquire into the expediency of allowing a reasonable compensation, out of the Territorial Treasury, to officers, witnesses, and jurors, and to other persons who have rendered services in capital cases, in any court in this Territory, who have applied at the present session, or at any previous session for compensation for services, and to report by bill or otherwise.

On motion of Mr. Bartow,

Resolved, That the committee on the Judiciary be instructed to inquire into the propriety of defining, more particularly, the jurisdiction of the different courts in the Territory in criminal cases, and that they report thereon.

The bill to authorise the Supervisors of St. Clair county, to erect certain bridges, and for other purposes, read a third time yesterday, was taken up.

On motion of Mr. Stockton,

The bill was amended by adding the following to stand as the fourth section thereof:

Sec. 4. That the receipts of the county Treasurer of St. Clair county, shall be received as the proper vouchers for the settlement of the accounts of the sheriff of said county, with the Territorial Treasurer.

Mr. M'Donell moved further to amend by striking out the third section, and inserting the following:

Sec. 3. That the sum of $shall be paid from the Territorial Treasury out of any moneys therein,not otherwise appropriated, which shall be applied to the erection of said bridges only, and audited and allowed by the auditor of the Territory, upon the order of the board of Supervisors of the county of St. Clair.

The question being taken, the amendment was rejected. Mr. M'Donell moved to amend the fourth section of the bill, by adding the following: Provided, the sum so paid over does not exceed two hundred dollars.

Mr. Stockton moved to amend so as to extend the sum to two hund.ed and fifty dollars.

The question on the amendment as amended, being taken, was decided in the affirmative.

Mr. Stockton moved that the bill pass.

The question being taken, it was decided that the bill do now pass, and that the title thereof be,

An act to authorise the Supervisors of St. Clair county to erect certain bridges.

THURSDAY, February 17, 1831.

Mr. Brown presented a petition from sundry inhabitants of the city of Detroit, praying a repeal of so much of the act relative to the city of Detroit, as creates the Mayor, Recorder, and Aldermen, a corporation. Referred to the committee on the Judiciary.

Mr. Fletcher from the committee on Enrolment, reported as correctly enrolled, bills with the following titles: An act for the relief of Clarissa Remington,

An act to authorise the Supervisors of St. Clair county to erect certain bridges,

An act for the relief of Delia Alvord.

An act for the relief of Luson Tousey,

An act to alter the name of the township of Jacksonopolis in the county of Jackson.

An act to authorise the board of Supervisors of the county of Lenawe to raise a sum of money to build a jail.

Mr. Lawrence from the committee on the Judiciary reported,

A bill relative to constables, and

A bill concerning divorces.

Said bills were read the first time and laid on the table. Mr. M'Donell from the committee on Territorial Affairs, to whom was recommitted the "bill to amend an act entitled an act amendatory to the several acts now in force relative to costs and fees," Approved, November 9, 1829, reported the same with amendments.

The bill and amendments were laid on the table.

The bill to prescribe the modes of proving in the courts of this Territory, judgments rendered by Justices of the Peace in the several States, was read a third time, and on motion,

Ordered, to lie on the table,

On motion of Mr. Drake,

Resolved, That the committee on roads be instructed to inquire into the expediency of appropriating so much of the Territortal taxes, as shall be assessed and collected in the county of Oakland for the years 1831, 1832, and 1833, for laying out a road from the town of Pontiac, in the county of Oakland, to the principal meridian, and thence to the mouth of the Kalamazoo river, and for opening the same.

Resolved, That the same committee enquire into the expediency of appropriating the Territorial taxes raised in each county of the Peninsula, to the constructing of roads and bridges therein.

Resolved, That the committee on Schools be instructed to inquire into the expediency of appropriating a portion of the Territorial taxes for the use and encouragement of common schools.

On motion of Mr. Bartow,

Resolved, That the committee on roads be instructed to inquire into the propriety of making some provisions for rebuilding two bridges between Spring Wells and Ten Eycks.

On motion of Mr. Kingsley,

Resolved, That the committee on Territorial Affairs be instructed to inquire into the expediency of taking some measures to enable and authorise the Treasurer of the Territory, or some other person, to purchase the land most suitable for seats of Justice in the new counties, where seats of Justice are not already established, for the benefit of the respective counties.

The resolution offered by Mr. Lawrence on the 28th ult. was taken up and read. The amendment then offered by Mr. Kingsley being withdrawn, the question was stated, on adopting the resolution, as amended by Mr. Drake, and decided in the affirmative.
