Duncan sheriff do. of Macomb, Nath'n Nye sheriff do. of St. Clair, Henry Cottrell sheriff It appears from the Treasurer's books, that the sheriff's of the above counties, have closed their accounts with the Treasurer and returned the licenses that remained on hand, on the 31st December 1830,excepting Harvey Parke sheriff of Oakland, who has not as yet accounted for three licenses which he is still to account for. County of Monroe, John Paxton ex-sheriff do. of do. Levi S. Humphrey do. The district attorney of Monroe was directed to bring suit against the ex-sheriff for delinquency. I have not been advised officially of the event of the suit, I have however understood that the suit has been quashed, but for what cause I do not know. His successor L. S. Humphreys has made a return of some taxes as above mentioned, but whether he has returned all or not, I cannot say,not knowing whether the ex-sheriff transferred any licences to him or not County of Washtenaw, B. J. Woodruff ex-sh'ff do. of do. Abel Millington do. All the licenses received by the late Sheriff of the above county have not been accounted for. The district Attorney for that county was instructed to institute a suit against him as a defaulter; his successor has paid into the Treasury the sum above stated, and it is probable he has paid all that he collected, as he was appointed Sheriff late in the year, and probably after all the licenses of that county were issued to those persons who made themselves subject to tax-and no licenses appear to be charged to him after his appointment. 57 60 85 67 130 30 22 25 9.00 50 00 12 69 $1810 79 ROBERT ABBOTT, Detroit, February 2, 1831. Mr. Kingsley from the committee on Territorial Affairs, to whom the inquiry was referred, reported, that since April 1827, when two vacancies in the board of Trustees of the University of Michigan, were filled, there had occurred three vacancies in said board by death, and two by removal from the Territory, and recommended the filling of the five vacancies. On motion of Mr. Schoolcraft, the report was accepted. A message was received from the Governor on Executive business, by the hands of Mr. Rowland. The bill to amend an act entitled "An act to prescribe the tenure of office of Auctioneers, and to levy a duty upon sales at auction in certain cases," was read the third time, and on motion, Ordered, That the bill lie on the table. to establish a board of Commissioners with auise a sum of money by lottery, and to locate, construct a free road between the city of Detroit and the River Aux Raisins in the county of Monroe, was taken up, and On motion of Mr. M'Donell, Ordered, That the bill be recommitted to the Territorial Committee. The bill establishing Courts of Common Pleas in certain counties, and defining their powers, and duties, the consideration of which was assigned to this day, was taken up, and on motion, Ordered, to lie on the table. On motion of Mr. Schoolcraft. Resolved, That the the committee on Expenditures, in concurrence with the committee on the Library, be authorised to purchase, from time to time, such books and journals as they may deem proper for the use of the Council; provided, that the amount of such purchase shall not exceed the sum of five hundred dollars. On motion of Mr. Fletcher, Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of providing by law, for the reporting and publishing the decisions of the Supreme Court and the several Circuit Courts in this Territory. On motion of Mr. Lawrence, Resolved, That the committee on Territorial Affairs be instructed to inquire into the expediency of amending the act for locating county seats, so as to require a notice to be posted up in the country where such location is proposed to be made, previous to any application to the Governor to appoint Commissioners for that purpose; and also, a notice before the Commissioners shall proceed to locate any county seat. Mr. M'Donell submitted the following resolution which was read and laid on the table: Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of allowing compensation for services rendered by the late J. V. R. Ten Eyck, clerk of the Supreme court, in the case of the United States against Levi Willard, and to the witnesses that testified in said case; And of allowing compensation to the clerk of the Circuit Court for services rendered in the case of the United States against S. G. Simmons, and compensation also to the jury that tried said case, and to the witnesses that testified on the trial; And of allowing compensation to clerks, jurors and witnesses in any court of record held in any county of this Territory for services rendered in capital cases, since the organization of the Legislative Council; and to report by bill or otherwise. On motion of Mr. Drake, Resolved, That the committee on Roads be instructed to inquire into the expediency of amending the law regulating the assessment of road or highway taxes, so as to secure a greater equality in the assessment and collection of highway taxes. On motion of Mr. Kingsley, Resolved, That the committee on the militia be instructed to inquire into the expediency of exempting those who are attached to regular bands of music in the Territory, from serving as jurors. On motion of Mr. Stockton, the Council went into the consideration of Executive business, and having disposed of the same, On motion of Mr. Drake, Resolved, That the committee on Territorial Affairs be instructed to inquire into the expediency of authorising by law, township clerks to appoint deputies, to serve in the absence or death of the township clerk, during such absence, or until the next annual township meeting. The Council adjourned. WEDNESDAY, February 9, 1831. Mr. Fletcher presented a petition from E. P. Hastings, and others, praying an act of incorporation, of the Detroit Hydraulic Company. Referred to the Judiciary commit tee. Mr. Durocher presented an account of E. D. Ellis, and an account of S. Wells, for balances for printing the Journals of the Council, and materials for the same. Referred to the committee on Expenditures. Mr. Lawrence from the Judiciary committee, reported A bill to incorporate the Stockholders of the Clinton Steam Mill Company at Mt. Clemens. The bill was read the first time and laid on the table. Mr. Schoolcraft from the Judiciary committee to whom was recommitted the "bill to repeal the act therein named," reported the same with amendments. The amendments having, on motion, been concurred in, On motion of Mr. Schoolcraft, Ordered, That the bill be engrossed and read a third time to-morrow. Mr. Fletcher from the select committee, to whom was referred the petition and remonstrance, on the subject of uniting the office of Register of Deeds for the city of Detroit, with that of Register of Probate for the county of Wayne, reported, A bill to amend an act entitled "an act concerning deeds and conveyances." The bill was read the first time and laid on the table. Mr. M'Donell from the committee on Territorial Affairs, to whom was recommitted, the Bill to establish a board of commissioners with authority to raise a sum of money by Lottery, and to locate, open, and construct a free road between the city of Detroit and the river aux Raisin in the county of Monroe, reported the same with amendments.
